RESOLUTION OF THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF JACKSON, COUNTY OF OCEAN, STATE OF NEW JERSEY AUTHORIZING THE RELEASE OF A PERFORMANCE GUARANTEE FOR JACKSON RETREAT, LLC, BLOCK 2901, Lot 14.01

WHEREAS, Jackson Retreat, LLC has previously received approvals from the Jackson Township Planning Board with respect to the property commonly known as Lot 14.01 in Block 2901 as shown on the official tax maps of Jackson Township; and

WHEREAS, in accordance with said approvals, the applicant has posted a performance guarantee in the amount of $459,015.66; and

WHEREAS, by letter dated July 3, 2023, the Township's Engineer, T&M Associates, has recommend to the Township Council that the applicant's performance guarantee be released upon the posting of a two-year maintenance bond in the amount of $63,752.18; and

WHEREAS, said recommendation results from the engineer's findings that all bonded improvements have been installed and are acceptable and in general conformance with the approved plans; and

WHEREAS, the Township Council wishes to accept the recommendation of its consulting engineer;

NOW, THEREFORE, BE IT RESOLVED this 12th day of September, 2023, by the Township Council of the Township of Jackson, County of Ocean, State of New Jersey, as follows: 1. The Township hereby authorizes release of previously posted performance guarantee of Jackson Retreat, LLC in the amount of $459,015.66, conditioned upon the applicant posting a two-year maintenance bond in the amount of $63,752.18.

BE IT FURTHER RESOLVED that the Township Mayor, Township Clerk and such other Township officials as may be necessary are hereby authorized to execute any and all documents necessary to implement the intent of this Resolution.
BE IT FURTHER RESOLVED that a copy of this Resolution be forwarded to the following:
Mary Moss, Township Clerk;
Sharon Pinkava, CFO;
Stephen J. Schreiber, Township Engineer;
Gregory P. McGuckin, Esq, Township Attorney;
Jeff Purpuro, Zoning Officer;
