47. Pannier Market

a) Construction Contract

The Council considered a Joint Contracts Tribunal (JCT) Intermediate Building Contract governing the refurbishment works at the Pannier Market which were due to commence imminently. The Council noted that the contract had to be signed by deed. The execution and signing of legal deeds were governed by the Council’s Standing Order 23 as follows:

Execution and Sealing of Legal Deeds

• a)A legal deed shall not be executed on behalf of the Council unless authorised by a resolution.
• b)Subject to standing order 23(a), any two councillors may sign, on behalf of the Council, any deed required by law and the Proper Officer shall witness their signatures.

It was proposed by Councillor J Hellyer, seconded by Councillor D Bushby and resolved to enter into the Joint Contracts Tribunal (JCT) Intermediate Building Contract governing the refurbishment works at the Pannier Market to be signed as a deed in accordance with the Council’s Standing Order 23.

b) Refurbishment

The Council considered a report appraising options to potentially bridge the funding gap for the Pannier Market refurbishment works.

It was proposed by Councillor D Bushby, seconded by Councillor J McKenzie and resolved to agree to maintain a general reserve for the Town Council at three months of net revenue expenditure at £210,000 and to offer £40,000 to contribute towards the funding shortfall at the Pannier Market to Torridge District Council, subject to:

• a)attracting additional Community Regeneration Programme funding.
• b)the currently excluded and currently unfunded works being capable of being completed at a later date.

48. Trust Port

The Council received a verbal update by Cllr Ken Hind.

49. Mayor's Robe

The Council considered a report recommending the replacement of the Mayor's robe.
