"text": "Lane M orell, duly sworn by Bd Attorney, applicant representing himself. M r. M orell is looking to replace a building that was existing but collapsed during a snowstorm. The building was 26.2x42 shed, and he is looking to put up a pole barn, standard size is 30x50. This would extend the building 4ft to the right and 8 ft toward the rear, from where the existing building was. This would be strictly for storage. M s. Bradley asked if he is planning on putting electricity. The applicant testified there was electricity to the original building and he would like to continue to have electric in the proposed building, the existing conduit is still there. He would have a licensed electrician come out and connect it again. M r. Wilder said there is an existing shed, it is not reflected on the survey and it requires variance relief. M r. Wilder spoke to the applicant before the hearing and reviewed with the applicant where it is located. M r. Wilder said the side yard setback to existing shed is 30ft and rear setback is 10ft. The applicant will provide a revised survey that includes the shed. M r. Wilder said he will require variance relief for the side and rear setbacks. M r Heiman asked size of shed. Applicant stated it is 12x20. M r. Wilder added the property predates the zoning modification with respect to the grandfathering of the R1 zone. The problem with the grandfathering of the R1 zone is it requires properties to be 1 acre. This property is .97 acres and it misses that 1 acre threshold by 3%. Because of this the R3 zoning standards apply. M r. Wilder added if the R1 standards were applied, some of the variants would be eliminated and the ones that are still required would be diminimus. M r. M orell said the pole barn will be used for tractor storage, car that was bought to restore. No hazardous materials. The existing shed will have shovels and lawnmower in it. The existing shed does not have utilities. The applicant does not have any",

"text": "drainage issues. Dr. Hofstein asked if he does any work on the tractor and he said he does not maintain or do work on the tractor. It will be taken offsite for repair. Mr. Tremer said he does not see any infringement on neighbors. The applicant pointed out on there is an outhouse on the property survey. The house was built by his Grandfather 60 years ago and that was the original outhouse. He would like to preserve the outhouse as a part of the house history. Mr. Wilder reiterated the setbacks for the existing shed, the rear setback is 10ft from western property line and side is 30ft from the southern property line. Mr. Wilder said they would treat the outhouse as a shed, it would require a rear setback variance. The rear setback required is 25ft and it is at 10ft. Mr. Wilder said if survey comes back different, the applicant will have to return before this Board for approval. Mr. Cipriani clarified the old shed/outhouse, rear setback 25ft is required and 10ft existing. Mr. Wilder said the pole barn, is treated like a detached garage, it will require side and rear setback variances. The applicant is looking to rebuild in the same footprint of a structure that was previously destroyed. The minimum side yard setback would be 21.68ft and the side required is 50ft and the rear setback is 43.9ft and it is required to be 100. Mr. Wilder reminded the Board that this is where they are applying the R3 zoning because the property is a little under 1 acre. Dr. Hofstein asked no intent to use for commercial, meeting or a school. Mr. M. Orell said no. Mr. Heiman is asking for justification for rear setback, why can't he move it up a little and get to at least 50ft. The applicant testified due to the asphalt the driveway is already poured. Mr. M. Orell testified that ordering a custom size pole barn would be a financial burden. Mr. Heiman asked how the existing outhouse/shed approval would work. Ms. Cipriani said the Board can limit it to the size of the existing structure. Ms. Tumolo asked if it the outhouse requires a side variance. Mr. Wilder asked how far to the right the outhouse to the house. The applicant agreed it is 30ft. Mr. Wilder said that would require a side setback. Mr. Wilder said the Board can grant relief and stipulate if that structure was ever taken down the applicant would lose the variance, it is a nonfunctioning structure. Mr. Silecchia asked if there is any commercial business on this property. Applicant said no, they had a commercial business on County Line Rd but they sold that building. The applicant testified he has been in his house 32 years and he has tried to acquire property but neighbors do not want to sell. Ms. Tumolo confirmed the dimensions, the detached garage 30x50 by 15ft height, the outhouse is 8x12 and the shed 12x20 and 8ft high. Ms. Tumolo said the R3 maximum height is 25ft. Mr. M.
