L. Annual report. The Construction Official shall, with the advice of the subcode officials, prepare and submit to the Township Council, no later than November 30, an annual report recommending a fee schedule based on the operating expenses of the agency, and any other expenses of the municipality fairly attributable to the enforcement of the State Uniform Construction Code Act, P.L. 1975, c. 217, as amended.

SECTION 2. All ordinances or parts of ordinances inconsistent herewith are hereby repealed.

SECTION 3. If any section, subsection, sentence, clause, phrase, or portion of this ordinance is for any reason held to be invalid or unconstitutional by a court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions hereof.

SECTION 4. This ordinance shall take effect after second reading and publication as required by law.

The Township Code of the Township of Jackson is hereby amended and supplemented so as to amend Chapter 216, entitled “Garbage, Rubbish and Waste Material,” so as to amend §216-51 entitled “Improper disposal, violations and penalties” so as to amend subsection B. so that it shall read as follows:
