KSU fulltime faculty; James Thornton, former KSU visiting instructor; and Keith Crabtree, former KSU instructional counselor.

Nineteen exhibits were introduced into the evidence at the hearing without objection. KSU offered five of those exhibits. The Petitioner offered thirteen exhibits. During the hearing, the Hearing Officer directed Dr. April Fallon, after the hearing, to produce an email that she testified she sent to KSU administration personnel expressing her concerns about administrators observing freshman math and English classes. Dr. Fallon's email was submitted for the record and was introduced into the evidentiary record as Hearing Exhibit 9 with no objection by the parties.

The parties agreed to file written arguments in lieu of closing arguments. The Petitioner asked for a thirty day extension of time to file her post-hearing brief to allow her time to transcribe the hearing recording. The Hearing Officer granted her request and set March 21, 2018, as the date for her to file her brief. The Petitioner did not transcribe the recording, however. The parties' written arguments have been considered in making this decision.

By post-hearing notice, the Hearing Officer set June 19, 2018, as the date by which he would file this recommended order.

OTHER POST-ADMINISTRATIVE HEARING ORDERS

By Post-Hearing Order dated January 17, 2018, the Hearing Officer directed the parties to file in the record copies of all the relevant pages from the KSU Faculty Handbook bearing on the KSU administration's authority to observe faculty classroom teaching. Neither party submitted a responsive document.
