Upon termination of Coach's employment with KSU for cause, KSU shall be under no further obligation to Coach except to pay all accrued but unpaid base salary and accrued vacation leave up to the date of termination. Upon notice of termination for cause, Coach shall vacate his KSU-provided office within five (5) calendar days of the notice, and he shall return all KSU-owned property forthwith. After notice of termination, Coach shall cooperate with KSU, as reasonably requested by KSU, to effect a transition of his responsibilities and to ensure that KSU is aware of all matters being handled by him.
Incidents warranting "termination for cause" shall include, but not be limited to, the following grounds:
A Level 1 violation of NCAA or SIAC legislation committed by Coach, or Coach’s failure to report a known violation of NCAA or SIAC legislation;
Engaging in conduct that is unlawful or which results in Coach's conviction of a crime;
Committing material or repeated violations of any provision of this Agreement or any University Policy;
Failure by Coach to promptly report to the Athletic Director any known violations of governing athletic rules or University Policies by assistant coaches, staff, student-athletes, or other persons under the direct control or supervision of Coach;
Fraud or dishonesty of Coach in the performance of his duties or responsibilities under this Agreement;
Fraud or dishonesty of Coach in the preparation, falsification, submission, or alteration of documents or records of KSU, the NCAA, or the SIAC; documents or records required to be prepared or maintained by law, governing athletic rules, or University Policies; other documents or records pertaining to any recruit or student-athlete, including, without limitation, expense reports, transcripts, eligibility forms, or compliance reports; or permitting, encouraging, or condoning such fraudulent or dishonest acts by any other person, provided that Coach had actual knowledge of such fraudulent or dishonest acts, or should reasonably have known about such fraudulent or dishonest acts;
Failure by Coach to respond accurately and fully, within a reasonable time, to any reasonable request or inquiry relating to the performance of his duties hereunder or the performance of his duties during his previous employment at any other institution of higher learning that is made by KSU, the NCAA, the SIAC, or any other governing body having supervision over KSU's athletic programs, or any such request or inquiry that is required by law, governing athletic rules, or University Policies;
