TITLE: RESOLUTION AUTHORIZING THE EXECUTION OF AN AMENDED DETENTION/STORMWATER BASIN OWNERSHIP, OPERATION AND MAINTENANCE AGREEMENT WITH JACKSON STORAGE, LLC ON BLOCK 4801, LOTS 22.01 AND 23.01 (400-412 NORTH COUNTY LINE ROAD)

WHEREAS, Jackson Storage, LLC is the developer of property located at Block 4801, Lots 22.01 and 23.01 at 400-412 North County Line Road; and
WHEREAS, the Jackson Township Governing Body has previously approved the required detention storm water basin ownership operation and maintenance agreement via Resolution 269R-17 dated August 22, 2017, based on Jackson Township Planning Board approvals dated June 13, 2017 for Block 4801, Lot 22.01, and which agreement was filed in the Ocean County Deed Records at Book 16862, PG 1347; and
WHEREAS, on March 18, 2019, the Jackson Township Planning Board has since approved new plans entitled “Preliminary and Final Major Site Plan and Preliminary and Final Major Subdivision for Jackson Storage of New Jersey, LLC Proposed Self Storage Expansion, Block 4801, Lots 22.01 and 23.01, prepared by James E. Henry, PE of Dynamic Engineering, dated 11/12/18 and last revised 8/6/19; and
WHEREAS, this amendment incorporates the “New Plans” and related revisions as approved by the Jackson Township Planning Board; and
WHEREAS, the detention pond that is the subject of the Agreement shall be as shown on the New Plans and as contained in the Amended Drainage and Right-Of-Way Easement to be recorded simultaneously herewith; and
WHEREAS, the Stormwater Management Operations and Maintenance Manual, prepared by James E. Henry, PE, PP of Dynamic Engineering dated June, 2019 shall replace the reference in the Agreement to the Stormwater Management Systems Operations and Maintenance Manual, prepared by WJH Engineering dated December 21, 2016.
WHEREAS, it is the desire of the governing body to authorize the execution of the AMENDED Ownership, Operation and Maintenance Agreement with Jackson Storage, LLC which is attached hereto and incorporated herein as Schedule A.
NOW, THEREFORE, BE IT RESOLVED that the Township Council of the Township of Jackson, County of Ocean, State of New Jersey as follows:
That the governing body does hereby authorize the execution of the Ownership, Operation and Maintenance Agreement attached hereto as Schedule A.
That a certified copy of this resolution shall be forwarded to the attorney for Jackson Storage of New Jersey LLC, Jennifer S. Krimko, Esq of Ansell, Grimm & Aaron PC; Planning Board Secretary Denise Buono, Planning Board Attorney Sean Gertner Esq., and Township Attorney Gregory McGuckin.
