RESOLUTION AUTHORIZING THE EXECUTION OF A DETENTION/STORMWATER BASIN OWNERSHIP, OPERATION AND MAINTENANCE AGREEMENT BETWEEN THE TOWNSHIP OF JACKSON AND MAZ PROPERTIES, LLC FOR BLOCK 4601, LOTS 9,10 AND 11
WHEREAS, Maz Properties, LLC has previously received approval from the Jackson Township Planning Board with respect to the property commonly known as Lots 9, 10 and 11 in Block 4601 as shown on the official tax maps of Jackson Township; and
WHEREAS, in accordance with said approvals, the applicant is required to the enter into a Detention/Stormwater Basin Ownership, Operation and Maintenance agreement with respect to the future maintenance of the stormwater management facilities at the subject property; and
WHEREAS, the proposed agreement is attached hereto as Exhibit A;
WHEREAS, the Township Council wishes to authorize the execution of said agreement;
- NOW, THEREFORE, BE IT RESOLVED this 12th day of September, 2023, by the Township Council of the Township of Jackson, County of Ocean, State of New Jersey, as follows:
- The Township hereby authorizes the execution of the Detention/Stormwater Basin Ownership, Operation Maintenance agreement in the form attached hereto as Exhibit A.
- BE IT FURTHER RESOLVED that the Township Mayor, Township Clerk and such other Township officials as may be necessary are hereby authorized to execute said agreement; and upon the execution of said agreement, the applicant will have been deemed to satisfy this condition of approval.
- BE IT FURTHER RESOLVED that a copy of this Resolution be forwarded to the following:
- Stephen J. Schreiber, Township Engineer;
- Mary Moss, Township Clerk;
- Gregory P. McGuckin, Esq, Township Attorney;
- Maz Property, LLC, Applicant
- Graham Macfarlane, Applicant's Engineer
