Dr. Campbell commended those Board members who do not reply on social media. She knows it is tempting and hard not to respond on occasions when we are spoken of unkindly. The Board attorneys over the years have suggested we stay off social media and do not respond. However, last week the Board was criticized on social media for not requiring sidewalks between the Gardens and the new Wawa just off 195. This Board as an approval requirement insisted that the Wawa and Glory's provide sidewalks literally to nowhere. It is a corner. There is a long sidewalk but they go nowhere because there are no other buildings on any of the three corners. And there are vast empty lots lying between the Wawa and the Gardens apartments. But we realized on this Board that we need to prepare for the future of the Township. So we required sidewalks. This Board has no power to require owners of undeveloped land to install sidewalks. Again, this Board has no power to require owners of undeveloped land to install sidewalks. Further, every applicant before this Board must either include sidewalks or the applicant must pay into the Pedestrian Safety Fund for future sidewalks installation as determined for pedestrian safety. Dr. Campbell thinks it is important that we point these things out so that the people at home, when they look at property and they ask why the Board did not make them put a sidewalk there, we cannot. It is undeveloped property and we cannot force somebody to put sidewalks on undeveloped property. Mr. Bressi stated that the Pedestrian Safety Fund goes back many years. These funds get put aside so that as they are needed more importantly in other areas they can go in as needed. It has paid off in the long run. Rather than putting a sidewalk in the middle of a nowhere just for the sake of it, he would rather see the money come in and put towards the Pedestrian Safety Fund.
Mr. Shea announced that the Board has to do a consistency review for pending Ordinance 2026-25 that is in front of the Council at this point. The standard that the Board would have to make a vote as to whether or not it is not inconsistent with the Master Plan. The language of the statute is tricky in the fact that it frames it as not inconsistent. It kind of sounds like a double negative, but that is the way that the statute uses the language, which is why we phrase the motions in that manner. Just be cognizant of that when whoever is making the vote that we just use the appropriate language while the vote is taking place. Dr. Campbell asked Mr. Peters how long he has served in Jackson on this Planning Board. He replied on and off for 24 years. Mr. Peters reminded the Board that the statute that Mr. Shea referred to is what we are here to talk about. The requirement when the governing body sends something down to the Planning Board is in the New Jersey Municipal Land Use Law under 40:55D-62, which indicates that the governing body may adopt or amend a zoning ordinance relating to the nature and extent of the uses of land and
