MAYOR REINA- Thanked Council for all the comments. Mayor feels that, Councilman Chisholm amazed him with his words as he spoke from the heart and to the whole nation.

BA WALL- Mr. Wall wanted the residents to be aware that this Administration is charged with delivering value to everyone in the community on a daily basis. If there is continued hate, he will ask to join together with concerned religious folks from all faiths, so everyone can express their concerns with appropriate County, State and/or Federal agencies. He welcomes all discussion. He strongly feels that Jackson residents are the lifeblood of the community and on behalf of himself and staff, “We are here to serve you, the doors of Town Hall are your doors and they are always open and available to you and your family.”

COUNCIL DISCUSSION- RESOLUTIONS ONLY

COUNCIL PRESIDENT FLEMMING Stated there are some resolutions that are creating some havoc, public comment has a limit of 5 minutes. Before public comment they will let the Counselors explain as best they can. They will write down the public’s questions and comments and answer at the end the best they can as it is still ongoing Litigation.

ATTORNEY MCGUCKIN Stated Attorney Pohlman will give a more detailed matter of the Litigation. Had Jackson Trails been a Land Use case, it would have been resolved some time ago. Unfortunately, because of comments that were made during that hearing and comments that were made by the public, it went to Federal Court which prolonged the litigation.

ATTORNEY POHLMAN Stated Resolution 140R-22 is a resolution authorizing the execution of a settlement agreement between the Township of Jackson and Jackson Trails LLC as well as some other identified plaintiffs. There are 3 reasons for the settlement agreement:

The 1st is the Statutes available to the property owners and the plaintiffs, the 2nd COAH affordable housing claims, and the 3rd is the public entities comments that were made on record. The settlement will be effectuated in two parts with a plan A moving forward initially and then plan B once the documents are finalized. The goal is to have this matter wrapped up in its entirety within 6 to 12 weeks. There are no further comment as it is still in litigation.

PUBLIC COMMENT OPENED, RESOLUTIONS ONLY

SHELDON HOFSTEIN-48 BALTUSROL DRIVE – Asked will the Builder be a hearing to the Federal Fair Housing Act when it comes to discrimination as to religion? Will 20 percent of the homes be set aside for affordable housing? Is the house of Worship not on the main road or in middle of the community? Will there be a variance needed? If this is a specific type of community within the RG2 zone and is a new zoning ordinance needed? Will the community only be sold to the Orthodox Jewish faith? Will the sales be limited to a single sector of those?

Council Vice President Kern informed the Attorney will answer all questions at the end.
