Corporate and partnership bidders shall comply with P.L. 1977, Chapter 33 by submitting a list of the names and addresses of all stockholders or owners holding ten percent (10%) or more of stock or owing a ten percent (10%) or greater interest therein. Failure to submit a list either prior to the time for the receipt of the bids or with the sealed bid will be grounds for the rejection of the bid.

Performance date shall commence as stipulated in agreement or as stated in specifications.

The second lowest bid shall be retained for a period of thirty (30) days after the award of bid.

TITLE: AUTHORIZE TOWNSHIP PURCHASING AGENT TO ENTER INTO CONTRACT NEGOTIATIONS FOR “NEXTEL PORTABLE DIGITAL CELLULAR TELEPHONE SERVICE PLAN AND RELATED EQUIPMENT

WHEREAS, Jackson Township previously advertised for the receipt of bids on August 27, 2002 at 10:00 a.m. for “Nextel Portable Digital Cellular Telephone Service Plan and Related Equipment”; and

WHEREAS, said advertisement for the receipt of bids was the second such advertisement, as the first advertisement for receipt of bids, July 24, 2002, one bid was received but rejected due to an inadequate bid bond, and;

WHEREAS, at the time and place for the second receipt of bids, no bids were received, and;

WHEREAS, the Township Purchasing Agent has recommended entering into contract negotiations for Nextel Portable Digital Cellular Telephone Service Plan and Related Equipment, and;

WHEREAS, now it is the desire of this Township Committee to act upon the recommendation of the Township Purchasing Agent,

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Committee of the Township of Jackson, County of Ocean and State of New Jersey, that:

The Mayor and Committee authorize the Township Purchasing Agent to enter into negotiations for a contract for “Nextel Portable Digital Cellular Telephone Service Plan and Related Equipment” N.J.S.A. 40A: 11-5(3) and

The Mayor and Township Clerk are authorized to sign or issue any appropriate documentation to give effect to the within resolution.
