# TOWNSHIP OF JACKSON RESOLUTION 314-2025

### AUTHORIZING ACCEPTANCE OF PERFORMANCE BOND, SAFETY AND STABILIZATION SURETY BOND AND STORMWATER MANAGEMENT BASIN AGREEMENT FOR BMOJ, INC., BLOCK 6401, LOTS 21 AND 22

WHEREAS, BMOJ, LLC has previously received approvals from the Jackson Township Planning Board with respect to the property commonly known as Lots 21 and 22 in Block 6401 as shown on the official Tax Maps of Jackson Township; and

WHEREAS, in accordance with said approvals, the Applicant is required to post a Performance Bond as well as a Safety and Stabilization Surety Bond and to execute a Detention Stormwater Basin Ownership Operation and Maintenance Agreement with Jackson Township; and

WHEREAS, by letter dated August 18, 2025 the Township Engineer, T&M Associates determined the amount of said Performance Guarantees totaling $54,156.00, with $48,740.40 to be provided by a Performance Bond and a cash portion of $5,415.60; and

WHEREAS, in addition thereto the Applicant is required to provide a Safety and Stabilization Guarantee totaling $17,960.25; and

WHEREAS, the Applicant has posted a Performance Bond and a Safety and Stabilization Surety Bond which documents are acceptable as to form and content as well as a Cash Bond portion in the correct amount; and

WHEREAS, the Detention Stormwater Basin Ownership Operation and Maintenance Agreement is acceptable to the Township.

NOW, THEREFORE, BE IT RESOLVED this 16th day of October, 2025 by the Township Council of the Township of Jackson, County of Ocean, State of New Jersey as follows:

1. The Township hereby accepts the Performance Guarantee for this project as well as a Safety and Stabilization Guarantee and authorizes the execution of the Detention Stormwater Basin Ownership Operation and Maintenance Agreement.

BE IT FURTHER RESOLVED, that the Mayor, Township Clerk and such other Township Officials as may be deemed necessary are hereby authorized to execute the documents in accordance with the intent of this Resolution.

BE IT FURTHER RESOLVED, that a copy of this Resolution shall be provided to the following:

1. Charles Cunliffe, PE, PP, CME, Township Engineer

2. BMOJ, LLC

3. Sandra Martin, Township Clerk

4. Jennifer Kuhn, Mayor
