Motion by Smith, seconded by Manternach, carried unanimously to approve publication in the official newspapers of the County the following notice:

Notice is hereby given that a Public Hearing will be held at 9:00 a.m. on the 8th day of September, 2009, in the Supervisors Chambers, Fourth Floor, Dubuque County Courthouse, Dubuque, Iowa, upon a proposal to make a sale and conveyance of the following real property to the Iowa Department of Transportation for $1.00:

RR Tracks Running Along Between 1-2-3 C & 2-2-3 C of Industrial Sub 1 and Bal.S.16' -N.66' City Lot 552A, City of Dubuque, County of Dubuque, State of Iowa

At the hearing, the Board of Supervisors shall receive comments on the proposal from all interested parties.

It is hereby resolved, that the Dubuque County Board of Supervisors proposes to make a sale and conveyance of the following real property to convey to the Iowa Department of Transportation for the sum of $1.00:

RR Tracks Running Along Between 1-2-3 C & 2-2-3 C of Industrial Sub 1 and Bal.S.16' -N.66' City Lot 552A, City of Dubuque, County of Dubuque, State of Iowa

It is further resolved, that a public hearing on the foregoing proposal shall be held at 9:00 a.m. on the 8th day of September, 2009, in the Supervisors Chambers on the fourth floor of the Dubuque County Courthouse and that notice of the hearing shall be published as provided by Iowa Code section 331.361(2).
