ORDINANCE NO. 2026-29

AN ORDINANCE OF THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF JACKSON, COUNTY OF OCEAN, STATE OF NEW JERSEY REPEALING AND REPLACING CHAPTER 350

BE IT ORDAINED by the Township Council of the Township of Jackson, County of Ocean, State of New Jersey, as follows:

SECTION 1. Chapter 350, entitled "Short Term Rentals" is hereby repealed and replaced in its entirety as follows:

§ 350-1. Purpose and scope.

  • The Township of Jackson is authorized to regulate buildings used for sleeping, lodging and occupancy for purposes including but not limited to boardinghouses, rooming houses, rental housing or other living units pursuant to N.J.S.A.. 40:52-1 et seq. In addition, N.J.S.A.. 40:48-2.12(a) provides that the governing body of a municipality may make, amend and repeal and enforce ordinances to regulate buildings and structures and their use and occupation to prevent and abate conditions therein harmful to the health and safety of the occupants of said building and structures and the general public in the municipality. This article aims to curtail, and in certain circumstances prohibit, the increasingly widespread practice of renting or leasing various types of dwellings, or segments thereof, located primarily in residential neighborhoods, on a short-term basis to transient guests. This practice has been popularized and facilitated by various websites that advertise and broker these rentals. Left unregulated, this practice will transform many residential dwellings into flophouses to the detriment to the health, safety, and quiet enjoyment of the affected neighborhoods.
  • This chapter does not apply to lawfully established and operating hotels, motels, rooming houses, boardinghouses, and bed-and-breakfast establishments.

BE IT ORDAINED, by the Township Council of the Township of Jackson, County of Ocean, State of New Jersey, that Chapter 316 of the Township Code be and hereby is amended as follows:

SECTION 1. The Township has previously adopted Chapter 316 of the Township Code to ensure certain public construction contracts which exceed a certain sum are performed promptly, at a reasonable cost and within the highest degree of quality. SECTION 2. Chapter 316-1 is hereby deleted and replaced with the following:

§ 316-1. Purpose.

This chapter shall ensure that certain public construction contracts with total project costs that exceed $3,000,000, excluding land acquisition costs which the municipality directly undertakes are performed promptly, at a reasonable cost, and with the highest degree of quality. This chapter also creates opportunities to employ a substantial number of apprentices, thus ensuring that these projects will expand access to living-wage careers in the construction trades for a new generation of workers. Projects which exceed the $3,000,000 threshold during the pendency of the project shall also be subject to this chapter.

TOWNSHIP OF JACKSON RESOLUTION 240-2026

REQUESTING THAT THE UNITED STATES POSTAL SERVICE RECONSIDER AND HALT ANY PROPOSAL TO REPLACE DOOR-TO-DOOR MAIL DELIVERY WITH CLUSTER MAILBOXES AT THE OAK TREE SENIOR COMMUNITY AND URGING THE PROTECTION OF HOME DELIVERY SERVICES FOR SENIOR COMMUNITIES

WHEREAS, the Oak Tree community in Jackson Township is a senior residential community consisting of residents who rely upon accessible and dependable delivery of United States Postal Service mail directly to their residences; and

WHEREAS, many Oak Tree residents are elderly, have mobility limitations, utilize walkers or other mobility assistance devices, are homebound, or otherwise face significant challenges traveling extended distances to retrieve their mail; and

WHEREAS, the proposed replacement of door-to-door mail delivery with centralized cluster mailboxes would require many residents to leave their homes and travel to a centralized location in order to retrieve their daily mail; and

WHEREAS, for elderly, mobility-impaired, and homebound residents, such a requirement may present significant concerns relating to safety, accessibility, inclement weather, physical limitations, and independence; and

WHEREAS, many residents purchased their homes with the reasonable expectation that their mail would continue to be delivered directly to their residences, and changing that service would materially affect the manner in which they access an essential daily service; and

WHEREAS, the Township Council recognizes that the United States Postal Service must consider operational and logistical matters in providing mail service, but believes such considerations should not be evaluated without fully considering the unique needs and circumstances of the senior residents who would be directly affected by this proposed change; and

WHEREAS, the Township Council believes that senior citizens who have built their homes and communities in Jackson Township should not be placed in a position where they must compromise their safety or independence simply to retrieve their daily mail; and

WHEREAS, centralized cluster mailboxes may be appropriate in certain residential settings; however, the Township Council believes that senior communities with substantial populations of elderly, mobility-impaired, and homebound residents warrant heightened consideration before any existing door-to-door delivery service is discontinued or substantially altered; and

WHEREAS, Mayor Jennifer Kuhn has received substantial constituent concern regarding the proposed change at Oak Tree, including 190 signed petitions from Oak Tree residents requesting that door-to-door mail delivery be maintained; and

WHEREAS, Mayor Jennifer Kuhn has joined with Congressman Chris Smith and Assemblyman Alex Sawicki in advocating on behalf of Oak Tree residents and requesting that the United States Postal Service reconsider the proposed installation of cluster mailboxes; and

WHEREAS, the Township Council recognizes its responsibility to advocate for the safety, accessibility, independence, and quality of life of Jackson Township residents, particularly its senior population; and WHEREAS, the Township Council further believes that the concerns raised by Oak Tree residents should receive meaningful consideration by the United States Postal Service before any permanent change to their mail delivery service is implemented; and NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township of Jackson, County of Ocean, State of New Jersey, as follows:

TOWNSHIP OF JACKSON RESOLUTION R246-2026

OPPOSING CERTAIN RECENTLY ENACTED STATE LAWS AFFECTING LAW ENFORCEMENT OPERATIONS, FEDERAL-STATE COOPERATION, AND PUBLIC SAFETY, AND URGING THEIR REPEAL

WHEREAS, the governing body of the Township of Jackson has a fundamental responsibility to protect the health, safety, and welfare of its residents and to support law enforcement officers in the lawful execution of their duties; and

WHEREAS, New Jersey State Government recently enacted legislation impacting federal-state cooperation in immigration enforcement, creating sanctuary spaces for immigrants in the country illegally and impacting law enforcement operations; and

WHEREAS, A4071/S3521 restricts certain communications and cooperation between state and local law enforcement and federal immigration authorities; and

WHEREAS, SCS for S3114 and S3216/A1743 requires law enforcement officers, including ICE agents, to reveal their facial identity during certain public interactions and to present identification before arresting or detaining an individual, which this governing body believes may interfere with law enforcement operations and raise constitutional concerns; and

WHEREAS, A4070/S3522, described as the "Privacy Protection Act," limits the collection and sharing of certain personal information, which this governing body believes may hinder law enforcement investigations and interagency coordination; and

WHEREAS, the “Safe Communities Act” (A6308/S5036) requires the Attorney General to develop model policies governing interactions between certain sensitive locations and federal civil immigration enforcement, including hospitals, public schools, shelters, disaster and emergency response sites, funeral homes, courthouses, and places of worship, which this governing body believes will discourage cooperation with lawful federal immigration enforcement and create additional barriers to apprehending criminal offenders; and

WHEREAS, this governing body recognizes the importance of constitutional rights, due process, lawful policing, and public accountability, but also finds that public policy should not jeopardize officer safety, operational effectiveness, intergovernmental cooperation, the ability of law enforcement agencies to respond to evolving public safety threats, or negatively impact the safety of the public at large; and

WHEREAS, this governing body is concerned that restrictions affecting communication, coordination, identification practices, and information-sharing, as well as policies that prohibit law enforcement from pursuing criminals at certain locations will create uncertainty for local law enforcement agencies, complicate interactions with federal authorities, increase risks to officers operating in volatile and rapidly developing situations and give sanctuary to criminals among the very communities these laws purport to seek to protect; and

WHEREAS, this governing body further recognizes that immigration law and enforcement are federal functions under the United States Constitution and believes that legislation restricting federal-state cooperation in this area is subject to constitutional challenge under the Supremacy Clause; and

WHEREAS, this governing body is also concerned that enactments designed to restrict cooperation or disclosure may invite costly litigation, create preemption disputes, undermine consistent enforcement practices, and expose municipalities and their officers to legal uncertainty, financial burdens, and operational difficulties, observing that the federal government has already sued New Jersey twice since March 2026; and

WHEREAS, this governing body is additionally concerned that requiring officers to reveal facial identity without adequate operational exceptions may increase the risk of retaliation, harassment, doxxing, targeting of officers and their families, and compromise of undercover, tactical, or other security-sensitive functions; and

WHEREAS, this governing body also finds that limiting the collection or sharing of personal information may impede legitimate law enforcement investigations, interagency coordination, and emergency response efforts, including efforts involving individuals who may pose threats to public safety; and

WHEREAS, this governing body recognizes the causal connection between sanctuary policies and the unfolding statewide voter registration scandal in which at least 6,600 noncitizens were registered to vote and approximately 400 cast ballots; and

WHEREAS, the governing body therefore wishes to formally express its opposition to the foregoing enactments and to urge the Legislature and the Governor to repeal them; and

WHEREAS, New Jersey’s sanctuary policies have directly resulted in avoidable lawsuits initiated by the federal government challenging unconstitutional policies as well as violent unrest and disorder outside of Newark’s Delaney Hall, a U.S. Immigration and Customs

Enforcement (ICE) detention facility, and the injury of an ICE officer in Ocean County, New Jersey;

WHEREAS, the governing body finds that New Jersey’s sanctuary-state policies, by attracting and incentivizing unlawful immigration and restricting meaningful cooperation with federal immigration authorities, have contributed directly to the registration of thousands of noncitizens to vote in New Jersey and 75,000 noncitizens annually being summoned for jury duty; and

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Jackson, County of Ocean, State of New Jersey, as follows:

  1. The Township Council of the Township of Jackson hereby formally opposes the recently enacted laws identified above.
  2. This governing body finds that these laws, individually and collectively, raise substantial concerns regarding public safety, law enforcement officer safety, effective federal-state and interagency cooperation, and the ability of local law enforcement to carry out its responsibilities in a clear, coordinated, and lawful manner.
  3. This governing body further finds, as a matter of policy and legal concern, that state measures restricting cooperation, identification practices, or information-sharing in this area may create practical conflicts with legitimate law enforcement objectives, burden municipal operations, and contribute to costly and divisive disputes concerning the limits of state authority, federal supremacy in immigration matters, and preemption principles under the United States Constitution.
  4. This governing body urges the Governor of New Jersey and the New Jersey Legislature to repeal the laws identified above and to take such prompt executive and legislative action as may be necessary to eliminate the risks these laws may pose to officer safety, law enforcement effectiveness, and sound intergovernmental relations.
  5. This governing body further urges that any future legislation in this area respect the supremacy of the federal government under the United States Constitution in matters of immigration policy and enforcement, and include clear protections for officer safety and operations, workable standards for interagency coordination, and provisions that preserve the ability of law enforcement to respond effectively to threats to the public.
  6. This governing body encourages state, county, and local law enforcement, to the fullest extent permitted by law, to cooperate with other law enforcement agencies in securing our

community against threats to public safety as well as assist federal authorities in safeguarding government installations located in the Garden State;

  1. This governing body urges the Governor of New Jersey, the New Jersey Legislature, the Attorney General of New Jersey, and the appropriate State election authorities to promptly conduct a transparent investigation into the reported registration of thousands of noncitizens on New Jersey's voter rolls; suspend automatic Motor Vehicle Commission (MVC) registrations; determine the scope and causes of the election-security breach; take all lawful corrective action to protect the integrity of the voter-registration system and elections; fully cooperate with investigating federal authorities; and report the results and remedial measures to the public.
  2. The Municipal Clerk is hereby directed to transmit a certified copy of this Resolution to the Governor of New Jersey, the President of the New Jersey Senate, the Speaker of the New Jersey General Assembly, the municipality's representatives in the New Jersey Legislature, the Attorney General of New Jersey, the New Jersey State League of Municipalities, the New Jersey Association of Counties, the United States Attorney for the District of New Jersey, and such other public officials and organizations as may be appropriate.
