ATTORNEY PAT VARGA TOWNSHIP CLERK KISTY
ALSO IN ATTENDANCE: BUSINESS ADMINISTRATOR TERENCE WALL MAYOR MICHAEL REINA
As Clerk of this meeting, I publicly announce that in compliance with the provisions of the “Open Public Meetings Act” adequate notice of this meeting of the Jackson Township Council has been advertised in the manner prescribed by law.
COUNCIL PRESIDENT KERN- COMMENTS- Tonight we have two Presentations and the Mayor will have two Proclamations. For the past two years I’ve witnessed a number of new hires and promotions within the Police Department at the beginning of Council meetings and then after they and their families have all left I’ve said wonderful things about the men and women who make our Police Department to a half empty room. Well tonight I get to speak before they leave thanked each and every member in our Police Department for all that you do; keeping us safe. This Council stated that our Police Department is second to none in the State of New Jersey. Our officers care about our community and our residents in our Town. Just this past year there have been a number of situations handled with unparalleled professionalism resulting in resolution to situation that that could have gone very bad. Thanked the families of the Police Officers to allow their loved ones to leave their homes to protect ours.
PRESENTATION OF POLICE OFFICERS- Three new Police Officers are here tonight. Zachary Schwartz Police Officer badge 323 will be a fulltime Police Officer. Captain Laskiewicz presented Zachary badge 323, Tyler Melnick Class 2 Special Police Officer and David DeJesus Jr. Special Class 2 Police Officer.
Captain Laskiewicz read their biographies into the record and Clerk Janice Kisty sworn them in.
Proclamation National Library Week- Councilman Borrelli read into the record.
Proclamation-Education Day- Mayor Michael Reina read into the record. The Mayor shared the Proclamation with Rabbi Shmuel, Thanked the Mayor, President and Council for the Proclamation; Education especially this year is in the purview and experience of every single person. As educators are not only teachers this year we have seen that parents are educators and every one of us are educators in our circle and everyone around us; message today view ourselves as Educators. Presented a book to the Mayor.
Presentation of Jackson Board of Education-
Nicole Pormilli Superintendent- thanked Council and especially Council President Kern for making them aware of this opportunity to get this grant. The schools grant will replace two very old garbage trucks.
John Blair- By way of history, Volkswagen got in trouble for misreporting their diesel emissions, and the result was $37 million to the State which was distributed; we are going to eliminate as many diesel run vehicles of the road as possible. The whole purpose of this grant when Council President Kern first let us know about it last July and the deadline was sometime at the end of the month to get two electric powered garbage trucks replacing diesel trucks. One is from 1996 and the second one is from 2006. Both trucks will eliminate about 25 tons CO2 greenhouse gases each year. Cost savings about $10,000 in diesel. The trucks run about 125 miles per charge. The charging station will be at Liberty bus lot. It will take a while; they still have to build the trucks. The amount of the Grant was for a little over $1.1 million dollars significant cost savings to the district the charging stations are included in the grant. What we have been doing with the school district for over four years ago we started an Energy Conservation Program since then won several mini grants. 19 schools in the State of New Jersey and three of them are here in Jackson. Speaking of the schools, next store Switlik Elementary School will be recognized as a National Green Ribbon School through the Department of Education. Our energy program has been chopped about 2.4 Million dollars past four year’s off the budget reducing the energy budget itself. ESIP- Energy Savings Improvement Program which is a large construction project which creates a net zero cost to the tax payer all the upgrades are energy efficient upgrades; $26 Million dollar project.
COUNCILMAN BORRELLI - Always nice to see the JTPD at the Council meeting thanked them for their service. Great news from our Education Officials regarding saving taxpayer's money. Recreational Marijuana law concerns with taken parental rights away and making the job of a Police Officer harder due to the new law. Helpful links Covid 19 vaccine are on the Jackson Township website; Rite Aid on North New Prospect Road is offering the vaccine. Complaints about Altice the State hearing was on March 16, 2021 hopefully the issue Optimum services will be fixed and fast.
COUNCILMAN CHISHOLM- Congratulated on the Board of Education on their grant that is wonderful news for all of us.
Congratulated the Police Officers on their promotions look forward to seeing them out there serving our community for a long time and for the years to come; wished them a long and healthy career.
National Library Week I know once we are not kids anymore we do not read and I certainly encourage you to get off the screen for once; pick up a book and instill in your children a lifelong habit of reading it is beneficial to you I would highly encourage it.
COUNCILMAN SAUICKIE -Two of my favorite things about this Town were highlighted tonight. First is our Police Department which is as the Council President said our Police is second to none to the State. Constantly keeping our rank among the safest towns in the State among the lowest percentage of hate crimes. Second favorite thing to talk about is the Jackson school district and he thanked the teachers and thanked the Board of Education for everything they do.
COUNCIL VICE PRESIDENT FLEMMING - Welcomed our new Police Officers and we are diffidently proud of our Police Department. We are also proud of our EMS Fire Departments- all four went over to Lakewood about a week or so ago to help with fires. Our companies handled four structure fires in Lakewood alone along with the brush fire. At the same time our companies were a spilt squad were doing the same thing in town had one structure fire and 8 other calls. We have a lot to be proud of in this town and it's important to let them know that.
COUNCIL PRESIDENT KERN- Congratulated the Police Officers and thanked Board of Education for coming out tonight telling all the residents about the wonderful grant.
A simple application can provide a tremendous upgrade for new equipment, supplies or program funding. $1.1 million is not bad for a few dozen hours' worth of work and effort. Tonight our Council is asking the Administration to prepare and advertise to receive bids for grant writing services; so we have dedicated services searching out and applying for grants that are out there. The return on investment for these services for tax payers is amazing. Has been proven by other Towns, it is time for Jackson to focus on these opportunities that will help all of our residents.
MAYOR MICHAEL REINA- Echo comments of the Council tonight and who they are acknowledging. When you say thanks, our Township workers as a whole really do a good job especially handling the pandemic and everything that goes with it. On a more somber note Jackson Township extends their sympathies in Boulder (Colorado). We want our friends to know that we are with them our thoughts and prayers will be with them always. 13 years sitting up here what I have been saying to the residents is to become more involved in the town and outside world. Township website has information and anything else you need the Council is always available, my Administration is always there their phones are always on even after hours however you know how to get a hold of us.

RESOLUTION 143R-21 TITLE: RESOLUTION URGING THE IMMEDIATE REPEAL OF SENATE BILL NO. 3454 (P.L. 2021 C.25)
MOTION TO APPROVE BY: BORRELLI MOTION SECONDED BY: CHISHOLM YES: BORRELLI, CHISHOLM, SAUICKIE, FLEMMING, KERN
WHEREAS, Public Question 1, the :Marijuana Legalization Amendment", was on the ballot in New Jersey as a legislatively referred constitutional amended on November 3, 2020; and
WHEREAS, the text of the ballot question provided as follows:
CONSTITUTIONAL AMENDMENT TO LEGALIZE MARIJUANA
Do you approve amending the Constitution to legalize a controlled form of marijuana called "cannabis"?
Only adults at least 21 years of age could use cannabis. The State commission created to oversee the State's medical cannabis program would also oversee the new, personal use cannabis market.
Cannabis products would be subject to the State sales tax. If authorized by the Legislature, a municipality may pass a local ordinance to charge a local tax on cannabis products.
WHEREAS, Public Question 1 was approved (67.8% Yes votes and 32.92% No votes); and
WHEREAS, on February 22, 2021, Governor Phil Murphy signed into law legislation legalizing and regulating cannabis use and possession for adults 21 years and older (A-21, The New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act) and decriminalizing marijuana and hashish possession (A-1897). The Governor also signed S-3454, addressing marijuana and cannabis use and possession penalties for individuals younger than 21 years old and imposing criminal penalties on law enforcement officers; and
WHEREAS, the majority of New Jersey residents last fall voted in favor to legalize marijuana for use by adults at least 21 years of age. There is no question, nor debate, on the outcome of the ballot question. However, New Jersey residents were not aware at the time of their vote that this would eventually lead to the New Jersey Legislature voting to make law enforcement officers "guilty of a crime" if they notify parents of children under the age of 18 that their child was caught with marijuana or alcohol, on the first offense; and
WHEREAS, Senate Bill No. 3454 was voted on, passed and signed into law with less than one hour left before the legalization of marijuana was scheduled to become law; and
WHEREAS, as a result of this law, our law enforcement officers will be guilty of a crime if they notify parents that an underage child is using or in possession of marijuana or alcohol on their first offense. Only if the child is found again using or in possession can a law enforcement officer notify the parents; and
WHEREAS, the legislation is treacherous to law enforcement officers because it creates a penalty of 3rd Degree Deprivation of Civil Rights if an officer uses the odor or possession of marijuana or alcoholic beverages as the reason for initiating an investigatory stop of a person. The new law states that a law enforcement officer cannot use the odor or marijuana or alcohol as reasonable articulable suspicion to initiate an investigatory stop. The new law states a minor cannot consent to be searched and that a law enforcement officer no longer has probable cause to search a minor for illegally using
Page 18 of 34
marijuana or alcohol. And if an officer violates a minor's rights by using pot or alcohol as the reason for a search then the officer will be charged with the crime of deprivation of civil rights; and
WHEREAS, Senate Bill No. 3454 establishes penalties of only warnings for illegal use by minors of marijuana or alcohol but it essentially prevents an officer from even approaching a person suspected of being a minor. The smell of marijuana and its use in the presence of a law enforcement officer will no longer be grounds to search an individual. While marijuana is now legal for those 21 and older Senate Bill No. 3454 is an assault on law enforcement's ability to enforce the law. Senate Bill No. 3454 is an attack on law enforcement officers by making law enforcement officers the target of punishment rather than the individuals breaking the law. This language will have dangerous consequences for the public and law enforcement officers.
NOW, THEREFORE, BE IT RESOLVED, that the Township Council of the Township of Jackson, County of Ocean, State of New Jersey finds as follows:
- Senate Bill No. 3454 was passed with little to no discussion, no public transparency and no public debate.
- By passing Senate Bill No. 3454, the Legislature and Governor Phil Murphy ignored the judgment of parents over the lives of their children. The requirements of the new law will keep parents in the dark about what may be happening in their children's lives. It shows children there are no major consequences if they are found using marijuana or alcohol for the first time. Parents should have the right to know if their child is using or in possession of marijuana from the first encounter and be given the chance to discuss the consequences before it potentially becomes a larger issue.
- Senate Bill No. 3454 takes a huge step backward on the path of ensuring children are aware of both the short-term and long-term consequences of drag and alcohol use. Essentially, the Legislature is telling the children they have one "free pass" to get caught with marijuana or alcohol before there are any real consequences.
- Senate Bill No. 3454 unfairly and unreasonably imposes criminal penalties on law enforcement officers if they are found to have violated new rules dictating underage possession. The odor or cannabis or alcohol will no longer be enough to justify a search. The same holds true for "the unconcealed possession" of an alcoholic beverage, marijuana, hashish or cannabis item, according to the bill text.
- Senate Bill No. 3454 turns law enforcement officers into criminals. It establishes a legal set of enforcement powers, but it criminalizes the actual enforcement of those powers.
- Senate Bill No. 3454 contradicts a prior law that banned smoking tobacco products on beaches and boardwalks, but now that law may be essentially unenforceable when it comes to smoking marijuana on beaches and boardwalks. Underage users of marijuana will now be free to smoke it anywhere, including in places the law says is illegal, because merely stopping a person to enforce the law is now illegal for police. Drug dealers will quickly learn to hide their drugs, guns and evidence of crimes on anyone under 18 years of age since merely lighting a joint as the officer approaches will put the officer in jeopardy of making an illegal search and being charged criminally.
- Senate Bill No. 3454 goes well beyond the express terms of the ballot question and the intent of New Jersey's voters when they approved the question.
- Governor Murphy and the State Legislature should take urgent steps to repeal Senate Bill No. 3454 to protect our children and law enforcement officers.
- A certified copy of this Resolution shall be forwarded to Governor Phil Murphy, the State Legislature, Ocean County Board of Commissioners, NJ State League of Municipalities, NJ Municipal Management Association, and NJ State PBA.
