IX. OUTSIDE OR SUPPLEMENTAL EMPLOYMENT
Coach agrees to not accept any supplemental employment opportunities without the prior consent of the Athletic Director. In the event that Coach is, as of the effective date of employment, receiving outside or supplemental employment, or is operating as an independent contractor, he shall disclose such information, including, inter alia, the amount and source of the outside or supplemental compensation, outside or supplemental employment, or independent contractor earnings. KSU has the right to require, in accordance with this Agreement, that Coach forgo such outside or supplemental compensation, outside or supplemental employment, or independent contractor projects.
Outside activities shall only be allowed subject to specific reporting requirements as established by KSU. In accordance with NCAA requirements, Coach shall report annually to the Athletic Director all athletic-related income from sources outside KSU. To verify this report, KSU shall receive prompt access to all related records of Coach.
X. PERFORMANCE-BASED INCENTIVES
A. Coach shall be entitled to receive additional compensation from KSU in the form of performance-based incentives, as listed below, for specific and measurable achievements. Coach shall be eligible to receive such performance-based incentives provided that the Football Program is in compliance with NCAA, SIAC, and KSU policies and regulations and that there are no pending or active NCAA or SIAC investigations into major violations of which Coach knew or should have known. Such performance-based incentives shall also be contingent upon Coach's satisfactory performance of the services, responsibilities, and duties delineated in Sections IV and V, as reflected by his most current annual employee performance review. Coach also acknowledges that receipt of any performance-based incentives are also contingent on the availability of non-state-appropriated funds available to the Athletics Department. Performance-based incentives are calculated as follows:
