- plagiarism, but the facts show the “classroom safety incident” involving the student was resolved to Dr. Stokes’ satisfaction before she barred the same student, as well as other students, from entering her classroom.
- For the reasons that follow, the Hearing Officer finds that Dr. Stokes wanted to have MS barred from her class primarily because she thought he was disruptive. When her complaint about a discrete incident involving MS's alleged threatening behavior did not result in his expulsion from KSU, she ignored the university's due process requirements regarding the student's alleged plagiarism and refused to allow him to continue in her class.
- The alleged “classroom safety incident” involved the same English class that, in September, Dr. Shaw and Dr. Wheeler observed. See HE 14 and HE 16, page 28.
- On Tuesday, October 6, 2015, Dr. Stokes orally reported to Assistant Vice President for Student Affairs, Christopher Cribbs, and Dr. Erin Wheeler, that a student, MS, made what she interpreted as a threatening gesture and statement. Dr. Stokes reported that at the end of or immediately after one class, she heard MS announce that he was “sick.” Dr. Stokes says she asked if he was “contagious.” He said, “I’m sick in the head” and then he made gun-pointing gestures at another student while making sounds like bullets ricocheting while he said, “I’m a fuck shit up.” See Stokes’ email to “Lorna” dated 10/8/15, attached to HE 14.
- Based on MS’s statements, Dr. Stokes converted the class from live teaching to an online format to “protect herself and her students.” See HE 7, page 2.
- On Thursday, October 8, 2015, Dr. Stokes wrote Dr. Shaw an email about the incident saying, “I find this behavior especially disturbing given the recent murders in an English class at a community college.” HE 14, page 3.
