PUBLIC COMMENT, ANY TOPIC

DONALD ORBAN - 98 ANTONIA DRIVE – On November 9th, I attended the Shade Tree Commission Meeting and a summons was to be issued to K&L Tree Service Experts but it was not done. He stated the meeting minutes of the Shade Tree Commission also reflected errors of attendance and incorrect verbiage. At the meeting, it was to be handled in a certain way but a letter was mailed November 6th and received by K&L Tree Service Experts on November 9th. He had tried twice to contact me via telephone that evening. Council President Calogero advised him to present his information to Administrator Schlegel. Administrator Schlegel stated she found a letter via email on December 2nd stating a letter would be sent to K&L Tree Service from Steven Chisholm. Mr. Orban's concerns were that the tree ordinance is not being enforced.

Administrator Schlegel’s recommendation is that the Shade Tree Commission contact Administration to advise what is not being enforced. Mr. Orban stated he’s here as a citizen and since 2001 no summonses had ever been issued under 3 consecutive tree removal ordinances. Councilman Bressi stated there has been a lot of action by the Shade Tree Commission with land use applications. I can’t say for sure about the violations but over the years people have been noticed. Administrator Schlegel will follow-up with the Board’s Chairman and Code Enforcement and to report back at the next meeting. Councilman Bressi stated there was a sabbatical with a 2-year period held up in the Appellate Court and it couldn’t be enforced and when it was approved it was re-enforced. Mr. Orban had concerns regarding a disabled resident who had trees removed from his home with no prior knowledge. Council President Calogero affirmed that when there is an application before the Board(s), Council is limited to what they can do. He asked Mr. Orban to hand over the documented information to Administrator Schlegel.

Councilman Nixon requested to come out of Public Comment to telephone Council Vice President Martin for his vote regarding Resolution No. 387R-15. We can then return to Public Comment.

7:58 p.m. – Reconvene Public Comment any topic:

DAVID VISCONI – 441 WHITEVILLE ROAD – Mr. Visconi referred to Chapter 216-8 (hours of collection of waste material) and stated it refers to Chapter 291-6(L), which doesn’t go to 291-6(L)l (it only lists a-b). The website indicates the Code was rewritten in February 2015. Township Clerk Eden will look into it and follow up.

BOB SKINNER – 404 LARKSPUR LANE – I met with Councilman Nixon weeks ago regarding the Rent Control Board and the relationship between the Rent Leveling Board and Council has been outstanding. Going into 2016, I believe things will greatly improve and I’m looking forward to that. Councilman Nixon stated we’re moving into an area where we can address some issues giving you more clarity. The meeting was very productive and I thank you for your leadership on that Board. Council President Calogero thanked Councilman Nixon for his participation with the Board.
