## Infra25-426 - NTC Response
Newquay Town Council wish to register their strong objection to the new waiting restrictions proposed under Infra25-426.
Whilst it is fully appreciated that parking and congestion around Porth Beach Road can present a challenge to Cornwall Council during the summer, increasing the current restrictions, from 5 months of the year to 8, will immediately impact the public's ability to access and enjoy Porth Beach. Similarly, doubling the hours of this restriction from 12 hours a day to 24 will act to multiply this same harmful effect.
Porth Beach has received national recognition under the British Beaches Seaside Award scheme. It is widely seen as a clean, safe, attractive and well-managed coastal stretch, making it a highly favoured family destination, both for our residents and for visitors to the town. The beach also attracts a wide and diverse range of users, including walkers, surfers and swimmers, as well as providing an important resource for valued community groups such as the Lusty Surf Life Saving Club and Newquay Road Runners.
Porth Beach is also Newquay's most accessible beach, enabling people with a wide range of disabilities to fully enjoy the coastal experience that our town offers. Porth Beach Road currently acts as an essential element of the 'gateway' to that experience, even more so given the ongoing status of the Porth Beach car park. The lack of any provision allowing Blue Badge holders to park in the proposed zone (subject to standard restrictions) is considered disappointing - such a concession could have helped preserve an element of access for any disabled person who would wish to use the beach.
The Town Council also has significant regard for the concerns raised by local businesses, whose very existence and vital contribution to our visitor economy almost completely relies upon the pulling-power of Porth Beach.
A complete absence of any justification for imposing these overly restrictive measures is the cause of great surprise and even greater concern, further strengthening the arguments for our robust objection to these proposed changes.
In conclusion, the Town Council gives great weight to the unique benefits that Porth Beach offers to our residents, to our visitors, to local businesses and to the town itself. It is for these reasons that Newquay Town Council strongly objects to the waiting restrictions proposed for Porth Beach Road, and to the significant harm they would inflict on Newquay as a whole.

| Licensing Objectives |
| b) The prevention of crime and disorder | adhered to and are suitable conditions for the variation put forward in this application. |
| A condition set in our previous application earlier this year that doorstaff shall be employed at the premises every Friday and Saturday from 21:00 unless the premises is closed by midnight. We continue to be active in communication with pubwatch, axien security, and keen to be involved in other Newquay initiatives. |
| c) Public safety | The licensed area has been enclosed with steel and wooden barriers to keep public pavements unobstructed and customers away from traffic. The Pagan Arms continues to have a small overall capacity, reducing impact on the local area with an extension of the outside area closure time. Our team receive training on anti-drug policy, Newquay Safe Space, and how and when to report incidences that occur inside or nearby. |
| d) The prevention of public nuisance | The Pagan Arms continues to utilise plastic cups after 11pm on Friday and Saturday nights to reduce the chance of injury or damage, especially important for keeping the outside area safe for the public. |
| e) The protection of children from harm | The Pagan Arms continues to follow the guidance of Think 25 and requesting IDs. |

| Town Council Response | NO OBJECTION: Cllrs agreed the scale and appearance of the proposed garage extension, including the materials to be used, would be quite suitable for this location.
Cllrs agreed the conversion of the garage to an annex e would appear unlikely to impact the residential amenity of neighbouring properties, noting that the annex e would accommodate an elderly dependent with health and mobility needs.
Members would expect the addition of an annex e condition appropriate to the intended use. |

| Town Council Response | SUPPORT: In line with Policy H1 of the Newquay Neighbourhood Plan (Replacement Dwellings and Extensions), Cllrs agreed the scale and appearance of this modest single-storey side extension, including the materials to be used, would be quite suitable for this location and unlikely to impact the residential amenity of neighbouring properties. The addition of a permeable resin-bound driveway, with associated vehicular access, is considered to be consistent with the wider local objective of providing appropriate off-street residential parking. Cllrs noted that formation of the vehicular crossover would be subject to the relevant Cornwall Council highway requirements and any separate vehicle-crossing approval required. With regard to Newquay Neighbourhood Plan policy G2(e), the applicant is encouraged to explore any reasonable opportunities to incorporate high levels of environmental sustainability, such as renewable energy sources and rainwater harvesting, into the overall design. |
