TOWNSHIP OF JACKSON ORDINANCE 18-24
AN ORDINANCE OF THE TOWNSHIP OF JACKSON, COUNTY OF OCEAN, STATE OF NEW JERSEY AUTHORIZING THE ACCEPTANCE OF A PORTION OF BLOCK 12701 LOT 12.02 FROM THE WESTLAKE MASTER ASSOCIATION, INC.
WHEREAS, the Westlake Master Association, Inc. is the assessed owner of property located at Block 12701, Lot 12.02 as shown on the Tax Map of the Township of Jackson; and
WHEREAS, Westlake Master Association, Inc. wishes to dedicate that portion of Block 12701, Lot 12.02, and as particularly described in the legal description attached hereto as “Schedule A” to the Township of Jackson in order for it to become a public roadway maintained by the Township; and
WHEREAS, N.J.S.A. 40A:12-5(a)(1) authorizes a municipality to accept property as a dedication by the adoption of an ordinance authorizing the acquisition of the same.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Township Council of the Township of Jackson, County of Ocean, and State of New Jersey, as follows:
SECTION 1. That the governing body does hereby accept the dedication of and authorizes the acquisition of the subject property known as a portion of Block 12701, Lot 12.01 on the Tax Map of the Township of Jackson and as further described in the legal description attached hereto as "Schedule A". This property is being acquired by the Township of Jackson pursuant to N.J.S.A. 40A:12-5(a)(1) as a gift from Westlake Master Association, Inc. to be utilized as a public roadway.
SECTION 2. That the Mayor and Municipal Clerk are hereby authorized to execute any and all documents necessary for the acquisition of the subject property from Westlake Master Association, Inc.
SECTION 3. All ordinances or parts of ordinances inconsistent herewith are hereby repealed.
SECTION 4. If any section, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions hereof.

DESCRIPTION OF TILFORD STREET CONNECTOR ROADWAY DEDICATION, PORTION OF LOT 12.02 IN BLOCK 12701, JACKSON TOWNSHIP, OCEAN COUNTY, NEW JERSEY
Being the intent to describe all that certain tract or parcel of land being known as Tilford Street Connector Roadway Dedication, portion of Lot 12.02 in Block 12701 in the Jackson Township, as shown on the plan entitled, "JACKSON TOWNSHIP, PORTION OF LOT 12.02 IN BLOCK 12701, JACKSON TOWNSHIP, OCEAN COUNTY, NEW JERSEY, EXHIBIT MAP SHOWING TILFORD STREET CONNECTOR ROADWAY DEDICATION," prepared by T&M Associates, dated April 3, 2024.
BEGINNING at a point on the easterly R.O.W. line of Tilford Street (50 feet wide R.O.W.), said point also being the existing southerly terminus of Tilford Street, said point bearing New Jersey State Plane Coordinates (N.A.D. 1983) North 467,678.10 and East 549,150.64 and running thence;
- South 18 degrees 44 minutes 03 seconds West, along the proposed roadway dedication, across and through Lot 12.02 in Block 12701, a distance of 132.81' feet to a point on a curve (non-tangent); thence
- Along the common property boundary line of Lot 12.02 with Lot 12.75 in Block 12701, said line also being the northerly Private R.O.W. line of Muirfield Road (50 feet wide Private R.O.W.), on a curve to the left, having a radius of 125.00 feet, a central angle of 24 degrees 16 minutes 18 seconds, a chord bearing of North 53 degrees 19 minutes 05 seconds West and distance of 52.56 feet, an arc distance of 52.95 feet to a point (non-tangent); thence
- North 18 degrees 44 minutes 03 seconds East, along the proposed roadway dedication, across and through Lot 12.02 in Block 12701, a distance of 96.36 feet to a point-thence
- South 79 degrees 58 minutes 58 seconds East, along the existing southerly R.O.W. line of South Boston Road (33 feet wide R.O.W.), a distance of 6.81 feet to a point; thence
- North 82 degrees 27 minutes 45 seconds East, continuing along the existing southerly R.O.W. line of South Boston Road, a distance of 43.75 feet to a point; thence
- South 69 degrees 10 minutes 01 seconds East, along the existing southerly R.O.W. line of Tilford Street, a distance of 4.04 feet to a point; thence
Containing an area of 5,630 square feet more or less (0.129 acres).
