4. Water Quality Protections: LDCs shall not be built within 1000 feet of a known mapped sensitive area and shall not be built within 1500 feet of a sinkhole. LDCs built within 1/2 mile of a known sensitive area must adhere to a water protection plan, which shall include the installation and maintenance of a buffer strip of perennial grasses and/or native trees with a minimum 30-foot width around the sensitive area. The installation of the buffer around the sensitive area shall be performed by the Natural Resources Conservation Service (NRCS) or an approved 3rd party qualified to install and maintain buffers that control runoff. Reports of compliance shall be provided to the Zoning Administrator at the time of completion and every three years thereafter. The cost of installation and maintenance of the buffer around the sensitive area shall be incurred by the LDC owner. Any State of Iowa or a Federal Regulatory Agency water quality restriction which is more restrictive than that provided in this ordinance shall supersede this portion of the ordinance.
