Chapter 2, Section 64.1 (c) “If the plat is found to substantially conform to the preliminary plat as approved, the final plat shall be forwarded to the Board for review. If the plat is found not to conform to the preliminary plat, it shall be corrected or referred to the Planning Commission for further review, prior to review by the Board. If the Board is referred to the Planning Commission, the Planning Commission shall then review the plat and shall forward a written recommendation to the Board within forty-five (45) days of the filing of the plat with the Plats Officer. If the recommendation is to disapprove the plat, or to require modification of the plat, the reasons therefore shall be set forth in writing, and a copy of the recommendation shall be provided to the subdivider.”
Chapter 2, Section 64.1 (d) “Upon receipt of the plat and written reports, the Board shall review the plat and attachments. If the plat is found to conform to the ordinances, statutes and standards of the County and the Comprehensive Plan and other duly adopted plans, all as of the date of approval of the Preliminary Plat; and is found to substantially conform to the preliminary plat, the Board shall approve the plat and shall cause its approval to be entered on the plat.”
Chapter 2, Section 64.1 (e) “Action of the final plat, by the Board, shall be taken within sixty (60) days of the date of filing of the plat with the Zoning Administrator, unless such time period is extended by agreement between the subdivider and the County. However, such time limitation is notwithstanding, if any portion of the land to be subdivided lies within the City's area of review as described in the City Ordinance adopted under Chapter 354 of the Code of Iowa. The Board shall defer final action on the plat until action has been taken by the City. If the action is to disapprove the plat, the reasons therefore shall be set forth in the official records of the Board and such decisions shall be provided to the subdivider.”
Staff Comment: The Final Plat of Weber Dubuque Farm No. 2 conforms with the Subdivision and Platting Ordinance, as addressed previously. With respect to the Dubuque County Zoning Ordinance, the new lots all conform to the minimum lot areas and frontage widths for their respective zoning districts.
Considering objectives within the Dubuque County Regional Comprehensive Plan, Chapter 8 “Housing” addresses the need for housing opportunities in the rural areas where appropriate. Lot 1 is zoned A-2 Agricultural Residential, which will provide an additional housing opportunity. Lot 2 is zoned A-1 Agricultural, and preserves about 90 acres of farm ground, and can’t be subdivided again unless a portion is zoned for Residential use. Preserving this farm ground meets the County’s goal to preserve and protect as much farm ground as possible (Chapter 9, Agriculture and Natural Resources).
