RESOLUTION 445R-21 TITLE: AUTHORIZE THE EXECUTION OF A CONTRACT AGREEMENT FOR CY 2022 ANNUAL SUPPORT MAINTENANCE SERVICES CONTRACT BETWEEN THE TOWNSHIP OF JACKSON AND EDMUNDS ASSOCIATES IN THE AMOUNT OF $21,408.55

WHEREAS, the Purchasing Department has requested approval for the award of a one year maintenance contract for the Township’s Edmunds System; and

WHEREAS, Edmunds & Associates, Inc., the vendor awarded the system project, has provided a proposal for the CY 2022 Annual Support Maintenance Services Contract; and

WHEREAS, the Mayor and Chief Financial Officer have considered the need for an annual maintenance contract for this system; and

WHEREAS, the Mayor is requesting authorization to award this contract pursuant to N.J.S.A. 40A:11-5 (dd) (i.e. “Exceptions”); and

WHEREAS, the Chief Financial Officer has certified that sufficient funding exists for this purpose and is available in the CY 2022 Temporary Operating Budget under the following accounts numbers: 2-01-20-103-000-029, 2-01-20-105-000-029, 2-01-20-130-000-029 and 2-01-20-145-000-029.

NOW, THEREFORE, BE IT RESOLVED, that the Township Council of the Township of Jackson, County of Ocean, State of New Jersey does hereby authorize the award of the CY 2022 Annual Support Maintenance Services contract for the Edmunds System to Edmunds & Associates with a properly executed purchase order for a total amount of $21,408.55.

A copy of this resolution shall be forwarded to the Township Administrator, Chief Financial Officer, Purchasing Department and any other interested parties.

TITLE: RESOLUTION AUTHORIZING THE SETTLEMENT OF LITIGATION BETWEEN THE TOWNSHIP OF JACKSON AND SIXTY ACRES RESERVE CONDOMINIUM ASSOCIATION, INC.

WHEREAS, the Township of Jackson is currently a party to litigation with the Sixty Acres Reserve Condominium Association, Inc.; and

WHEREAS, the parties wish to resolve a dispute in an amicable fashion by way of settlement; and

• NOW, THEREFORE, BE IT RESOLVED, this 21st day of December, 2021, by the Township Council of Township of Jackson, County of Ocean, State of New Jersey as follows:
• The Township Attorney be and he is hereby authorized to execute a Stipulation of Dismissal with Prejudice upon the full execution of a Stipulation of Settlement.
• BE IT FURTHER RESOLVED that the Mayor and Township Clerk, be and they are hereby authorized to execute said Stipulation of Settlement thereby resolving this
