MOTION TO AMEND AGENDA TO ADD ORDINANCE 12-20 FOR FIRST READING BY: BRESSI
SECONDED BY: FLEMMING
YES: BRESSI, CHISHOLM, FLEMMING, KERN, SAUICKIE
PROCLAMATION: SAL VIGILANTE-COUNCILMAN CHISHOLM READ THE PROCLAMATION.
COUNCIL PRESIDENT SAUICKIE- thanked everyone for attending the meeting and congratulated Mr. Vigilante on his retirement. The proclamation read by Councilman Chisholm captured how thankful our residents and town feel in regards to Mr. Vigilante and his donut shop.
Our town had an unusual and unwelcome party of 700 attendees at a rental property. It was held in the center of a quiet development in Jackson. Our Police Department again showed why they are “second to none” in the State. The Police Officer at the scene called for additional officers once the party reached 200 people. The Officer requested backup from other municipalities, State Police and Prosecutor’s Office to control the situation. By calling for additional aid, Jackson Police prevented this matter from escalating. We should be proud that our Police Department was able to disperse 700 people without incident. The owner allowed for outside entities to advertise a party going against an Executive Order related to COVID-19 and our local ordinances in regards to public nuisance. Once again Jackson was painted negatively in a negative spotlight by people that do not reside in our town. Those individuals who continue to cause havoc and disturb the “quality of life” expected and deserved, will not be tolerated. Summonses have been issued to all parties involved including the homeowner and the party organizer. We are confident that the Jackson Police Department will investigate and issue additional summonses if necessary. We have spoken to representatives of Airbnb and the property listing was removed. The Council requested the Township Attorney to take all steps necessary to hold the homeowner accountable for the services dispersed in containing the illegal party. Even though it was great to have professional police presence in order to disperse the party those services may come to a cost. It should not be at the cost of Jackson’s tax payers. An ordinance will be added to our agenda to ban Airbnb rentals for less than 30 days which will also include pool rentals. This Council repeatedly fights for our residents’ “quality of life” and to ensure these incidents do not occur.
COUNCILMAN BRESSI – stated today we recognized Mr. Vigilante for all his accomplishments. He still took the time to recognize our First Responders, Police Department, Fire Department, EMS and Armed Forces. He took the time to acknowledge this country and provided a tribute to his beliefs and this country.
Our Police Department provided a quick response without an incident at the party held on Sunday. He expressed that our Police Department has a great force who recently promoted
===== PAGE 3 =====
Police Officers with many qualifications. This weekend they showed how great they are and we appreciate the caliber of our Police Department.
COUNCILMAN CHISHOLM- congratulated Mr. Vigilante on his retirement and wished him well. Echoed comments made by Council President Sauickie.
COUNCILMAN FLEMMING-congratulated Mr. Vigilante on his retirement and wished him well.
COUNCIL VICE PRESIDENT KERN – congratulated Mr. Vigilante on his retirement. On the agenda we have a resolution to add a question on the ballot for November in regards to increasing the open space fund. The funds would be used for historical preservation, and farmland preservation which currently is not included. This 2020 Council has been clear since the beginning in its intent to continue our open space policy. We will protect our town against overdevelopment. In 2004 the open space fund was increased and then lowered due to the recession in 2010. We can submit a resolution for the increase in the open space fund but the council prefers to let voters to decide on Election Day. The Historical Preservation will allow us to preserve land such as Rova Farms, which the Township purchased last year. The land will be utilized by all residents and our residents can be proud of for generations to come. The council’s intent until November, is to spend our open space funds on properties we are already working to acquire. These types of land are in line with protecting Jackson and overdevelopment.
TOWNSHIP CLERK KISTY- reminded residents 2020 Census will be held this year and encouraged residents to complete the census online at 2020census.gov. The information provided is completely confidential and it is important for everyone to be counted.

YES: BRESSI, CHISHOLM, FLEMMING, KERN, SAUICKIE
## ORDINANCE 12-20
NOW, THEREFORE, BE IT ORDAINED, by the Township Council of the Township of Jackson, County of Ocean, State of New Jersey, as follows:
SECTION 1. The Township Code of the Township of Jackson is hereby amended and supplemented to establish new Chapter 350 entitled Short Term Rentals which shall read as follows:
Chapter 350
Short Term Rentals
§ 350-1 Purpose and scope.
A. The Township of Jackson is authorized to regulate buildings used for sleeping, lodging and occupancy for purposes including but not limited to boarding houses, rooming houses, rental housing or other living units pursuant to N.J.S.A. 40:52-1 et. seq. In addition, N.J.S.A. 40:48-2.12(a) provides that the governing body of a municipality may make, amend and repeal and enforce ordinances to regulate buildings and structures and their use and occupation to prevent and abate conditions therein harmful to the health and safety of the occupants of said building and structures and the general public in the municipality. This article aims to curtail, and in certain circumstances prohibit, the increasingly widespread practice of renting or leasing various types of dwellings, or segments thereof, located primarily in residential neighborhoods, on a short-term basis to transient guests. This practice has been popularized and facilitated by various websites that advertise and broker these rentals. Left unregulated, this practice will transform many residential dwellings into flophouses to the detriment to the health, safety, and quiet enjoyment of the affected neighborhoods.
B. This article does not apply to lawfully established and operating hotels, motels, rooming houses, boardinghouses, and bed-and-breakfast establishments.

WHEREAS,thereafter, pursuant to Ordinance 03-10, the Township of Jackson reduced the amount of the open space tax to 2.0 cents per $100.00 of assessed valuation, which is the rate at which the Open Space Trust Fund is currently funded; and

a) Acquisition, development and maintenance of lands for conservation and recreation purposes;
b) Acquisition of farm land for farm land preservation purposes;

d) Payment of debt service on indebtedness issued or incurred by the Township for the purposes set forth in paragraphs a through d; and
NOW, THEREFORE, BE IT RESOLVED, this 28th day of July, 2020, by the Township Council of the Township of Jackson, County of Ocean and State of New Jersey as follows:
1. The Township of Jackson hereby requests the County Clerk of the County of Ocean to print upon the official general election ballot of the next general election to be held on November 3, 2020, the following proposition question:
“Should the Jackson Township Open Space Tax be reestablished at the rate of 3 cents per $100.00 of equalized valuation pursuant to N.J.S.A.40:12-15.7, etseq., and such Open Space Trust Fund be utilized for the acquisition, development and maintenance of lands for recreation and conservation purposes, the acquisition of farmland for farmland preservation purposes, the historic preservation of historic properties, structures, facilities, sites, areas or objects, and the acquisition of such properties, structures, facilities, sites, areas or objects for historic preservation purposes, and for payment of debt service on indebtedness issued or incurred by the Township for the purposes set forth herein?”
===== PAGE 11 =====
2. The Township of Jackson requests the printing upon said general election ballot the following explanatory statement of the proposition question presented:
“In 2001, the voters of Jackson Township authorized the establishment of the Township’s Open Space Trust Fund and the imposition of an open space tax equal to 1.5 cents per $100.00 of equalized valuation. Thereafter, in 2004, the voters of Jackson Township authorized the increase of said open space tax to 3 cents per $100.00 of equalized valuation.
Said tax is currently collected at the rate of 2 cents per $100.00 of equalized valuation, and a “yes” vote on this question would reconfirm the wishes of the Township’s voters to provide for an open space tax at the rate of 3 cents per $100.00 of equalized valuation while permitting said funds to be utilized for the acquisition, development, maintenance, preservation and payment of debt service for conservation, recreation, farmland and historic properties and structures. The increase would fund additional acquisitions and improvements of open space by the Township.”
3. The Township Clerk is hereby authorized and directed to forward a certified true copy of this Resolution to the County Clerk of the County of Ocean on or before August 14, 2020.
4. This Resolution shall become effective immediately upon adoption.

## PUBLIC COMMENT, ANY TOPIC
GAVIN KOHUTE- 405 BURKE ROAD- he is organizing a 5k mile for an Eagle Scout Project for Life Scout Troop #204. The event will honor First Responders, and benefit Jackson Volunteer Fire Company. The event will be held on August 29, 2020 at Johnson Park. A scholarship will be given to a Jackson Township student with parents who are First Responders. Thanked Council President Sauickie, Business Administrator Wall and Joelyynn Anderson. He is seeking additional advertisement on this event as more runners and walkers are needed. He distributed flyers with additional information and signup sheets for anyone interested in participating.
COUNCIL PRESIDENT SAUICKIE- asked Mr. Kohute to distribute the flyers to those residents who are interested or he can place the flyers on the table for distribution. He stated this a great event that he planned and he is a fan of the Boy Scouts. Congratulated Mr. Kohute for trying to advance into the Eagle Scout, it is a great accomplishment.
Thanked Mr. Kohute for this event benefitting the town and the First Responders.
COUNCILMAN BRESSI- stated it is an excellent project and complimented Mr. Kohute for moving forward to the Eagle Scout.
LISA GOMEZ-2 ROUND HILL ROAD- thanked the First Responders, and the multijurisdictional agencies who were involved in containing this party. The residents are used to a safe and quiet neighborhood. The attendees of this party intended to do harm and our town cannot allow for these situations to continue. She supports the Jackson Police Department and does not believe in defunding the Police. She wants a response instead of a summons in these types of cases. She expressed she felt fear in her own home and wants the council to address this matter.
COUNCIL PRESIDENT SAUICKIE -the Council concurs with the statements made by Ms. Gomez and the introduction of this ordinance will prevent short term rentals for less than 30 days. In addition, the Police and our Township Attorney continue to investigate in order to determine additional summons and citations can be accessed. Some violations were assessed the same day as they violated COVID-19 executive orders and were processed by the Ocean County Prosecutor's Office. He is confident that the Police Department and Township Attorney will seek additional citations. This ordinance was a decisive action by the council.

NINO BORELLI- 36 WINTHROP DRIVE- thanked Jackson Police Department and the Law Enforcement Officers who handled the house party that was held with 700 people. Jackson Police Department is “second to none” as Council President Sauickie stated. Thanked God no one was injured. Thanked council for allowing voters to determine if the open space tax should be increased by voting on Election Day. He also thanked the council for voting for the Special Resource Officers. The public safety of our students, staff and schools is an important matter.
KATHY MALLETTE- 17 KNOLLS DRIVE- contacted the Mayor in regards to her client obtaining an easement. She has spoken to several departments in the township without success. The address is on Holman Place. An easement was available on the property previously but documentation is unavailable. She has provided the township with all the documentation that is available.
BUSINESS ADMINISTRATOR WALL- asked for the property address and asked if this matter was connected to an easement on that property from 15 years ago. Asked Attorney McGuckin whether this address is familiar to him.
ATTORNEY MCGUCKIN- he will follow up with the Engineering Department and provide available information at the council meeting to be held on August 11, 2020.
ROBERT SKINNER- 404 LARKSPUR LANE- asked the protocol for vacating Broadway Avenue and asked if there is a scheduled date for the rent leveling ordinance. Questioned if the council reviewed the rent leveling ordinance. In regards to Ordinance 12-20, he asked for the council to review the rental ordinance Toms River approved in their township.
BUSINESS ADMINISTRATOR WALL- he stated to Mr. Skinner that his inquiry was referred to Julio Vega (Township Engineer). The Township Engineer will review and comment prior to the council taking any action on this matter.
COUNCIL PRESIDENT SAUICKIE- Council Vice President Kern will be involved in the rent leveling ordinance and has the confidence he will do a great job. Responded to Mr. Skinner by stating that our ordinance is very similar to that of Toms River. Our ordinance will be highly effective in our town.
COUNCIL VICE PRESIDENT KERN- he reviewed the rent leveling ordinance thoroughly. A discussion will be held this week to determine the best course of action, but he couldn't provide a date for introduction at this time.
