COUNCIL PRESIDENT NIXON – A moment of silence out of respect for our troops and our men and women in uniform. During this holiday season, they’ll be out in the cold and away from their families defending our rights and freedoms and keeping our community a nice place to live.
ROLL CALL:
COUNCILMAN CALOGERO COUNCILMAN MARTIN COUNCILWOMAN UPDEGRAVE COUNCIL VICE PRESIDENT BRESSI COUNCIL PRESIDENT NIXON
ATTORNEY CIPRIANI TOWNSHIP CLERK EDEN
ALSO IN ATTENDANCE: BUSINESS ADMINISTRATOR SCHLEGEL
As Clerk of this meeting, I publicly announce that in compliance with the provisions of the “Open Public Meetings Act” adequate notice of this meeting of the Jackson Township Council has been advertised in the manner prescribed by law.
COUNCILMAN CALOGERO – Thanked everyone for coming out and acknowledged and thanked the Scouts in the audience for attending. Waived comments.
COUNCILMAN MARTIN – It’s a great holiday season and Christmas is upon us and Chanukah is approaching. He thanked the Boy Scouts for coming out and acknowledged how hard they work to earn the merit badges; keep up the good work.
COUNCILWOMAN UPDEGRAVE – Thanked everyone for coming out and waived comments.
COUNCIL VICE PRESIDENT BRESSI – Thanked everyone for coming out. He acknowledged the scouts. He asked for a reflection with all the upcoming holidays. We celebrate Memorial Day and our Gold Star Families celebrate every holiday as Memorial Day. Think of all the Veterans that gave the supreme sacrifice. All the Veterans that served us in the past, all our Armed Forces out there today keeping our freedoms as they are and sustaining them. To our first responders who enable us to live safely with these freedoms. Always remember as you celebrate and enjoy these holidays, we have the freedom to celebrate the one we want in this country because of our Veterans and Armed Forces. Please take a moment out at every holiday to think of that. Think of the Gold Star Families whose every holiday is Memorial Day. Enjoy your holiday and God Bless you all.
COUNCIL PRESIDENT NIXON – Thanked everyone for coming out. Thanked the scouts for doing a wonderful job in our community. I know, from experience, the hard work that goes into the commitment that you’re making wearing that uniform. We’re grateful for what you do for Jackson and your future personal growth. Poignant words from Council Vice President Bressi for the men and women in our Armed Forces, Law enforcement and Firefighting communities. On the way here, I passed by two serious accidents and there were already Police Officers out there. It’s going to get really cold and wet and while we’re inside staying warm, those Police Officers, Firefighters and First Responders we’ll be out in the streets in bad weather, on Christmas Eve, New Years Eve and every day. It’s important to say thank you to all of them as they do a tremendous amount that we don’t see.

ORDINANCES, FIRST READING:
ORDINANCE: 31-16
ORDINANCE: 31-10 TITLE: AN ORDINANCE OF THE TOWNSHIP OF JACKSON, COUNTY OF OCEAN, STATE OF NEW JERSEY, AMENDING AND SUPPLEMENTING CHAPTER 216 ENTITLED "GARBAGE, RUBBISH AND WASTE MATERIALS" SO AS TO INCREASE PERMITTED MAXIMUM GALLON CAPACITY OF RECEPTACLES
Attorney Cipriani advised the original change was made to increase the capacity of the acceptable receptacles. There appears to be ancient language which requires that the receptacles be tapered metal containers. It seems like this would be a good time to not only increase the capacity but to remove the metal requirement.
MOTION TO AMEND AND APPROVE ORDINANCE 31-16 ON FIRST READING, ADVERTISE THE APPROVAL, NOTICE OF SECOND READING AND PUBLIC HEARING TO BE HELD ON DECEMBER 27, 2016 BY: CALOGERO MOTION SECONDED BY: BRESSI YES: CALOGERO, MARTIN, UPDEGRAVE, BRESSI, NIXON

DISCUSSION AGENDA:
1. TOWNSHIP CLERK EDEN
- January 2017 Re-Organization Meeting date and tentative Council meeting dates for CY 2017 - Council President Nixon proposed January 3, 2017 at 7:30 pm for the Township Council Re-Organization and it was accepted. Township Clerk Eden and Council President Nixon discussed the 2017 dates previously submitted. Township Clerk Eden announced the 2017 Township Council Meeting dates will be: January 24th, February 14th & February 28th, March 14th & 28th, April 11th & 25th, May 9th & 23rd, June 13th & 27th, July 25th, August 1st & 22nd, September 12th & 26th, October 10th & 24th, November 1st & 21st and December 13th & 26th. Township Clerk Eden will have the resolution ready at the January 3rd Re-Organization Meeting.
- Annual Chanukah Menorah Lighting will take place on December 29, 2016 at 4:30 – 6:00 pm.
- Hawkins Ridge – Shawn Blick came to see me today as he was unable to attend this evening’s meeting. He is a resident at Hawkins Ridge. He wanted to express his concerns regarding the paving work being done at Hawkins Ridge. Administrator Schlegel advised our Engineering Department had inspected the project and found some deficiencies in the work and called the contractor. The contractor will be out there tomorrow to try to remedy some of the issues. We are aware and have been in contact with Mr. Nagurka, one of our Township Attorneys, who is handling the matter.
2. COUNCILMAN MARTIN
- a. Cheerleading – he advised that there were a number of cheerleading squads in Florida and congratulated the Division 12 Team won the National Championship. Some other teams placed and did very well. Applause.
PUBLIC COMMENT, ANY TOPIC
RAE ANN WALKER – 2 EVERGREEN COURT – asked if there would be meetings or workshops regarding how the Community Development Block Grant is decided. Administrator Schlegel advised the Senior Center’s addition is part of that grant. We had public hearings on it and asked for suggestions as there are restrictions; it can be used in assisting with the Disability Act. We are required to have public hearings which we did on this past grant. Township Clerk Eden advised the next time it will come up will be in January/February. Administrator Schlegel stated that Ms. Silversmith is on top of all the deadlines. Ms. Walker was hoping that some of those funds could be put towards the drug epidemic as other towns have done. Administrator Schlegel advised there are a lot of variables in order to qualify. She advised after attending the last meeting at the County, we had only qualified for improvements to Township buildings and making some of the public right-of-ways handicapped accessible. There will be upcoming public discussions on the grant.
Ms. Walker had noticed some of the streets listed on the permits for solicitation have been in the Planned Retirement Communities (PRC). Township Clerk Eden explained there were some issues with that today and it is on their list of streets. My office doesn't review those streets and the solicitors are given a letter informing they cannot solicit within a private community. Today's issue seems to be one's word against another's and I'm handling that. Township Clerk Eden advised that the street names have no bearing on the issuance of the permit. That information is an FYI for the Police and residents.
At last week’s Zoning Board hearing, an applicant stated that he was referred by the Township to a specific professional. The Township had offered and recommended a surveyor and when pressed, the applicant got his request from the Building Department. Does the Township normally give out name and Administrator Schlegel advised the Township doesn’t do that. Administrator Schlegel will review the transcript.
ELENOR HANNUM – 7 EVERGREEN COURT – I’m a native of Jackson Township and attended all the schools, participated in school activities and volunteered throughout my adult years. Five years ago, I couldn’t tell anyone in Town who the Mayor or anyone from
Page 37 of 37
Council was until something happened in my backyard. I have lost countless time. When was the last time a political caucus meeting has been held and Council President Nixon felt it wasn’t a relevant question for Council. Ms. Hannum advised how much George Gilmore’s political influence has on Jackson Township and Council President Nixon felt it was a general question and advised he has no impact on the decisions made on this dais. Ms. Hannum asked if there was a secret meeting held on December 3, 2016 and Council President Nixon advised Council is separate from political roles and we’re permitted to meet with anyone in political context as long as Township business is not discussed outside of that context. Ms. Hannum asked if a secret meeting took place on December 3rd and Council President Nixon advised he would not discuss when they meet and political meetings are political meetings and they are not Council Meetings.
Ms. Hannum stated that on December 3, 2016 a meeting took place at Gilmore & Monahan’s office and some entered at 10:50 am. A viewer had witnessed the entire Council go in, Mr. Gilmore, Mayor Reina and 3 Board Members of the J.T.M.U.A. She stated she finds it disheartening and felt if anyone of them found it in violation of the Open Public Meetings Act. Council President Nixon informed it is not and is distinct from that act. It is a political caucus and not a Council Meeting and is accepted by State law under an exemption of the Open Public Meetings Act. Ms. Hannum stated numerous people have been notified and it is a clear violation. Our Governing Body is meeting with the Republican Chair/Township Attorney and 3 Board Members of the J.T.M.U.A. Council President Nixon advised based on years of experience with State law, it is not a violation of the Open Public Meetings Act. Ms. Hannum stated Council speaks of transparency but it was clearly not transparency; our elected officials are meeting with the Township Attorney at an undisclosed location. Council President Nixon pointed out that if there had been a Republican Club Meeting and all those people you mentioned were present, it’s the exact same thing. There is no difference; it is a political caucus and not a Council Meeting and is accepted by State law under an exemption of the Open Public Meetings Act.
We were told that you would claim it to be a political caucus. You have 3 governing bodies representing this Town making financial decisions for this Town. Council President Nixon advised it is the United States of America and they are permitted to belong to a Republican or Democratic Party and meet politically; it is no different than any other.
BEATRICE PETTI – RESIDENT – advised in 2015 she applied for a Rehabco Grant and tried to find out the guidelines for an appeal. No one has called me back from Administration for months. I’ve asked for a meeting with the Mayor and am waiting to hear back from Ms. Novak for a reply. Several years ago, I applied for a Grant for my Father and it was denied. I’d like to know where that money went to and why it ended. Council President Nixon apologized for not receiving a return phone call. Attorney Cipriani asked for her information after the meeting and will review both grant requests.
