RESOLUTION 148R-21 TITLE: AUTHORIZE AS-BUILT/CLOSE-OUT CHANGE ORDER NO. 1 TO THE CONTRACT BETWEEN THE TOWNSHIP OF JACKSON AND CAPTAIN CONSTRUCTION FOR THE PROJECT KNOWN AS “2019 ROADWAY DRAINAGE IMPROVEMENTS” WHEREBY DECREASING THE CONTRACT AMOUNT BY $16,567.20 RESULTING IN AN ADJUSTED CONTRACT PRICE IN THE AMOUNT OF $178,331.80

WHEREAS, the Township of Jackson previously awarded a contract to Captain Construction for the project known as “2019 Roadway Drainage Improvements” in the amount of $194,899.00; and

WHEREAS, Township Engineer, Julio Vega, Jr., has recommended the approval of As-Built/Close-Out Change Order No. 1, decreasing the contract by $16,567.20 as a result of final as-built quantities (per attached “Schedule A”); and

WHEREAS, the approval of this As-Built/Close-Out Change Order #1 will result in the return of the performance guarantee posted for this project. The return of said performance guarantee will be contingent upon the posting and acceptance of any required Maintenance Guarantee.

WHEREAS, it is now the desire of the Township Council to act upon the Engineer's recommendation and to approve said Close-Out Change Order No. 1.

• NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Jackson, County of Ocean and State of New Jersey, as follows:
• That the Township Council hereby formally approves and authorizes As-Built/Close-Out Change Order No. 1 to the contract between the Township of Jackson and Captain Construction, decreasing the contract by $16,567.20 for the project known as “2019 Roadway Drainage Improvements” resulting in an adjusted contract price in the amount of $178,331.80.
• That upon the adoption of the within resolution, the Township Clerk is authorized and directed to forward a certified copy of it to the Township Engineer, Julio Vega Jr.; Sharon Pinkava, Purchasing Department, Captain Construction and any other interested parties.

TITLE: RESOLUTION AUTHORIZING PROFESSIONAL ENGINEERING SERVICES WITH T&M ASSOCIATES FOR FY 2021 ROADWAY IMPROVEMENT PROGRAM DESIGN, CONSTRUCTION ADMINISTRATION AND INSPECTION SERVICES IN AN AMOUNT NOT TO EXCEED $191,875.00

WHEREAS, there exists a need for professional engineering services related to the FY 2021 Roadway Improvement Program; and

WHEREAS, the performance of these services requires knowledge of an advanced type in a field of learning pursuant to N.J.S.A. 40A:11-2, and the Township has determined that T&M Associates has the ability and expertise to perform the Municipal services required by the Township and is duly qualified to serve as Special Engineer; and
