WHEREAS, Township Engineer, T & M Associates has no objection to the renewal of this license but with the above submissions prior to approval as indicated in a letter dated July 14, 2021 providing the appropriate fees have been paid, all property taxes are paid and up to date, the Zoning Officer ensures there are no outstanding violations for the subject site, and the bond is reviewed by the Township Attorney; and

NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township of Jackson, County of Ocean and State of New Jersey, as follows:

  1. The Township Clerk is hereby authorized to issue a one (1) year mining license to the applicant, Clayton Sand Company.
  2. Said license is issued for a period commencing March 31, 2021 nunc pro tunc and terminating on March 31, 2022.
  3. Said license is issued subject to the applicant's continued compliance with conditions and requirements as follows:
  4. Payment of all outstanding fees and taxes.
  5. An updated survey will be performed and provided to the Township Engineer within 3 months of the approval.
  6. Changes to Certificate of Liability showing correct Certificate Holder information.
  7. The applicant retaining the required insurance in accordance with Chapter 185.
  8. The applicant retaining the required bonding in accordance with Chapter 185.
  9. The applicant adheres to all guidelines/requirements as set forth in Chapter 244, Section 79 (F).
  10. The applicant obtaining all other local, County and State permits.
  11. The existing topographic information shown on the plans is based on the flown survey for Atlantis Aerial Survey Company on February 9, 2006. Ordinance #185-2E4 requires the submitted plan include contour lines showing elevation at the time of the application. We recommend a survey update to be provided to this office for review within the next (3) months, as a condition of this approval.
  12. That upon the adoption of this resolution, the Clerk is authorized and directed to forward a certified copy of it to Clayton Sand Company, Township Engineer, Stephen Schreiber, T&M Associates & Zoning Officer.

TITLE: REQUEST APPROVAL FOR THE INSERTION OF A SPECIAL ITEM OF REVENUE AND APPROPRIATION PURSUANT TO N.J.S.A. 40A: 4-87 - FOR THE FY 2022 NJDHTS PEDESTRIAN SAFETY GRANT

WHEREAS, N.J.S.A. 40A: 4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any local unit when such item shall have been available by any public or private funding source and the amount therefore shall not have been determined at the time of adoption; and

WHEREAS, N.J.S.A. 40A: 4-87 further provides that the Director may approve the insertion of an appropriation item of an amount equal to any such special item of revenue making such item of revenue available for expenditure; and

WHEREAS, the Township of Jackson has been provided additional funds from the State of NJ, Department of Law and Public Safety, Division of Highway Traffic Safety in the amount of $6,840.00; and
