# TOWNSHIP OF JACKSON RESOLUTION 318-2025

### AUTHORIZING THE RELEASE OF PERFORMANCE GUARANTEE AND SAFETY AND STABILIZATION GUARANTEE, JACKSON PROPERTIES/CASA NOVA 1, BLOCK 2101, LOT 5.01

WHEREAS, Jackson Properties/Casa Nova 1 has previously applied for and received approvals from the Township of Jackson, for the development of property known as Lot 5.01 in Block 2101 as shown on the official Tax Maps of Jackson Township; and

WHEREAS, in accordance with said approvals the developer has previously posted a Performance Guarantee in the amount of $67,327.20 and a Safety and Stabilization Guarantee in the amount of $2,805.30; and

WHEREAS, by letter dated August 1, 2025, the Township Engineer, T&M Associates has recommended that the Performance Guarantee may be released as all bonded improvements have been installed and are acceptable and in general conformance with the approved plans; and

WHEREAS, by letter dated September 4, 2025, the Township Engineer has recommended release of the Safety and Stabilization Guarantee as the site has been constructed to a point where improvements are adequate to avoid any potential threat to public safety; and

WHEREAS, the Township Council wishes to accept the recommendations of its Consulting Engineer; and

WHEREAS, the Applicant has further posted a two (2) year Maintenance Bond in the amount of $8,415.90.

NOW, THEREFORE, BE IT RESOLVED this 16 day of October, 2025 by the Township Council of the Township of Jackson, County of Ocean, State of New Jersey as follows:

1. The Township hereby authorizes the release of the Performance Guarantee and Safety and Stabilization Guarantee previously posted through a letter of credit from Manasquan Bank totaling $70,132.50.

2. This authorization of release of said guarantees noted above is specifically contingent upon a two (2) year Maintenance Bond being held by the municipality in the amount of $8,415.90 which Maintenance Bond shall not expire until two (2) years from the date of this Resolution.

BE IT FURTHER RESOLVED, that a copy of this Resolution shall be provided to the following:

2. Jackson Properties/Casa Nova Today, LLC, PO Box 869, Lakewood, NJ 08701

3. Gregory P. McGuckin, Township Attorney

4. Sandra Martin, Township Clerk

5. Stephanie Marlin, CFO

I, Sandra Martin, Municipal Clerk of the Township of Jackson in the County of Ocean, hereby certify that the above is a true copy of a Resolution adopted by the Township Council on the  $ 16^{th} $ day of October 2025.
