COUNCILMAN BORRELLI COUNCILMAN CHISHOLM COUNCILMAN SAUICKIE (Absent) COUNCIL VICE PRESIDENT FLEMMING COUNCIL PRESIDENT KERN

ATTORNEY MCGUCKIN TOWNSHIP CLERK KISTY

ALSO IN ATTENDANCE: BUSINESS ADMINISTRATOR TERENCE WALL MAYOR MICHAEL REINA

As Clerk of this meeting, I publicly announce that in compliance with the provisions of the “Open Public Meetings Act” adequate notice of this meeting of the Jackson Township Council has been advertised in the manner prescribed by law.

COUNCILMAN BORRELLI – He stated that Ordinance 13-21 must be passed by August 22nd if not passed; Recreational Marijuana businesses can start popping up in our town, potentially near our residential neighborhoods. He is glad for this Council to be proactive on this issue.

Food Truck and Fire Works event at Johnson Park on Saturday, July 10th from 3 to 9 pm, free admission and live music. More information can be found on the Jackson Township website.

He wished his fellow Jackson residents a happy and safe 4th of July; “Let Freedom Ring.”

COUNCILMAN CHISHOLM- He gave a brief history about the upcoming anniversary of America; July 3rd, 1776 our second President John Adams wrote one of many letters to his wife Abigail, stating in that letter that on the 2nd of July in 1776 will be the most memorable epica in American history and that future generations will celebrate it as the greatest anniversary festival. This festival should be solemnized in many ways, including parades, shows, guns, sports, bells, and illuminations from one end of this continent to another. President Adams wasn’t too far off in how we celebrate, although it was not officially signed until two days later. He expressed the importance of teaching each generation about July 4th and why we have this freedom - that is not only about the fireworks, BBQs and parades.

Echoed Councilman Borrelli comments in regards to the Food Trucks and Fireworks event and encouraged everyone to attend.

He wished everyone a happy and safe Independence Day.

COUNCILMAN SAUICKIE- Absent.

COUNCIL VICE PRESIDENT FLEMMING- Echoed Councilman Borrelli comments in regards to Ordinance 13-21, adding that he saw comments on social media about missing out on tax dollars from those businesses; however, he feels it's important to adopt a wait and see approach and possibly address the matter again in the future.

He was happy to see that the first steps to move township property to a fire district to build the first new fire house in about 40 years; the fire house is going to replace an out of date structure that is closer to 80 years old. Hope it will be done soon and the town will have good fire protection for many years to come.

COUNCIL PRESIDENT KERN- Thanked Council Vice President Flemming for his hard work over the years to get the fire house project where it is now.

Echoed Councilman Chisholm comments about Independence Day. Many people just say Happy Fourth of July, but please remember that this day is celebrated of our independence from tyranny and declared that the citizens would not be governed by a king. The United States became a country that would govern themselves. He went on to ask the State

Page 3 of 22

legislators to ensure that the tyrannical restrictions that had been in place over the past year can never happen again. He wished everyone a safe and Happy Independence Day.

MAYOR MICHAEL REINA- Wished everyone a Happy Independence Day. Waived further comments.

APPROVE EXECUTIVE SESSION MEETING MINUTES: JUNE 15, 2021 MOTION TO APPROVE BY: CHISHOLM SECONDED BY: BORRELLI YES: BORRELLI, CHISHOLM, FLEMMING, KERN ABSENT: SAUICKIE

ORDINANCES, SECOND READING:

ORDINANCE: 13-21

TITLE: AN ORDINANCE OF THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF JACKSON IN THE COUNTY OF OCEAN, STATE OF NEW JERSEY PROHIBITING THE OPERATION OF ANY CLASS OF RECREATIONAL CANNABIS BUSINESSES WITHIN ITS GEOGRAPHICAL BOUNDARIES AND ESTABLISHING CHAPTER 252 OF THE TOWNSHIP CODE

PUBLIC HEARING OPENED:

Hugh Giordano – Mr. Giordano is a Union representative for United Food Commercial Workers Union Local 152, which officially represents cannabis workers from seed to sale from both medical and adult use. Addressed the Council with his opposition on this ordinance; he spoke positively about the cannabis business and that one facility can create up to 100 full-time jobs which are needed to maintain a stable community. He said that allowing cannabis business doesn’t have to be limited to retail; it could be cultivation, manufacturing, or warehousing. These opportunities have no interaction of purchasing anything, and you can still get the tax credits and create jobs. He invited Council to see a dispensary for themselves and he asked Council to reconsider the ordinance.

MOTION TO CLOSE PUBLIC HEARING ON ORDINANCE 13-21 BY: FLEMMING MOTION SECONDED BY: CHISHOLM YES: BORRELLI, CHISHOLM, FLEMMING, KERN

ABSENT: SAUICKIE

MOTION TO APPROVE ORDINANCE 13-21 ON SECOND READING, ADVERTISE THE NOTICE OF PASSAGE AND APPROVAL IN AN APPROVED NEWSPAPER AS REQUIRED BY LAW BY: FLEMMING MOTION SECONDED BY: BORRELLI YES: BORRELLI, CHISHOLM, FLEMMING, KERN ABSENT: SAUICKIE

Council President Kern- He spoke to Mr. Giordano stating that those facilities are under the current rules, they are not set up on the potential rules if we don’t pass this Ordinance we won’t be able to do it for five years. With 100 jobs we have businesses in our town that are looking for over 100 employees. He encouraged anyone looking for jobs now to contact the Township and we will do what we can to help you.

ORDINANCE 13-21

PURPOSE: The purpose of this Ordinance is to regulate the marketplace class of licensed recreational cannabis businesses.

WHEREAS, on February 22, 2021, Governor Murphy signed into law P.L. 2021, c. 16, known as the "New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act" (the "Act"), which legalizes the recreational use of marijuana by adults 21 years of age or older, and establishes a comprehensive regulatory and licensing scheme for commercial recreational (adult use) cannabis operations, use and possession; and

Page 4 of 22

WHEREAS, the Act establishes six marketplace classes of licensed businesses, including:

Class 1 Cannabis Cultivator license, for facilities involved in growing and cultivating cannabis;

Class 2 Cannabis Manufacturer license, for facilities involved in the manufacturing, preparation, and packaging of cannabis items;

Class 3 Cannabis Wholesaler license, for facilities involved in obtaining and selling cannabis items for later resale by other licensees;

Class 4 Cannabis Distributor license, for businesses involved in transporting cannabis plants in bulk from on licensed cultivator to another licensed cultivator, or cannabis items in bulk from any type of licensed cannabis business to another;

Class 5 Cannabis Retailer license for locations at which cannabis items and related supplies are sold to consumers; and

Class 6 Cannabis Delivery license, for businesses providing courier services for consumer purchases that are fulfilled by a licensed cannabis retailer in order to make deliveries of the purchases items to a consumer, and which service would include the ability of a consumer to make a purchase directly through the cannabis delivery service which would be presented by the delivery service for fulfillment by a retailer and then delivered to a consumer.

WHEREAS, section 31a of the Act authorizes municipalities by ordinance to adopt regulations and police regulations governing the number of cannabis establishments (defined in section 3 of the Act as "a cannabis cultivator, a cannabis manufacturer, a cannabis wholesaler, or a cannabis retailer"), cannabis distributors or cannabis delivery services allowed to operate within their boundaries, as well as the location manner and times operation of such establishments, distributors or delivery services, and establishing civil penalties for the violation of any such regulations; and

WHEREAS, section 3 lb of the Act authorizes municipalities by ordinance to prohibit the operation of any one or more classes of cannabis establishments, distributors, or delivery services anywhere in the municipality; and

WHEREAS, section 3 lb of the Act also stipulates, however, that any municipal regulation or prohibition must be adopted within 180 days of the effective date of the Act (i.e., by August 22, 2021); and

WHEREAS, pursuant to section 31b of the Act, the failure to do so shall mean that for a period of five years thereafter, the growing, cultivating, manufacturing, selling and reselling of cannabis and cannabis items shall be permitted uses in all industrial zones, and the retail selling of cannabis items to consumers shall be a conditional use in all commercial and retail zones; and

WHEREAS, at the conclusion of the initial and any subsequent five-year period following a failure to enact local regulations or prohibitions, the municipality shall again have 180 days to adopt an ordinance regulating or prohibiting cannabis businesses, but any such ordinance would be prospective only and would not apply to any cannabis business already operating within the municipality; and

WHEREAS, the Township Council of the Township of Jackson has determined that, due to present uncertainties regarding the potential future impacts that allowing one or more classes of cannabis business might have on New Jersey municipalities in general, and on the Township of Jackson in particular, it is at this time necessary and appropriate, and in the best interest of the health, safety and welfare of Jackson's residents and members of the public who visit, travel, or conduct business in Jackson, to amend Jackson's zoning regulations and police regulations to prohibit all manner of marijuana-related land use and development within the geographic boundaries of the Township of Jackson; and

WHEREAS, officials from two prominent non-profit organizations that have been established for the purpose of advising New Jersey municipalities on legal matters such as have been presented by the Act (those organizations being the New Jersey State League of

Page 5 of 22

Municipalities and the New Jersey Institute of Local Government Attorneys) have strongly urged that, due to the complexity and novelty of the Act; the many areas of municipal law that are or may be implicated in decisions as to whether or to what extent cannabis or medical cannabis should be permitted for land use purposes or otherwise regulated in any particular municipality; and the relatively short duration in which the Act would allow such decisions to be made before imposing an automatic authorization of such uses in specified zoning districts subject to unspecified conditions, the most prudent course of action for all municipalities, whether or not generally in favor of cannabis or medical cannabis land development and uses, would be to prohibit all such uses within the Act's 180-day period in order to ensure sufficient time to carefully review all aspects of the Act and its impacts;

NOW THEREFORE, BE IT ORDAINED, by the Township Council of the Township of Jackson, County of Ocean, State of New Jersey, as follows:

SECTION 1. Pursuant to section 31b of the New Jersey Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act (P.L. 2021, c. 16), all cannabis establishments, cannabis distributors or cannabis delivery services are hereby prohibited from operating anywhere in the Township of Jackson, except for the delivery of cannabis items and related supplies by a delivery service.

SECTION 2. Chapter 252 of the Township Code entitled "Cannabis Regulation" is hereby established and shall provide as follows:

252-1 The following uses shall be prohibited in all zoning districts in the Township of Jackson:

All classes of cannabis establishments or cannabis distributors or cannabis delivery services as said terms are defined in section 3 of P.L. 2021, c. 16, but not the delivery of cannabis items and related supplies by a delivery service.

SECTION 4. Any article, section, paragraph, subsection, clause, or other provision of the Township of Jackson Township Code inconsistent with the provisions of this ordinance is hereby repealed to the extent of such inconsistency.

SECTION 5. If any section, paragraph, subsection, clause, or provision of this ordinance shall be adjudged by a court of competent jurisdiction to be invalid, such adjudication shall apply only to the section, paragraph, subsection, clause, or provision so adjudged, and the remainder of this ordinance shall be deemed valid and effective.

SECTION 6. A copy of this Ordinance shall be transmitted to the Ocean County Planning Board for filing upon final passage after second reading by the Township Clerk.

SECTION 7. This ordinance shall take effect upon its passage and publication and filing with the Ocean County Planning Board, and as otherwise provided for by law.
