8. Preliminary Stormwater Management Area Evaluation (SWM), prepared by Whitestone, dated 11/16/2023.

The applicant seeks Preliminary and Final Major Site Plan Approval associated with the construction of a three-story 15,000 SF business office building and a 12,750 SF one-story warehouse building with 4 rental units on the subject property. In addition to the two primary buildings, the applicant proposes a 1,575 SF storage shed, an 810 SF pipe storage shed and an area designated for small equipment storage. Additional site improvements include one new two-way driveway connection to Whitesville Road, off-street parking, lighting, landscaping, stormwater management facilities as well as all typical site plan development improvements.

The 6.07-acre tract is located at the Westerly side of Whitesville Road within the PM-1 Pinelands Manufacturing Zoning District. The site has been previously developed with one-story residential dwellings and associated accessory structures, all of which are designated to be removed.

Based on a review of the submitted material, we offer the following for the Board's consideration:

B. General Comments

  1. Environmental Considerations
  2. The property is located within a Pinelands Area and subject to the specific requirements of the Pinelands Comprehensive Management Plan (CMP). The applicant has provided the required Certificate of Filing which notes specific inconsistencies from the CMP. The inconsistencies are as follows:

Stormwater volume (N.J.A.C. 7:50-6.84(a)6iv(1))

The Township land use ordinance and the CMP require that any proposed development retain and infiltrate the total runoff volume generated from the net increase in impervious surfaces by a 10-year, 24-hour storm. Note that the required volume must be met below the lowest outfall elevations within the proposed stormwater management measures.

Total nitrogen reduction (N.J.A.C. 7:50-6.84(a)6iv(6))

The Township land use ordinance and the CMP require that stormwater management measures be designed to achieve a minimum of 65 percent reduction of the post-development total nitrogen load from the developed site, including those permanent lawn or turf areas that are specifically intended for active human use, in stormwater runoff generated from the water quality design storm. The development has not been designed to meet this standard. Note that this requirement must be met for the entire development and not just the lawn and landscaped areas.

Permeability (N.J.A.C. 7:506.84(a)6v(2))

The Township land use ordinance and the CMP require that stormwater infiltration facilities be sited in suitable soils verified by field testing to have permeability rates between one and twenty inches per hour. The submitted information indicates that all proposed stormwater management measures will be located in soils having a permeability rate greater than twenty inches per hour. This issue may be resolved by removing soils below each BMP and replacing those soils with a three-foot layer of soil having an acceptable permeability rate (such as a K3 or K4 soil). Any replacement soils must also be replaced up to the elevation of the lowest outfall within each BMP.

These inconsistencies should be addressed by the applicant.

  • The site is also impacted by a wetlands buffer which has been previously established on site.
  • Based on the overall square footage proposed, an Environmental Impact Statement is required and has not been provided. The applicant should address this submission waiver request as well as any comments which have been received from the local Environmental Commission.
  • The drawings indicate that the project site is subject to a wetlands buffer. However, the drawings also indicate that no new disturbance to or construction in the wetland buffer area is proposed.
  • Utilities- The drawings indicate the proposed buildings will connect to public water facilities within Whitesville Road and private onsite septic system. Any approval which may be granted would be subject to review and approval from the Jackson Township Municipal Utility Authority.
  • Site Utilization and Proposed Operation – The applicant supplied Statement of Operations is attached to this engineering report. Supplementing any specific concerns the Board may have, the applicant should be prepared to address:
  • Nature and extent of any outdoor bulk storage which may be proposed including maximum number of vehicles and nature of the outdoor equipment storage which is proposed.
  • Estimated number of new employees.
  • Days and hours of operations.

  • Anticipated deliveries.
  • Security proposals.

  • Ownership and maintenance proposals associated with the site's stormwater management system.
  • EV Parking and the extent of roof top solar.

4. Traffic Safety, Site Access, Circulation, Loading, Required Parking and Existing Roadway Improvements

  • A Traffic Impact Analysis is required based on the total floor area proposed and has been provided. The following has been concluded:
  • "It is concluded, based on the analysis set forth in this report, that plans to construct a driveway to a construction yard and to construct a 15,000 SF office building on the noted property can be approved and operate compatibility with future traffic conditions. Exiting traffic from the 2 uses to Whitesville Road will do so at acceptable levels of service for the 2035 design year.
  • The Site Plan, prepared by YPE, shows adequate areas for parking and storage of vehicles, equipment and materials for the construction yard and adequate parking for the office building."
  • The applicant should review these conclusions with the Board as well as the specific methodology in establishing same. Any comments which have been required from the local Bureau of Fire Prevention and Traffic Safety should be addressed.
  • Site access is proposed through 1 new 2-way driveway connection to Whitesville Road. As Whitesville Road is a County roadway facility, County Planning Board review and approval is required. The applicant should also address any input which has been received by the County Planning Board/Engineering department regarding the driveway design which is proposed.
  • Specific construction detailing including pavement restoration/widening areas, cross sections and design grading should be provided for the Whitesville Road driveway connections as well as all R.O.W. improvements.
  • The new driveway connects to the site's main circulation aisle providing access to all buildings and all off-street parking areas. Based on aisle width and turning radii provided onsite circulation is acceptable, however all curb radii should be specified at 5.0 FT. Additionally, the applicant should address the following waivers:

  • Based on overall floor area designated loading zones are required. The applicant should address adequacy the 12 FT x 45 FT loading area proposed for the office building. No loading area is indicated for the proposed warehouse building.

f. Ordinance Standards require the construction of concrete curbing and sidewalk adjacent to the tract's Whitesville Road frontage. Although new curbing is indicated, no sidewalk is proposed. The applicant should be prepared to provide supportive testimony in conjunction with this improvement waiver request. Any waiver which may be granted should be subject to the applicant's contribution to the Township's Pedestrian Safety Fund.

5. Grading and Drainage

a. Except as may be noted under Section D Technical Revisions and/or Corrections, proposed site grading reflects a conceptually acceptable design. Proposed site grading will properly convey all stormwater flows to stormwater management facilities while still providing for acceptable parking and driveway area slopes. The applicant should however confirm that the specific provisions of Ordinance Section 244-184 relating to clearing and grading will be met.

a.1 Chapter 364 of the municipal Code regulates soil and fill importation and requires proper permitting be secured. No permit is required for any development that requires Planning Board/Zoning Board approval provided said approval contains conditions that meet the specific standards of Chapter 364. Should the current application anticipate placement of fill as regulated by Chapter 364, the applicant should be prepared to address how the specific provisions of Chapter 364 are being met. Specifically:

The applicant submits proof that the soil/fill material has been tested consistent with any applicable requirements of Chapter 364.

The soil/fill meets the definition of “acceptable soil/fill” per Chapter 364.

The application otherwise conforms with the standards of Chapter 364.

The applicant's attention is directed to Chapter 364-3.E.2 for the specific information which must be provided on the plans currently under consideration by the Board.
