It was good to see a good crowd out there again. Stated we had some music and the band playing and the chorus singing. It was good to see everyone back out celebrating the season. Stated it was already previously mentioned by our Council President Today is the 80th anniversary Pearl Harbor Day that will live in infamy as it was so described by FDR himself and that’s a great day to remember that real defining moment for that generation. For our grandparents generation that was defined them that was what they rose to the occasion for. Just like our parents where they all knew where they were when JFK was assassinated. Our Generation it was 2001 with the Towers coming down. Stated who knows what the next generation will have but there is always a defining moment. This is why we always need to remember our history and why he typically preach that to everybody these things matter, they mean something and they should be taught so if your children and grandchildren do not understand what the day of infamy really means after 80 years. If their grandparents and great-grandparents are not there to tell them stories about it bring that to their attention. Let them know so that they can stand proud as Americans for what they fought and died for. COUNCILMAN SAUICKIE- Appreciates both Council President Kern and Councilman Chisholm for bringing up the 80^{th} anniversary of Pearl Harbor Day. We should remember it. Waived further comments. COUNCIL VICE PRESIDENT FLEMMING – Knows he is early however, in a month we lose our Clerk the lady who has been taken care of Council since he’s been here and with everybody on Council. Stated they are going to miss Clerk Kisty. COUNCIL PRESIDENT KERN- Thanked everyone for coming out and to please get home safe. ## APPROVE EXECUTIVE SESSION MEETING MINUTES: NOVEMBER 23, 2021 APPROVE EXECUTIVE SESSION MEETING MINUTES: NOVEMBER 23, 2021 MOTION TO APPROVE BY: FLEMMING SECONDED BY: SAUICKIE YES: CHISHOLM, SAUICKIE, FLEMMING, KERN ABSENT: BORRELLI ===== PAGE 3 ===== ORDINANCES, FIRST READING: ORDINANCE: 30 -21 TITLE: AN ORDINANCE AUTHORIZING THE ACQUISITION OF CERTAIN REAL PROPERTY FROM THE STATE OF NEW JERSEY, DEPARTMENT OF TRANSPORTATION PURSUANT TO N.J.S.A.. 40A:12-5 MOTION TO APPROVE ORDINANCE 30-21 ON FIRST READING, ADVERTISE THE APPROVAL AND NOTICE OF SECOND READING AND PUBLIC HEARING TO BE HELD ON DECEMBER 21, 2021 BY: FLEMMING MOTION SECONDED BY: CHISHOLM YES: CHISHOLM, SAUICKIE, FLEMMING, KERN ABSENT: BORRELLI ## ORDINANCE 30-21 NOW, THEREFORE, BE IT ORDAINED, by the Township Council of the Township of Jackson, County of Ocean, State of New Jersey, as follows: SECTION 1. DATED: 12-7-2021 COUNCIL PRESIDENT KERN Stated before public comment our BA has an update on leaf pickup. BA Wall- Just a brief update on the leaf pickup collection started on November 8th as Public Works Department will revisit the zones to pick up any remaining leaves. Township residents will also receive weekly updates regarding legal pickup on the website and you can also find it on Facebook. BA Wall stated for all concerns please reach out to Public Works if there are any communication issues or you’re not satisfied with the answers please reach out to Administration so we can address that for you. ## PUBLIC COMMENT, ANY TOPIC MR. AND MRS. JAMES RAPP–49 JOHNSON LANE – Asked Council to reverse the rezoning on block 12201 Lot 16 and 18, those lots are on what is known as Johnson Lane it is a portion that enters from Bennetts Mills Road and it’s a 14 foot wide dirt road, or right of way, and it ends at their house, where there is a Township installed gate that says emergency access only and there’s no place to turn around. The problem in our neighborhood began when the properties began to be rezoned; he says began to because it’s a continuing process but the main properties that are on Bennetts Mills are lot 18 and subsequently then lot 16 caused their neighborhood a considerable angst, undue stress and nervousness about what possibly was going to take place in and around their homes. Their homes are rural in nature, have been agricultural in use. Stated to hear news that it’s rezoned from R-5 where the Rapps felt secure when he bought his home thought he bought in a bedroom community that was going to accommodate their desire to live in harmony with their neighbors; feels it is not possible since the property was rezoned. Stated a neighbor who ===== PAGE 33 ===== lived near cause a considerable amount of angst who came before the council in 2016; asked the Township with anger and frustration and fear about her property was rezoned without the resident being informed. The owner sold the property however that property is valuable piece of land to the ecosystem it is piece of buffer land, its clear field, it is home to several threatened endangered species that they have documented and stated other species. Council President Kern asked if the resident still owns the property. Mr. Rapp stated no. Council President Kern asked when the zoning change and if was when master plan changed in 2010. Mr. Rapp stated the zone changed from residential to limited commercial. Mr. Rapp stated they currently have an application they are going for a use variance and the purpose development. Standard septic system it is going to be used for different stores and will be used to go surrounded by business. Councilman Sauickie asked does the property have frontage on Bennetts Mills Road and is it land locked property. Mr. Rapp stated no; its landlocked property other than the dirt road that goes along the side of it which is a right of way. Council President Kern stated they would have to go before a Board- Planning or Zoning. Mr. Rapp stated they currently have an application they are seeking a use variance and the proposed development consists of two 9,600 square foot warehouse, retail, office on sales from those properties to accommodate 24 parking spaces and a minimal septic field which stands the lowest feet from his neighbor's corner of her horse farm. Attorney Greg McGuckin stated if it is before Planning Board the Township cannot change the Ordinance if it's under review with the Board. Council President Kern told Mr. Rapp we do understand your comment; we’ll take into consideration and speak to our Attorney and speak to whoever else we can speak to about it. There is no statement that we can make tonight and there’s nothing we can do today. Preserving land is very important to this Council; as the Attorney stated there are many laws that prevent us from making changes that you had hoped when you came here. It is before the Zoning Board it is an active application there is no comment that we can make about it. Mr. Rapp wants Council to take a look at the map, to look at the water table and the species of animals that live there. Stated the negative impact on their quality of life, the safety of the children and their house values. DEBORAH ARTZ- 16 JOHNSON LANE - Stated the property that Mr. Rapp was talking about is on the side of her property she is in middle of two properties. Ms. Artz was unaware that her zoning was changed; it went from R1 to LC since she bought her property in 2016. She was never informed about the zoning change. Now she is getting calls, text and people coming to her house to ask her to sell her home. Council President Kern asked Ms. Artz what year did she purchase her house. Ms. Artz stated 2016 it was changed to LC however, all her documents have Zone R1 on them. Council President Kern stated the master plan has not been changed since 2010. Stated Ms. Artz should go speak to the Tax Assessor to make sure her zone is zoned correctly. There's an active application on this. Councilman Sauickie asked Attorney Greg McGuckin in general no applicant involved here, in the case of 2010 when the master plan was opened up and zones were apparently changed. Would there be notice written provided to the people in the area. Attorney Greg McGuckin stated there would have not been separate notice to the property owner it would be advertise as part of the master plan, moving advertisements on the public hearings and each ordinance would have been advertised as any ordinance in the newspaper with public hearings thereon here in town hall. There wouldn't be separate individual notice but there would be notice of the master plan hearings publicly and the ordinance changes are all announced publicly published publicly and then the hearing is held here. ===== PAGE 34 ===== Councilman Sauickie stated what about if somebody was living on the property and it got changed would with the owner be notified. Attorney Greg McGuckin stated no if it was done as part of the master plan. If it was a recommendation of the master plan, they would not receive individual notice. It is statewide. Ms. Artz stated she will speak to Taxation and see what it says; but on every paper work even from her Attorney when she bought the property she checked with Jackson to make sure that she could have animals on the property since it was previously a farm and was told yes its residential R1. When she went to the meeting a couple of weeks ago and found out her property is suddenly her property is an LC. Councilman Sauickie stated there is an ordinance in town about no knock advised Ms. Artz to get a no knock sticker. Clerk Kisty stated if it continues to contact the Police Department. JANELLY LANDA -70 JOHNSON LANE- Ms. Landa stated just moved to the area and new to this issue and picked this particular street because it was quiet cul-de-sac where kids go outside and play. She did observed the area that Mr. Rapp spoke about, thinks it would have a huge detriment to have half commercial properties develop in this area it would decrease property values and make it a little less safe for kids. SHELDON HOFSTEIN-48 BALTUSROL DRIVE- Wanted to know if Council could give a quick rundown on Ordinance 32-21 rezone where you’re amending and supplementing Chapter 244-57 one in the mixed area what are the plans for that. Council President Kern stated that’s a part of the Jackson 21 settlement. That portion of land was originally set up to be large retail like in Howell where they are having problems filling space and in other areas of the State where regular normal retail would be and being adjusted to where it’s e-commerce and other opportunities to develop that portion; it is a small portion of that settlement. Mr. Hofstein’s next comment was about the Planning Board appointee feels the person should resign and should wait until the lawsuit is resolved. Mr. Hofstein thanked Clerk Kisty for her service to the Township and for the excellent job she has done for this town Clerk and hopes she enjoys her retirement and her grandchildren. JIM RAPP- 49 JOHNSON LANE- Mr.Rapp stated that a former Councilperson had made a comment sometime in the past that all of Bennetts Mills is going to be commercial. ## MOTION TO CLOSE PUBLIC COMMENT ON ANY TOPIC BY: SAUICKIE MOTION SECONDED BY: FLEMMING YES: CHISHOLM, SAUICKIE, FLEMMING, KERN ABSENT: BORRELLI MOTION TO ADJOURN BY: SAUICKIE MOTION SECONDED BY: CHISHOLM YES: CHISHOLM, SAUICKIE, FLEMMING, KERN ABSENT: BORRELLI 8:45 P.M. ## RESPECTFULLY SUBMITTED, COUNCIL PRESIDENT KERN JANICE KISTY, R.M.C.
