WHEREAS, official Minutes of Jackson Township Council meetings have been prepared; and
WHEREAS, the Township Clerk has reviewed these Minutes and has submitted them to the Town Council for their approval;

TITLE: AUTHORIZE AND ACCEPT SETTLEMENT AGREEMENT BETWEEN THE TOWNSHIP OF JACKSON AND CHRISTOPHER & JENNIFER MONTALVO

WHEREAS, it is the desire of the Township of Jackson to settle the litigation matter entitled “Montalvo v. The Township of Jackson, et al.”, with said matter having a docket number of OCN-L-360-06; and
WHEREAS, the nature of the litigation was to determine the individual or parties who were responsible for the maintenance of the detention basin located upon Block 144.01, Lot 14.01, with said parcel currently owned by Christopher and Jennifer Montalvo; and
WHEREAS, as part of the settlement negotiations, the Township of Jackson shall assume maintenance responsibilities for the detention basin located upon Block 144.01, Lot 14.01; and
WHEREAS, as part of the settlement negotiations, the Township of Jackson will be paid the amount of $13,750.00 for current and future maintenance of the detention basin.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Township Council of the Township of Jackson, County of Ocean, State of New Jersey, as follows:
