On September 18, 2023, the Pretrial Fairness Act (PFA) went into effect. It modified the Illinois' pretrial justice system for court- involved individuals in the criminal justice system. It eliminated the cash bail system. The PFA defines what offenses are detainable, and a hearing must be held if the prosecutor asks the court to detain an individual pretrial.

In 2025, the Winnebago County State's Attorney filed 610 Petitions to Detain, and 426 Petitions were granted.
