SECTION 13. All ordinances or parts of ordinances inconsistent herewith are hereby repealed.
SECTION 14. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions hereof.
SECTION 15. This ordinance shall take effect after second reading and publication as required by law.

TITLE: AUTHORIZE AS-BUILT/CLOSE-OUT CHANGE ORDER NO. 1 TO THE CONTRACT BETWEEN THE TOWNSHIP OF JACKSON AND EARLE ASPHALT COMPANY FOR THE PROJECT KNOWN AS “RECONSTRUCTION OF WRIGHT DEBOW ROAD” HEREBY DECREASING THE CONTRACT AMOUNT BY ($62,255.26) RESULTING IN AN ADJUSTED CONTRACT PRICE IN THE AMOUNT OF $639,257.88

WHEREAS, the Township of Jackson previously awarded a contract to Earle Asphalt Company for the project known as “Reconstruction of Wright DeBow Road” in the amount of $701,513.13; and
WHEREAS, Township Engineer, Daniel Burke, has recommended the approval of As-Built/Close-Out Change Order No. 1 decreasing the contract by ($62,255.26) as a result of final as-built quantities (per attached “Schedule A”); and
WHEREAS, the approval of this As-Built/Close-Out Change Order No. 1 will result in the return of the performance guarantee posted for this project. The return of said performance guarantee will be contingent upon the posting and acceptance of the required Maintenance Guarantee, which will run for a period of one (1) year.
