BOX 1057 FORKED RIVER, N.J. 08731 RESOLUTION OF THE COUNSEL TOWNSHIP OF JACKSON, COUNTY OF OCEAN, STATE OF NEW JERSEY, AMENDING AND SUPPLEMENTING RESOLUTION 122-2025, REGARDING RELEASE OF PERFORMANCE GUARANTEES POSTED BY RUTHERFORD ESTATES LLC (BLOCK 11701, LOTS 9, 25, 26 &33) WHEREAS, the Township Counsel of Jackson, County of Ocean, State of New Jersey, (hereinafter referred to as the “Township”) has previously adopted Resolution 122-2025 on March 11, 2025 (hereinafter referred to as the “Resolution”); WHEREAS, it appearing that a typographical error was inserted into the Resolution, and the cash portion of the bond referenced in paragraph one (1) is in fact $48, 404.40, not $8,404.40; WHEREAS, the Township wishes to correct the typographical error set forth in the Resolution; NOW, THEREFORE BE IT RESOLVED, by the governing body of the Township of Jackson, County of Ocean, State of New Jersey this 7th day of May 2025 as follows: 1. The Township corrects the aforementioned Resolution to reflect that an existing bond in the amount of $435,639.60 includes a cash portion of $48,404.10. 2. The Township will authorize that $15,075.57 of the aforementioned cash bond be released to Lakewood Investments, LLC, thereby leaving a cash site stabilization bond in the amount of $33,328.83. 3. A certified copy of this Resolution shall be forwarded to the Township Chief Financial Officer, the Township Engineer, and Rutherford Estates LLC. ## CERTIFICATION I, SANDRA MARTIN, RMC, CMR, Municipal Clerk of the Township of Jackson, do hereby certify that the foregoing resolution was duly adopted by the Council of the Township of Jackson at a meeting held on this 13 day of May. 2025
