WHEREAS, Kripa’s Properties, LLC has requested a reduction of the Performance Guarantee posted for site plan known as County Line Plaza, located at 129 N. County Line Road (Block 84-01, Lot 6), Jackson Township; and

WHEREAS, the following Performance Guarantee is currently in place:

1. Performance Bond #FP0021436 issued by First Indemnity of America Insurance Company in the amount of $308,406.96.
2. Cash Bond in the amount of $34,267.44
3. ; and
4. WHEREAS, Michael G. Miller, T&M Associates, has reviewed and approved the reduction in the Performance Guarantees in a letter report dated January 30, 2017 reducing the total allowable reduction to $102,802.32 consisting of the following amounts:
1. Reduction in Performance Bond posted to not less than $92,522.09
2. Reduction in Cash Bond posted to not less than $10,280.23

;and

WHEREAS, the Township Council of the Township of Jackson has considered the application and the report of the Township’s Engineer.

NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Township of Jackson, County of Ocean and State of New Jersey, that the Performance Bond is hereby reduced from $308,406.96 to not less than $92,522.09 and the Cash Guarantee from $34,267.44 to not less than $10,280.23.

The Mayor and Township Clerk are authorized to sign or issue any appropriate documentation to give effect to the within resolution.

TITLE: AUTHORIZE THE EXECUTION OF A SCHEDULE “C” AGREEMENT BETWEEN THE TOWNSHIP OF JACKSON AND THE COUNTY OF OCEAN UNDER ITS SCHEDULE “C” PROGRAM FOR CY 2017

WHEREAS, the Interlocal Services Act, N.J.S.A. 40:8a-1 et seq. authorized the Township of Jackson to enter into a contract for the provision of certain governmental services with the County of Ocean; and

WHEREAS, N.J.S.A. 40:8 a-1 et. seq. requires such a contract be authorized by resolution or ordinance; and

WHEREAS, it is the desire of this governing body to authorize the execution of a contract with the County of Ocean for the provision of services, materials and equipment as set forth in Schedule “C” attached hereto.

NOW THEREFORE, BE IT RESOLVED by the Township Council of the Township of Jackson, County of Ocean, State of New Jersey as follows:

1. 1. That the Mayor and Township Clerk are hereby authorized to execute a Schedule “C” agreement with the County of Ocean in accordance with the provisions of the law to include $20,000.00 for “Schedule C” Labor and Equipment Rates of the Ocean County Road Department ($10,000.00 for Labor and $10,000.00 for Equipment). A copy of said agreement is attached hereto and made part hereof as Schedule “C”.
