620 WEST LACEY ROAD FORKED RIVER, N.J. 08731 AN ORDINANCE OF THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF JACKSON, COUNTY OF OCEAN, STATE OF NEW JERSEY, SUPPLEMENTING CHAPTER 244, ARTICLE XII ENTITLED DESIGN STANDARDS AND IMPROVEMENT SPECIFICATIONS, TO INCLUDE SECTION 244-209.2, WHICH ESTABLISHES STORMWATER MANAGEMENT REQUIREMENTS FOR NON-MAJOR DEVELOPMENTS
SECTION 1. §244-209.2 Stormwater management for Non-Major Developments
- Scope and purpose.
- The purpose of this section is to establish minimum stormwater management requirements and controls for "non-major development".
B. Applicability.
- This chapter shall be applicable to any development not classified as a major development under §244-209, Stormwater management, and §244-209.1, Stormwater management in Pinelands Area, and shall be hereafter referred to as a "non-major development."
- For the purpose of this section, "Impervious Surface" shall include:
- Driveways, of all material types;
- Patios and walkways, of all material types;
- Roof areas, both principal and accessory structures;
- Swimming pools;
- Decks, with roofs above and/or impervious cover below;
- In cases where Pinelands regulations or another outside agency's regulations both apply, the stricter regulation providing greater protection to natural resources controls and takes precedence.
C. Stormwater management requirements for Residential Non-Major Development.
- a. For any residential non-major development that results in a net increase in impervious cover of 1,000 sf or greater, drywells must be provided and
sufficiently sized to store one cubic foot for each 10 square feet of new impervious cover.
- Provisions shall be made for overflow of excess drainage. Overflows shall be discharged to downstream pervious areas as overland flow. Direct piping of downspouts to the curb or to a stormwater runoff conveyance system will only be allowed in situations where sheet flow is impractical or would create hazards to property.
- Residential property owners shall be restricted from removing drywells or placing structures on the ground surface above the same, without further approval by the Township Engineer as part of a formal Building and/or Zoning Permit approval.
- Stormwater management requirements for Non-Residential Non-Major Development.
- For any non-residential non-major development that results in a net increase in impervious cover of 1,000 sf or greater, for each 10 square foot of new impervious surface; 2.5 cubic feet of stormwater shall be managed without overflow using one or more of the green infrastructure practices set forth in Table 1 below.

COUNSELLORS AT LAW
620 WEST LACEY ROAD FORKED RIVER, N.J. 08731 sufficiently sized to store one cubic foot for each 10 square feet of new impervious cover.
*The use of dry wells is allowed only where the other listed methods cannot feasibly meet the requirements of this section.
- In such cases where it is determined that the out flow from the stormwater management system will impact an adjacent property, the out flow shall be directed to a storm sewer, gutter, swale, or other suitable stormwater runoff conveyance measure.
- If the Township Engineer (or Board Engineer, where applicable) determines that the out flow from the stormwater management system will negatively impact an adjoining property and the out flow cannot be safely directed to a storm sewer, gutter, swale, or other suitable stormwater runoff conveyance measure, the stormwater runoff from the development shall be retained on-site at a rate of 4 cubic feet of storage for each 10 square foot of new impervious surface using green infrastructure practices or such other measures as may be required by the Township Engineer (or Board Engineer, where applicable).
- The stormwater management feature shall be protected from future development by drainage easement, deed restriction, or other acceptable legal measures.
- Maintenance and repair:
- Projects subject to review of this section (§244-209.2D) shall comply with the same maintenance and repair requirements for “Major Developments” as set forth in §244-209J(2) §244-209J(3), and shall also comply with the requirements of §244-40, Stormwater management system maintenance.
- Whenever the stormwater management design includes one or more BMPs that will infiltrate stormwater into subsoil, the design engineer shall perform a
Groundwater Mounding Analysis as outlined in the NJDEP BMP Manual, Chapter 13, in order to assess the hydraulic impact on the groundwater table and design the site so as to avoid adverse hydraulic impacts. Potential adverse hydraulic impacts include, but are not limited to, exacerbating a naturally or seasonally high water table, so as to cause surficial ponding, flooding of basements, or interference with the proper operation of subsurface sewage disposal systems or other subsurface structures within the zone of influence of the groundwater mound, or interference with the proper functioning of the stormwater management measure itself.
E. Additional Requirements.
- All such non-major development shall be subject to review by the Township Engineer (or Board Engineer, where applicable) to determine that stormwater runoff created by the development is adequately controlled and does not cause an adverse impact on adjoining properties.
- All such “Mixed Use” non-major development, consisting of both residential and non-residential development on the same lot, shall be subject to the requirements set forth in §244-209.2D, Stormwater management requirements for Non-Residential Non-Major Development.
- For the purpose of sizing drywells and underground small-scale infiltration basins, clean stone has an acceptable void ratio of 0.30.
- For the sizing of drywells, infiltration shall not be accounted for in the sizing of the required storage volume.
- Soil Testing shall be performed to confirm the permeability of the soils and the depth of the water table and seasonal high-water table.
- DASTI, McGUCKIN, McNICHOLS, CONNORS, ANTHONY & BUCKLEY
- A minimum of 2 ft. of separation is required from the bottom of all drywells to seasonal high-water table.
- The design of all BMPs shall adhere to the guidelines set forth in Chapter 13 of the NJDEP BMP Manual, unless specifically modified herein.
COUNSELLORS AT LAW
620 WEST LACEY ROAD FORKED RIVER, N.J. 08731 Groundwater Mounding Analysis as outlined in the NJDEP BMP Manual, Chapter 13, in order to assess the hydraulic impact on the groundwater table and design the site so as to avoid adverse hydraulic impacts. F. Exceptions.
- For any non-major development located on a lot created as part of a Major Site Plan and/or Major Subdivision approved by the Planning or Zoning Board on or after February 2, 2004, where adequate stormwater management BMPs meeting NJAC 7:8 have been provided and approved, the requirements of §244-209.2 do not apply. This exemption is void if:
- The proposed development exceeds the permitted impervious coverage for the property's zoning district.
- If the subject lot has been further subdivided and/or consolidated with other properties.
- If any new net impervious cover is graded in a manner that stormwater runoff bypasses the previously approved stormwater management BMPs for the development and/or is graded in a manner that it will negatively impact adjacent properties, subject to review by the Township Engineer (or Board Engineer, where applicable).
G. Variances.
- A variance from strict compliance with the requirements of this section may be granted by the reviewing board for those projects where an applicant has demonstrated the inability or impracticability of strict compliance with the stormwater management requirements in this section.
- In those cases where a non-major development does not require approval of the Planning Board or Zoning Board, but a building permit is required, any party
aggressed by any decision of the Township Engineer acting under this Section as part of the building permit process shall have the right to petition the Mayor and Council to review the Township Engineer's decision. If the Mayor and Council decide that, due to the peculiar or unique circumstances of the matter, strict compliance is not practical or would create an undue hardship, then the Mayor and Council may, on such terms and conditions as they deem appropriate, waive any requirements set forth by the Township Engineer.
SECTION 2. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions hereof.
SECTION 3. This Ordinance shall take effect after second reading and upon publication, as required by and in conformance with law.
