TOWNSHIP OF JACKSON RESOLUTION 187-2025

AUTHORIZING THE RELEASE OF THE TEMPORARY CERTIFICATE OF OCCUPANCY GUARANTEE POSTED FOR FERNMOOR HOMES-MAPLEWOOD ESTATES, BLOCK 17201, LOT 36.09

WHEREAS, N.J.S.A. 40:55D-53(c) authorizes municipalities to adopt ordinances requiring the furnishing of separate guarantees in favor of the municipality in an amount equal to 120% of the cost of installation of improvements or items which remain to be completed or installed under the terms of a Temporary Certificate of Occupancy; and

WHEREAS, the Township of Jackson has adopted such provisions under Township Code § 244-32(C); and

WHEREAS, the Township Engineer had certified that the required improvements or items under the Temporary Certificate of Occupancy have been completed, and the Permanent Certificate of Occupancy has been issued in accordance with Township requirements and authorized release of the Temporary Certificate of Occupancy Guarantee; and

WHEREAS, it is the desire of the Governing Body of the Township of Jackson to acknowledge and approve the release of the Temporary Certificate of Occupancy Guarantee for the subject development, pursuant to the applicable statutory and ordinance provisions;

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Jackson, County of Ocean, State of New Jersey, as follows:

1. That the governing body does hereby acknowledge and approve the release of the Temporary Certificate of Occupancy Guarantee posted for Fernmoor Homes-Maplewood Estates for a project at Block 17201, Lot 36.09 (9 Tuxedo Court) on the Tax Map of the Township of Jackson, in the amount of $43,906.80 consisting of bonded portion of $39,516.12 and cash portion of $4,390.68.
2. A certified copy of this resolution shall be forwarded to the Township Engineer and Fermmoor Homes-Maplewood Estates.
