Dr. Campbell announced a tem minute break beginning at 8:26 p.m. Mr. Herman left the meeting.

Application for Block: 4801; Lots: 24 and 25 – 450 Business Park, LLC

Mr. Klee stated that one variance for side yard setback is requested. Mr. Peters said a variance may be needed because there is parking between the two sites. Sal Alfieri, Esq. said all items will be addressed during testimony.

Brian Murphy, a professional engineer, professional planner and a principal with FWH Associates was sworn in. The Board accepted his credentials. Lot 24 received prior approval and construction has started. Mr. Alfieri revised this application to include lot 24 because there is some shared infrastructure. He did notice for both lots 24 and 25. An easement will be recorded to connect the sites. Mr. Murphy stated this is for a contractor warehouse and office with hours between 7:00 a.m. to 7:00 p.m. Monday through Friday and 7:00 a.m. to 2:00 p.m. on Saturday and Sunday. The 36 handicapped parking spaces will be provided plus handicapped and EV spaces. There will not be a lot of work vehicles on the property. There will be van and box truck deliveries but there is one loading dock per unit for tractor trailer access. There is no outdoor storage, no hazardous materials on site, no building signage on the road and no phasing. There is public water and sewer, privately maintained internal drives, a landscaping evergreen buffer and shrubs between street trees. Access will be through lot 24. The lots are not being merged. There will be a cross access easement. A variance is requested for parking to the side lot line. The 300 foot buffer is being maintained. They are tying into the sewer connection but have not received MUA approval.

Mr. Alfieri said an easement will be recorded with the County Clerk and will run with the land. Mr. Peters thinks there is an efficiency to this as it limits the number of points of access. Mr. Klee asked if signage complies and if there are floor drains in the warehouse. Mr. Murphy confirmed that signage will comply and there are no floor drains. Mr. Peters had concerns about the loading zones facing County Line Road and a senior community. Mr. Riker suggested an enclosed dock, which would be non-continuous use so it will not count towards parking and the applicant will not be penalized.

Michael Millemann, a principal with Tokarski & Millemann who has been practicing since 1999 was sworn in. The board accepted his credentials. Signage will conform. The loading docks will be screened with materials matching the rest of the building. Solar panels can be accommodated but that is a decision for the tenants.

John Rea was sworn in as a professional engineer with a specialty in traffic. The Board accepted his credentials. There are two points of intersection with lot 24. This setup limits conflict points and is an efficient way to run a traffic operation.

Dr. Campbell opened the meeting to public comments to address the testimony of the professionals.
