J.Y.F.C. Cheerleaders (Division 12) – Council Vice President Martin called forward Coach and the team and announced Division 12 Cheer Squad, under Coach Nicole Carrara and staff, is to be recognized and honored for their outstanding season. Their achievement of the undefeated Division 12 Cheer Squad has won the Jersey Shore Division 12 Large Blue Championship title and progressed to achieving the Big East Region Division 12 Large Blue Champion title and ending the season with an impressive title of American Youth Cheer Division 12 Small/Large Blue National Champions. On behalf of Michael Reina, Mayor of the Township of Jackson, we congratulate the Jackson Youth Football and Cheerleading Division 12 Cheer Squad, their coach, and all people associated with the team for their outstanding accomplishments.
As a cheer father, you don’t realize the amount of hours that go into this. These girls live at the field; they start late July with 2-3 hours every week and when school starts, they’re there 2-3 times a week practicing. Coach Carrara thanked all the parents and all these girls that worked so hard this season. Half of this team is brand new and have never cheered before and half has spent the last 4 years being the 4th place team that just missed going out. I’m very proud of all of them and I hope they all come back next season.
J.Y.F.C. Cheerleaders (Division 13) – Council President Calogero called forward Coach Lubertazzi and the team. He stated this is the national undefeated Grand Champions and the highest score ever in AC wide history. What a tremendous accomplishment! He announced the Jackson Youth Football and Cheerleading, Division 13 Cheer Squad, under Coach Nancy Lubertazzi and staff, is to be recognized and honored for their outstanding season. This squad has won the Jersey Shore Division 13 Large Blue Championship title and over-all Grand Championship title, then progressed to the Big East Regional Division 13 Large Blue Championship title and ending the season with an impressive title of American Youth Cheer Division 13 Large Blue National Champions and Division 13 Grand Champions. Coach Lubertazzi congratulated the girls on this accomplishment and noted it’s their 3rd national title and their 2nd undefeated season. We’ve been together for 5 years and this is our last season together. Hopefully they’ll move on to more high school champion titles to our town.
Jackson Memorial High School Jaguars – Councilman Nixon stated he loves talking about the young men and women who represent Jackson Township. He expressed sincere congratulation for their recent Central Jersey Group IV State Championship title. This victory marks their 4th State Championship win in school history and most points scored in a season, most road wins in a season and school record for most rushing touchdowns in a season for a single player. The Jaguars have 12 athletes named to A-South team; in addition to finishing the season ranked #1 in Shore Conference, #2 in NJ Conference and #2 in Tri-State Conference. The excellent performance, dedication and commitment of these young men, along with Coach Krystopik and staff, have proven to be a source of admiration and inspiration to the citizens of Jackson Township. On behalf of Michael Reina, Mayor of the Township of Jackson, we congratulate the Jackson Memorial Jaguar Football Team, their coach, athletic department and all people associated with the football team for their outstanding accomplishments.
Coach Krystopik thanked all the athletes and parents for their dedication. We have several players who received athletic scholarships for college and wish them the best of luck.
Toys-4-Tots – Councilman Bressi called forward Sergeant Bennett, Officer Gorski and Officer Notare. Sergeant Bennett has donated his time to the Toys for Tots program since 1991 by collecting $5 from each member of his shift to feed a family in need during the holidays. While teaching a DARE program during the holiday season, he learned that one of the students would not be celebrating Christmas with his family due to their poor financial status. He felt he needed to help and found resources through the school to assist. He learned of many other families in need and it drove him to seek further assistance. Police Officers Derek Gorski and Louis Notare took an interest in this program about 4 years ago. For the past 2 years they have partnered with Station 55 firefighters and others, and today are able to help over 70 families with food and presents. On behalf of Michael Reina, Mayor of the Township of Jackson, we recognize and show appreciation to Sergeant Edward Bennett, Offer Derek Gorski and Officer Louis Notare for their outstanding community services.
7:54 P.M. – 5 MINUTE RECESS
COUNCILMAN BRESSI – The proclamations are not only for winning as they do well with their academics. As for the Toys-4-Tots, the Marines had it for many years and a these Officers took it one step further on their own. Thank you for coming out and have a safe drive home.
COUNCILMAN NIXON – Our young men and women of this town are champions on and off the field. Some adults should take a learning lesson on how much time and effort these kids put in for what they care about; we're very proud of them. Thank you for being here tonight.
COUNCILWOMAN UPDEGRAVE – It makes us proud to be a Jackson resident. Thank you and congratulations. I also would like to congratulate the Commission for the Disabled as they had a wonderful luau celebration on Sunday at the Senior Center. I am a member of a non-profit and, hoping that within a month, I would like to bring in someone from this organization to give information to residents regarding social services that are available to residents. They provide food, shelter, a ride to the doctor or a kind hand. I am so proud to be a part of this non-profit. Council President Calogero stated as soon as you’re ready we’ll put it on the agenda.

COUNCIL VICE PRESIDENT MARTIN – Tonight is basically pride night. I know the cheerleaders work very hard getting ready for the season. Our Police really do give back to the community by looking out for those less fortunate. Thank you for coming out and I hope you have enjoyed this night as much as we have.
COUNCIL PRESIDENT CALOGERO – The spirit of Jackson is alive and well. It’s been a great evening to have so many proclamations for so many good people. At the last meeting, we honored the First Aid Responders and Police Department for their heroism and today we honor the youth of Jackson for their hard work and dedication and the Police Department for their contributions to Toys-4-Tots. Page 14 of 35
The following words and terms, when used in this ordinance, shall have the following meanings, unless the context clearly indicates otherwise. Terms not defined in this ordinance have the same meaning as those defined in N.J.A.C.. 7:29.
“Construction” means any site preparation, assembly, erection, repair, alteration or similar action of buildings or structures.
“dBC” means the sound level as measured using the “C” weighting network with a sound level meter meeting the standards set forth in ANSI S1.4-1983 or its successors. The unit of reporting is Db(C). The “C” weighting network is more sensitive to low frequencies than is the “A” weighting network.
“Demolition” means any dismantling, destruction or removal of buildings, structures, or roadways.
“Department” means the New Jersey Department of Environmental Protection.
“Emergency work” means any work or action necessary at the site of an emergency to restore or deliver essential services including, but not limited to, repairing water, gas, electricity, telephone, sewer facilities, or public transportation facilities, removing fallen trees on public rights-of-way, dredging navigational waterways, or abating life-threatening conditions or a state of emergency declared by a governing agency.
“Impulsive sound” means either a single pressure peak or a single burst (multiple pressure peaks) that has a duration of less than one second.
“Minor Violation” means a violation that is not the result of the purposeful, reckless or criminally negligent conduct of the alleged violator; and/or the activity or condition constituting the violation has not been the subject of an enforcement action by any authorized local, county or state enforcement agency against the violator within the immediately preceding 12 months for the same or substantially similar violation.
“Motor vehicle” means any vehicle that is propelled other than by human or animal power on land.
“Muffler” means a properly functioning sound dissipative device or system for abating the sound on engines or equipment where such device is part of the normal configuration of the equipment.
“Multi-dwelling unit building” means any building comprising two or more dwelling units, including, but not limited to, apartments, condominiums, co-ops, multiple family houses, townhouses, and attached residences.
“Multi-use property” means any distinct parcel of land that is used for more than one category of activity. Examples include, but are not limited to:
1.A commercial, residential, industrial or public service property having boilers, incinerators, elevators, automatic garage doors, air conditioners, laundry rooms, utility provisions, or health and recreational facilities, or other similar devices or areas, either in the interior or on the exterior of the building, which may be a source of elevated sound levels at another category on the same distinct parcel of land; or
2.A building, which is both commercial (usually on the ground floor) and residential property, located above, below or otherwise adjacent to.
“Noise Control Officer” (NCO) means an employee of a local, county or regional health agency which is certified pursuant to the County Environmental Health Act (N.J.S.A. 26:3A2-21 et seq.) to perform noise enforcement activities or an employee of a municipality with a Department-approved model noise control ordinance. All NCOs must receive noise enforcement training as specified by the Department in N.J.A.C. 7:29 and is currently certified in noise enforcement. The employee must be acting within his or her designated jurisdiction and must be authorized to issue a summons.

However, they are knowledgeable about their model noise ordinance and enforcement procedures. A Noise Control Investigator may only enforce sections of the ordinance that do not require the use of a sound level meter. The employee must be acting within his or her designated jurisdiction and must be authorized to issue a summons.
“Plainly audible” means any sound that can be detected by a NCO or an NCI using his or her unaided hearing faculties of normal acuity. As an example, if the sound source under investigation is a portable or vehicular sound amplification or reproduction device, the detection of the rhythmic bass component of the music is sufficient to verify plainly audible sound. The NCO or NCI need not determine the title, specific words, or the artist performing the song.
"Private right-of-way" means any street, avenue, boulevard, road, highway,
sidewalk, alley or easement that is owned, leased, or controlled by a non-governmental entity.
“Public right-of-way” means any street, avenue, boulevard, road, highway, sidewalk, alley or easement that is owned, leased, or controlled by a governmental entity. “Public space” means any real property or structures thereon that are owned, leased, or controlled by a governmental entity.

Officer
or Noise Control Investigator shall issue an enforcement document to the violator.
Violation of any provision of this ordinance shall be cause of Violation (NOV) or a Notice of Penalty Assessment (NOPA) document to be issued to the violator by the Noise Control Officer or Noise Control Investigator.
Any person who violates any provision of this ordinance shall be subject to
civil penalty for each offense of not more than $2,000. If the violation is of a continuing nature, each day during which it occurs shall constitute an additional, separate, and distinct offense.
Upon identification of a violation of this Ordinance the Noise Control
The enforcement document shall identify the condition or activity that constitutes
the violation and the specific provision of this Ordinance that has been violated. It shall also indicate whether the violator has a period of time to correct the violation before a penalty is sought.
If the violation is deemed by the Noise Control Officer or Noise Control Investigator to be a minor violation (as defined in Section 291-2 of this ordinance) a NOV shall be issued to the violator.
The document shall indicate that the purpose of the NOV is intended to serve as a notice to warn the responsible party/violator of the violation conditions in order to provide them with an opportunity to voluntarily investigate the matter and voluntarily take corrective action to address the identified violation.
The NOV shall identify the time period (up to 90 days), pursuant to the Grace Period Law, N.J.S.A. 13:1D-125 et seq. where the responsible party's/violator's voluntary action can prevent a formal enforcement action with penalties issued by the TOWNSHIP OF JACKSON. Therefore, the NOV may not be appealed or contested.
If the violation is deemed by the Noise Control Officer or Noise Control Investigator to be a non-minor violation the violator shall be notified that if the violation is not immediately corrected a NOPA with a civil penalty of no more than $2,000 will be issued. If a non-minor violation is immediately corrected a NOV without a civil penalty shall still be issued to document the violation. If the violation occurs again (within 12 months of the initial violation) a NOPA shall be issued regardless of whether the violation is immediately corrected or not.
The violator may request from the Noise Control Officer or Noise Control Investigator, an extension of the compliance deadline in the enforcement action. The Noise Control Officer or Noise Control Investigator shall have the option to approve any reasonable request for an extension (not to exceed 180 days) if the violator can demonstrate that a good faith effort has been made to achieve compliance. If an extension is not granted and the violation continues to exist after the grace period ends, a NOPA shall be issued.
The recipient of a NOPA shall be entitled to a hearing in a municipal court having jurisdiction to contest such action.

The Noise Control Officer or Noise Control Investigator may seek
injunctive relief if the responsible party does not remediate the violation within the period of time specified in the NOPA issued.
Any claim for a civil penalty may be compromised and settled based on the following factors:
Mitigating or any other extenuating circumstances;
The timely implementation by the violator of measures which lead to compliance;
The conduct of the violator; and
The compliance history of the violator.
Consistency, Severability and Repealer
If any provision or portion of a provision of this ordinance is held to be unconstitutional, preempted by Federal or State law, or otherwise invalid by any court of competent jurisdiction, the remaining provisions of the ordinance shall not be invalidated.
All ordinances or parts of ordinances, which are inconsistent with any provisions of this ordinance, are hereby repealed as to the extent of such inconsistencies.
No provision of this ordinance shall be construed to impair any common law or statutory cause of action, or legal remedy there from, of any person for injury or damage arising from any violation of this ordinance or from other law.

PUBLIC COMMENT, ANY TOPIC
LORI GREENBERG, ESQ., MARLTON, NJ – Thanked everyone as the license applications did go out a little earlier this year. I represent a number of the Manufactured Home Park communities in Jackson and it would be good if the applications could even go out earlier as there is snow in January, which holds up inspections. Thank you for passing MGM but their license terminated January 31st. If we started earlier, we could have run through some issues earlier.
DAVE VISCONI – 441 WHITESVILLE ROAD – I was here several weeks ago regarding the suspected dumping drudge spoils at the Whitesville Business Park. I am following up as it was my understanding Ms. Cipriani would check with the DEP regarding this problem. Attorney Kelly stated he knows it was a subject of a recent municipal court hearing but didn’t know about the DEP issue. He will follow up getting the information for Council. Council President Calogero requested that information be prepared for the next Council meeting. Mr. Visconi stated he was present at that municipal court hearing and it didn’t have anything to do with this topic. Council President Calogero apologized for Ms. Cipriani’s absence and stated more information would be available at the next Council meeting.
WILL BOYCE – 33 BOXWOOD DRIVE – We have had a high rate of crime in our area and the Police have been patrolling. The citizen’s of Maple Glen Mobile Home Park feel secure and would like to thank the Police Department.
