MICHAEL REINA MAYOR DATE: February 25, 2014 ===== PAGE 3 ===== Councilman Bressi stated when these 3 bases joined together no one realized the strength it gave us, especially on the Eastern seaboard and why it was done between the New England states and Washington, D.C. To put a museum together to show, display and educate is so important to our freedoms and our Veterans for what they did in peace time and World War times. I really appreciate it and thank you all for doing it. Council Vice President Calogero stepped off the dais to personally congratulate Mr. Wysong and Mr. De Pasquale for their service. Mr. Wysong stated on behalf of the entire Board of Directors we thank you for this honor and recognition from Jackson Township Council and Mayor Michael Reina. The resolution tonight means a great deal to us because it raises the awareness further than the Proclamation. There are a number of museums on the bases but the public can’t access them for security reasons. COUNCILMAN BRESSI – Was proud to make the Proclamation to educate everyone to understand what the cost of freedom means. Thanked the gentlemen for getting it out to the public. COUNCILMAN MARTIN – A project like this reminds everyone what the Armed Forces do and we appreciate everything. Places like this make it possible to educate and the public can see what the Armed Forces do and how they protect us. Wished everyone a safe drive home. COUNCILWOMAN UPDEGRAVE – Thanked the gentlemen for proposing their museum; it’s a great place for the residents to go and see the preservation and the history of the base. COUNCIL VICE PRESIDENT CALOGERO – Thanked the gentlemen for their hard work in putting this museum together. With the phrase, “Never Forget” from 911, you’re making sure we don’t forget even further. COUNCIL PRESIDENT NIXON – My father spent part of this Army training in Fort Dix before he went to Vietnam; this base is a part of my family’s legacy. I’m grateful for what you are doing. Thanked everyone for coming out. ORDINANCES, SECOND READING: NONE AT THIS TIME. TOWNSHIP CLERK ===== PAGE 22 ===== ## DISCUSSION AGENDA: ### 1. ADMINISTRATOR TORRES a. Solar Project – Authorization had been granted to enter into an agreement with CME to prepare bid specifications to create a solar farm located at the Legler Site. Completion is nearing; therefore, I am seeking a resolution at the next Council meeting to go out on a RFP. Superfund Sites can be readapted for uses such as solar farms. We can generate revenue with the lease; also it allows us to be the purchaser of the energy generated by this farm at a discounted rate. Council discussed and agreed. A resolution will be ready for the March 25th meeting. ## PUBLIC COMMENT, ANY TOPIC RAY CATTONAR – 11 FORDHAM ROAD – You promised to supply information pertaining to the conflicts of interest but you invoked client/attorney privilege. He asked the Council to release the legal opinion to the public. Council President Nixon was not willing to disclose that information based on client/attorney privilege and the precedent it sets. Your interpretation is based on the statute you provided and her reading stating no conflict exists. I don’t believe we should release client/attorney documents. Mr. Cattonar couldn’t understand why it wouldn’t be released; he assumes the legal aspect is discussed in that statute. Council President Nixon stated he believes that he and Attorney Cipriani have given the answer and there is nothing that he will learn from that document based on the information given. Mr. Cattonar addressed Council Vice President Calogero and stated that he was quoted on a blog on The Ocean Signal, advocating I was trying to appoint my own campaign manager. Council Vice President Calogero stated that he stands corrected. PETER GRZELAK – 3 ABE'S WAY – Asked why Council President Nixon had an abstention. Council President Nixon explained his wife is employed by the Ocean County Board of Health and at the Attorney's recommendation he would abstain from anything related to the Ocean County Board of Health. Mr. Grzelak asked when the vote came up on your campaign manager to a paid position, did you also speak with Counsel before hand? Council President Nixon stated he did not and he is well aware of how the ethics statute reads. He has taken the State ethics course through his other job and knows the difference voting for a family member and a member of the public who happened to volunteer as my campaign manager. You are welcome to your opinion but I am very comfortable that I have made a decision that is perfectly legal. It's in the best interest of the Township that an excellent, qualified individual was appointed to that position. Mr. Grzelak never disputed the individual was or was not qualified. From day one it wasn’t about advocating for someone else, it was about the hiring of your campaign manager to a paid position. Council President Nixon stated we need to respectfully disagree there is no conflict and I respect your reading of the statute. Mr. Grzelak asked why our Attorney is invoking client/attorney privilege on a matter that the people should know about. It was done at the re-organization, it was hurried and no one spoke to the J.T.M.U.A. Attorney Cipriani stated the ability to invoke attorney/client privilege always rests with the client. It is my job to provide information to Council and it is up to them to release it. They frequently but not always do. Council President Nixon stated you’ve been given the answer and I disagree with past precedent about releasing things that have been given to the Township. It’s against the spirit of why you asked for that document with that advice of your Counsel. He offered to continue this discussion at another time. Mr. Grzelak stated by stating that answer, you have something to hide and are hiding it from the public. Council Vice President Calogero doesn’t feel it was rushed. In fact, the last several appointments were done at the re-organization. The last appointment to the J.T.M.U.A. was for Carol Blake at the re-organization. ===== PAGE 23 ===== RAY CATTONAR – 11 FORDHAM ROAD – At the first meeting you stated you would provide me with the information and at the second meeting it was client/attorney privilege. In my personal opinion, you are hiding something by not providing the information. Council President Nixon stated I will confer with Counsel after the meeting; I have nothing to hide. I have taken a stand with principal with the release of a document; I am more than happy to go through this with you. It was very specific direction that I was given after the fact. Council President Nixon wants no issue. PETER GRZELAK – 3 ABE’S WAY – Has a problem with Council President Nixon’s answer.
