Appeals
Either party (complainant or respondent) may appeal the decision-maker's determination regarding responsibility and/or KSU's dismissal of a formal complaint or any of its allegations.
- Grounds for Appeal: Appeals are limited to the following grounds:
- oA procedural irregularity that affected the outcome of the matter (e.g., a material deviation from established procedures).
- oNew evidence, which was not reasonably available at the time the determination regarding responsibility or dismissal was made, that could affect the outcome of the matter.
- oThe Title IX Coordinator, investigator(s), or decision-maker(s) had a conflict of interest or bias for or against complainants or respondents generally, or the individual complainant or respondent, that affected the outcome of the matter.
• Appeal Process:
- oAppeals must be submitted in writing to the appeals officer within five (5) business days of the delivery of the written determination or dismissal. The Title IX Coordinator or decision-maker shall notify the parties of who the appeals officer is for a particular matter.
- oThe written appeal must specify the ground(s) for appeal and include supporting information.
- oThe non-appealing party will be notified of the appeal and provided an opportunity to submit a written statement in response within five (5) business days.
- oThe appeals officer will review the written submissions and the record of the original matter to determine if the grounds for appeal have been met.
