Forfeiture of pay from present salary for actual monetary damage suffered by the University through unauthorized use of University property.
Proceedings under KRS 164.230 for dismissal for reasons of “incompetence, neglect of or refusal to perform his/her duty, or immoral conduct.”
CONCLUSIONS OF LAW
The administrative hearing in this matter was conducted under the authority of KRS 164.360(3), which states, “Each board [of regents of a university] . . . upon the recommendation of the president may remove any faculty member . . . A . . faculty member shall not be removed until after ten (10) days' notice in writing, stating the nature of the charges preferred, and after an opportunity has been given him to make defense before the board by counsel or otherwise and to introduce testimony which shall be heard and determined by the board.”
The Kentucky State University president issued charges against the Petitioner, Dr. Karah Stokes, in the April 22, 2016, Charge Supporting the Termination and Removal of Karah Stokes. HE 1. That document sets forth four separate incidents that KSU claims each support her removal from the KSU faculty under KRS 164.360(3).
A hearing was held as required after due notice to the Petitioner of the charges against her. The Petitioner was given an opportunity to make a defense both by introducing evidence at the hearing and by making argument in a post-hearing brief.
The parties agreed that the administrative hearing and any appeal from the final order of the Board of Regents would be governed by the procedures set forth in KRS Chapter 13B.
