WHEREAS, the Township of Jackson has received a quote from GOVPILOT for the provision of certain proprietary computer software for use by various departments within the Township of Jackson; and

WHEREAS, the Township has received a quote for such services in the amount of $53,328.00; and

WHEREAS, pursuant to N.J.S.A. 40A:11-5(dd) the provision or performance of goods of services for the support or maintenance of proprietary computer hardware and software is a specific exception to the provisions of the New Jersey Local Public Contracts Law due to the proprietary nature of such services and equipment; and

WHEREAS, the Township of Jackson has a need for the services and software to be provided; and

NOW, THEREFORE, BE IT RESOLVED, this 28th day of September, 2021, by the Township Council of the Township of Jackson, County of Ocean and State of New Jersey, as follows:

1. 1. The Township hereby authorizes a contract with GOVPILOT in the amount of $53,328.00 retroactive to June 1, 2021 and continuing to May 30, 2022.

BE IT FURTHER RESOLVED that the Township Clerk is hereby authorized and directed to provide a copy of this Resolution to Terence Wall, Township Administrator; Janice Kisty, RMC; Sharon Pinkava, CFO; GOVPILOT; and Gregory P. McGuckin, Esq.

TITLE: AUTHORIZE THE EXECUTION OF A SCHEDULE “C” AGREEMENT BETWEEN THE TOWNSHIP OF JACKSON AND THE COUNTY OF OCEAN UNDER ITS SCHEDULE “C” PROGRAM FOR CY 2021

WHEREAS, the Interlocal Services Act, N.J.S.A. 40:8a-1 et seq. authorized the Township of Jackson to enter into a contract for the provision of certain governmental services with the County of Ocean; and

WHEREAS, N.J.S.A. 40:8 a-1 et seq. requires such a contract be authorized by resolution or ordinance; and

WHEREAS, it is the desire of this governing body to authorize the execution of a contract with the County of Ocean for the provision of services, materials and equipment as set forth in Schedule “C” attached hereto.

NOW THEREFORE, BE IT RESOLVED by the Township Council of the Township of Jackson, County of Ocean, State of New Jersey as follows:

1. 1. That the Mayor and Township Clerk are hereby authorized to execute a Schedule “C” agreement with the County of Ocean in accordance with the provisions of the law to include $10,000.00 for “Schedule C” Labor and Equipment Rates of the Ocean County Road Department ($10,000.00). A copy of said agreement is attached hereto and made part hereof as Schedule “C”. The Chief Financial Officer has certified that sufficient funding exists for this purpose in Account No. 1-01-26-290-000-115.
