WHEREAS, the maximum amount of this contract is undetermined and the Chief Financial Officer has certified that a maximum amount of 10,000 is available for this purpose is an appropriation in the 2002 Budget entitled:

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Committee of the Township of Jackson, County of Ocean and State of New Jersey as follows:
That Robert Clarke & Steve Glickman are hereby appointed to the position of Labor Attorney terminating December 31, 2002.
This appointment is made without competitive bidding for “Professional Services” to be performed by a person authorized by law to practice a recognized profession.
The Mayor and Township Clerk are hereby authorized to execute and deliver the contract attached hereto to said appointee.
A Notice of this appointment shall be advertised as required by law.
That upon adoption of this resolution, the Clerk is authorized and directed to forward a certified copy of it to the Administrator, Chief Financial Officer and Robert Clarke & Steve Glickman.

WHEREAS, in 2001, Joshua Associates filed a civil lawsuit against the Township of Jackson regarding Jackson Township Ordinances No. 03-01 and No. 36-01; and
WHEREAS, Joshua Associates has offered in settlement to release the Township of Jackson from any liability or damages arising out of the civil action, Docket Nos. OCN-L-756-01 and OCN-L-3072-01, subject to the attached "Exhibit A"; and
WHEREAS, the Township Attorney, Kevin N. Starkey, Esq., has recommended entering into the proposed Settlement Agreement; and
WHEREAS, the Township Committee of the Township of Jackson has considered the Settlement Agreement and the recommendation of Kevin N. Starkey, Esq.;
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Committee of the Township of Jackson, County of Ocean and State of New Jersey, that:
The Mayor for the Township of Jackson is hereby authorized to enter into a Settlement Agreement attached hereto as "Exhibit A" with Joshua Associates under Docket Nos. OCN-L-756-01 and OCN-L-3072-01.
