ROLL CALL:

COUNCILMAN BORRELLI ATTORNEY MCGUCKIN COUNCILMAN CHISHOLM TOWNSHIP CLERK FESTINO COUNCILMAN SAUICKIE COUNCIL VICE PRESIDENT KERN COUNCIL PRESIDENT FLEMMING

ALSO IN ATTENDANCE: BUSINESS ADMINISTRATOR TERENCE WALL MAYOR MICHAEL REINA ATTORNEY BRENT POHLMAN

As Clerk of this meeting, I publicly announce that in compliance with the provisions of the “Open Public Meetings Act” adequate notice of this meeting of the Jackson Township Council has been advertised in the manner prescribed by law.

COUNCILMAN BORRELLI- Our thoughts and prayers are with the people of Ukraine. Resolution 144R-22 is in support of a bipartisan legislation (Senate Bill S-48), this Bill would subpoena powers to investigate nearly 10,000 Covid-19 deaths in New Jersey nursing homes. Families of the Covid-19 patients who died in Nursing Homes in their State deserve compassion and transparency as to what happened to their loved ones. Resolution 145R-22 is an Opposition to Democrat State Assemblyman Raj Mukherji's Bill A-26729 that would give minors consent to a number of vaccines without parental consent. Children belong to the parents not to the State and decisions concerning children's health including vaccines should be left to the parent not to the Government. He encouraged residents to call or email Assemblyman Mukherji at 201-626-4000 and Assembly speaker Craig Coughlin at 732-855-7441 to express opposition to Bill A-2679.

Registration for Jackson Township’s 2022 summer camp began on March 1st for children completing K-8th grade. The Recreation Department is accepting applications for the program and applicants must be currently completing their freshman year at a high school. The summer camp will run from June 27th to August 12th at Jackson Memorial High School. To inquire about the camp registration and applications, please call the Recreation Department at 732-928-1260 or you can visit the recreational link on the Jackson Township website.

COUNCILMAN CHISHOLM- Stay safe next week celebrating St. Patrick's Day. Resolution 143R-22 will allow Council to move forward with Rova Farms Advisory Board, Council looks forward to working with the residents to make a great opportunity for a park. He thanked Councilman Borrelli for addressing Resolutions 144R-22 and 145R-22. He agrees with Councilman Borrelli's sentiments, as the rights and privilege as parents should not be dictated by the Government. He is also in support of Resolution 144R-22, in supporting the committee to look into the investigation to our Veterans and seniors in nursing homes.

Councilman Chisholm continued to address the Constitution and if one reads the first Amendment, we have 5 specific and enumerated rights, of which, the Democrats have gone against and should be held accountable for. Governor Murphy and President Biden are to be held accountable for the laws that has been violated. It is time to stand up for those rights. He hopes that everyone contact their Congressmen, Assemblymen and Senators and make sure they follow these resolutions, regardless if they Democrats or Republicans, these are American issues. These are everyone's rights and hopes everyone stands up for that.

COUNCILMAN SAUICKIE- Commented on Resolution 133R-22, commends the Mayor and Mr. Wall for hiring a Public Relations Firm for the town. For too many years this Town has been a victim of propaganda and what he calls factual inaccuracies against the Town. This has a negative impact on the Township and its residents, hopefully the PR Firm that has been acquired will have a positive effect.

COUNCIL VICE PRESIDENT KERN – Echoed Councilman Chisholm and Councilman Borrelli’s comments in support of Resolution 144R-22. With regards to Resolution 136R-22, he thanked the Mayor and BA Wall for hiring a Grant Writer (Collier’s Engineering and Design), this will benefit the residents of Jackson with various State and public funding projects that are out there.

COUNCIL PRESIDENT FLEMMING – Glad to see more faces in the meeting. Waived Comments.

MAYOR REINA- Thanked Council for all the comments. Mayor feels that, Councilman Chisholm amazed him with his words as he spoke from the heart and to the whole nation.

BA WALL- Mr. Wall wanted the residents to be aware that this Administration is charged with delivering value to everyone in the community on a daily basis. If there is continued hate, he will ask to join together with concerned religious folks from all faiths, so everyone can express their concerns with appropriate County, State and/or Federal agencies. He welcomes all discussion. He strongly feels that Jackson residents are the lifeblood of the community and on behalf of himself and staff, “We are here to serve you, the doors of Town Hall are your doors and they are always open and available to you and your family.”

COUNCIL DISCUSSION- RESOLUTIONS ONLY

COUNCIL PRESIDENT FLEMMING Stated there are some resolutions that are creating some havoc, public comment has a limit of 5 minutes. Before public comment they will let the Counselors explain as best they can. They will write down the public’s questions and comments and answer at the end the best they can as it is still ongoing Litigation.

ATTORNEY MCGUCKIN Stated Attorney Pohlman will give a more detailed matter of the Litigation. Had Jackson Trails been a Land Use case, it would have been resolved some time ago. Unfortunately, because of comments that were made during that hearing and comments that were made by the public, it went to Federal Court which prolonged the litigation.

ATTORNEY POHLMAN Stated Resolution 140R-22 is a resolution authorizing the execution of a settlement agreement between the Township of Jackson and Jackson Trails LLC as well as some other identified plaintiffs. There are 3 reasons for the settlement agreement:

The 1st is the Statutes available to the property owners and the plaintiffs, the 2nd COAH affordable housing claims, and the 3rd is the public entities comments that were made on record. The settlement will be effectuated in two parts with a plan A moving forward initially and then plan B once the documents are finalized. The goal is to have this matter wrapped up in its entirety within 6 to 12 weeks. There are no further comment as it is still in litigation.

PUBLIC COMMENT OPENED, RESOLUTIONS ONLY

SHELDON HOFSTEIN-48 BALTUSROL DRIVE – Asked will the Builder be a hearing to the Federal Fair Housing Act when it comes to discrimination as to religion? Will 20 percent of the homes be set aside for affordable housing? Is the house of Worship not on the main road or in middle of the community? Will there be a variance needed? If this is a specific type of community within the RG2 zone and is a new zoning ordinance needed? Will the community only be sold to the Orthodox Jewish faith? Will the sales be limited to a single sector of those?

Council Vice President Kern informed the Attorney will answer all questions at the end.

ELENOR HANNUM- RESIDENT- Asked why it is settling with other LLC's that were not a part of the Jackson Trails project to begin with.

SARAH FROINT- RESIDENT- Feels hatred. Enjoys living in this Township. Thanked the Mayor for all that he has done.

RICHARD CIUILO -215 GRANT AVENUE SEASIDE HTS - Wanted to know why this case is being settled.

Council President Flemming reiterated again that this matter is still in litigation.

JOSEPH SULLIVAN- 31 CATHY COURT- Opposed the settlement due to Environmental reasons.

ERIC HANNUM-RESIDENT- Asked if there are any constraints to the Deeds of who can and can't own these units?

THOMAS BRADLEY-4 WEST VIRGINIA ROAD – Commended the Council on their vigilance and what they have done. He believes that this matter would open up the Township for a future lawsuit with violating the First Amendment.

ROGER DERICKSON- 10 LAURELTON AVENUE – Asked are there any more potential lawsuits in the future?

JENNIFER CUSANELLI - 14 BLUE SPRUCE DRIVE – Addressed Council and asked if they are you still going to settle?

ATTORNEY POHLMAN-Provided the following response to the public's comments:

  • Everyone is treated the same under the law and the Governing Body is obligated to obey by those laws.
  • With regards to the location of the House of Worship Mr. Pohlman stated that if it was moved to a different location it could not be done with in the RG 3 zone and be in compliance.
  • With regards to Community laws, Mr. Pohlman stated that there is no HOA, however, the Community laws will obey by local ordinances and follow local code.
  • With Regards to those LLC's, they do own property and they have to settle with those claims.
  • Attorney Pohlman reviewed the record and there was no acknowledgement during the hearing for the use of the House of Worship and it does comply with the RG 3 zones.
  • Regarding the restricted covenants the answer is no, the use is still Governed by our ordinances and zones. The individual property homeowner's will have privacy screens, fences and will have to maintain their property.
  • Regarding the settlement, it does not violate the establishment clause.
  • With regards to this particular lawsuit it will not bring up another lawsuit.

ATTORNEY MCGUCKIN informed the residents that the Fair Housing Act does applies. The House of Worship does not require a variance to the zone, Public law does apply within that development.

PUBLIC COMMENT, ANY TOPIC

DIANE C. FESTINO, R.M.C. TOWNSHIP CLERK

SHELDON HOFSTEIN-48 BALTUSROL DRIVE— Asked followed up questions is this a complete settlement or will there be another vote on the final settlement? Attorney McGuckin advised there will be no other vote made by the Governing Body. Mr. Hofstein stated if anything else is added to this

settlement, it will be automatically approved. Attorney McGuckin stated that anything the Governing Body approved would be with the settlement, if there is additions, they would have to come back. The lawsuit was based on comments by residents of the community and Mr. Hofstein wanted to know if any of these residents were deposed. Attorney McGuckin advised their comments are on the record. Mr. Hofstein wanted an update on resolutions to be considered for the State to pay for school busing. Council President Flemming told Mr. Hofstein that there are no updates, however there is movement in the funding formula and they are waiting. Mr. Hofstein asked about establishing school zones to keep busing limited to 1 or 2 areas. Council President Flemming stated that is part of the Master Plan which is redone every 10 years, and it will not change the schedule of the Master Plan.

ELENOR HANNUM- RESIDENT- After the last meeting, residents are not receiving the information and/or getting any responses from the Township. There are safety issues with regards to the illegal U-turns, idling illegally and speeding issues on Woodlane as children wait for their buses.

She addressed several concerns, such as, the Mayors duties from previous year, her OPRA extension, the lawsuit with Agudeth of Israel, and the meeting that was held with the LSTA.

Attorney Pohlman stated regarding the Agudeth litigation that the Mayor should not make comments about any individual in public that the Township is engaged in litigation with. BA Wall stated with regards to the traffic concerns, the Chief of Police and the Code Enforcement Supervisor Mr. Cheney is in attendance and will have the chance to comment on her traffic concern.

CHIEF KUNZ- Advised Ms. Hannum, that there was a recent traffic on Oregon Avenue. Due to numerous traffic incidents, he has set up heavy police presences with in the Township to monitor traffic safety. Requested that Ms. Hannum contact him directly with any future traffic safety concerns/issue.

ANDY CHENEY-Mr. Cheney advised for the month of January, there was $46,000 in housing fees and penalties. In February, they were over $53,000. The contractors at Adventure Crossing has addressed the construction light. Code enforcement has been to the site to take a proper reading of the bid screen on Monmouth Road. Mr. Cheney stated that all construction work could commence at 7 AM instead of 4 AM, 7 days a week, up to a half hour before sundown. No resident should tolerate a 4 AM start, and will not be tolerated.

SUSAN COOPER- 22 WILLETTA DRIVE- Has been a resident of the town for 22 years loves Jackson. She is upset about the over building and wants it to stop. Ms. Cooper wants quality of life and persevere land.

Council President Flemming stated unfortunately anyone who owns a piece of land has the right to develop on their land. The upside is the residents of Jackson were gracious enough to grant 3 cents per 100 for Open Space funds. They do have money to buy land but the constraint with that is they can only buy it for the appraised value and the values of land in Jackson are high right now, and they are having trouble meeting the criteria and having trouble spending the money. They do hear the residents and they are trying to get the job done.

ERIC HANNUM- RESIDENT- Mr. Hannum asked about the LSTA meeting with an adversary and questioned if Council was present. Attorney McGuckin advised Council was not present.

TINA KOWALESKI- 437 CASSVILLE ROAD- Was raised in Jackson and moved to Lakewood. She had concerns with the trees being cut down by the developers and wanted to know what the process was to have them replaced.

JUSTIN GRAVES- 9 PARKSIDE DRIVE – Wants to keep quality of life in Jackson.

RICHARD CIUILO – 215 GRANT AVENUE SEASIDE HTS- Feels the meeting with LSTA and the attendance of the meeting would have been better if they had invited a member from the Board of Education and have a representative for the community. He feels that the Mayor had good intentions, however, the way that the meeting was handled, it was taken out of context. He addressed an OPRA request, and Attorney McGuckin stated the investigation was completed, however, it cannot be disclosed as it is a personnel matter.

JENNIFER CUSANELLI - 14 BLUE SPRUCE DRIVE- Inquired about her OPRA request. Attorney McGuckin advised the investigation is completed and the matter cannot be disclosed as it is falls under an OPRA exemption (personnel matter). She addressed the safety concerns for her children as they stand and wait for the bus on Stump Tavern Road because there are no sidewalks or shoulder and the speed is 55mph.

Mayor Reina as address these concerns with the Ocean County Engineer, Township Engineering, Jackson Police Department Traffic Safety Bureau and the road department office to discuss the speed limits in Jackson and how we can safely lower it. The County is giving recommendations to traffic safety. His office and the Engineer will be copied. Mayor Reina will speak with Ms. Richardson (Board of Education)

Council Vice President Kern commented that the Township is working with owners and developers on a portion of land so the curve on Freehold Road is made safer.

KEITH JOLLIFFE -5 HOLLY TREE COURT- would like developer to adhere to the decimal level established in the Township ordinance. Attorney McGuckin stated new construction is okay to work at any hour. Councilman Sauickie requested Mr. McGuckin to define the ordinance clearly for him so there is a clear understanding and that it is fair to everyone.

Mr. Jolliffe asked about the berms being built along the back of Holly Tree Court along the front of Anderson Road and the back of Perrineville Road. Council directed Mr. Jolliffe to contact Mr. Purpuro, the Zoning Official on this issue.

Mr. Jolliffe addressed his concern for the ordinance of limitations for stadium lighting and construction lighting and the hours of operation. Council President Flemming stated the construction lights according to the Code Enforcement official, are now turned inwards to the property. Council President Flemming informed Mr. Jolliffe there are ordinance for lighting a property and referred him to contact Mr. Purpuro the Zoning Official. BA Wall advised Mr. Jolliffe to facilitate a conference call with the developer and residents about the issues and how they can fix the problem.

JEFF NEMETH- PERRINEVILLE ROAD- Stated that construction business can work 12 hour days. Concerns about traffic problems with the projects being developed. Mayor Reina has no authority to stop construction or telling somebody they can't develop. Mr. Nemeth feels that there will be more lawsuits. Mayor Reina stated those who sit on Planning Board are going to hear the applications. Attorney McGuckin stated this Council, the Mayor's office or no one can stop the building of any development. People are selling properties at a rate that has never been before and not just here in Jackson.

TINA KOWALESKI- 437 CASSVILLE ROAD – inquired how an individual is able to apply for the 20% low income housing. BA Wall advised the administration process is highly regulated by the State and the developer will have their own administrative agent. There is a processes and statues they have to follow. Ms. Kowaleski wanted to know if they will follow through once the community is built and make sure only one family is living in a single dwelling. Attorney McGuckin advised Council not to answer due to the Litigation.

BA Wall stated the previous speaker addressed a number of issues tied with traffic and future development. Administration is working with New Jersey transportation and looking into capital drainage enhancing milling and paving. The engineering firm will provide a real grading of the all the streets. This will provide a real grading on streets and the data will be submitted to Council review. He will ask the DOT in coordination with Monmouth and Ocean County to check Route 537, and the choke point on Monmouth Road. There are federal funds available.

ED BANNON-22 ABERCORN COURT – Asked when will Brewers Bridge Road be paved. BA Wall will ask Engineering. Mayor stated that the issues are the utility poles and residents will need to move their mailboxes.

TRACEY MCKINNEY- 7 HOLLY TREE COURT- Wanted an update as to when the burms will be done. Commended Council for looking into the construction lights affecting households, and making it fair for all developers that construction start at 7 AM. Ms. Mckinney addressed her concern about sports being held 7 days a week until 1 AM and would like Council to look into it.

Ms. Mckinney wants Council to look into the timing of the traffic light delay in front of the outlets, Route 537 and the ramp coming off of Rt. 195. Council President Flemming stated those are County Roads. Mayor informed Ms. Mckinney that they did engage Monmouth and the States DOT, Federal Highway through Congressman Chris Smith for assistance on this issue, this hasn't been addressed for over 20 years but they are actively addressing the issue.

Ms. Mckinney concern about the winds and dirt crossing over Anderson Road and all over Rt. 195 from the construction site. She feels that there should be commercial trucks watering down the dirt and debris on a daily basis. Mayor Reina advised Ms. Mckinney that it is part of the agreement that the water trucks are supposed to water down the dirt and Code Enforcement needs to get a call about that.

RICHARD CIUILO –SEASIDE HTS – Stated that a fully conforming application cannot be denied. Attorney McGuckin stated the Township has no legal authority to implement a legal building moratorium in the Municipality.
