of reconciling itself with the Master Plan. Dr. Campbell asked how this should be verbalized and what exact language should be used. Mr. Shea advised keeping it simple and somebody makes a motion to either have it consistent with the Master Plan or inconsistent with the Master Plan.

Mr. Bressi made a motion that Ordinance 2026-25 is not consistent with the Master Plan. This ordinance was placed be so minimal that the applicants can just go in and like a conditional use add more testimony. He referred to the main thing that Mr. Sullivan brought up by assigning out a particular use to ban by affirmative legislation permits a developer to argue the Township itself and therefore the Zoning Board is a biased against the application and that would be a loss all the way around. It would also ruin the Master Plan because they would make you turn that around. That has happened in the Town before. So with all that said, there is enough here to support why he voted no. Mr. Bressi is not telling anyone else how to vote. His opinion is all his.

Mr. Shea wanted to make it clear that prohibited use would increase the weight of evidence and burden of proof on the negative criteria of a D1 variance regarding that type of use. It does increase the weight and burden of proof on the negative side.

Being in the middle of a motion, Dr. Campbell asked Mr. Bressi to restate that motion. Mr. Bressi once again made a motion that this is not consistent, especially with the minimal effect it has for the applicant to just add some more testimony to try to wean his way through the Zoning Board. His motion is it is not consistent with the Master Plan. Mr. Sullivan seconded that motion.

A roll call vote was taken:

Mr. Bressi voted yes for not consistent.

Ms. DeMarzo voted yes for not consistent.

Mr. Heller voted no, it is consistent with the Master Plan.

Mr. Parkes voted yes to it being inconsistent with the Master Plan.

Mr. Rogers voted yes it is inconsistent.

Mr. Sullivan voted yes it is inconsistent.

Dr. Campbell voted yes it is inconsistent with the Master Plan.
