===== PAGE 1 ===== A special meeting of the Millcreek Township Transition Advisory Committee was called to order at 6:00 p.m. by Chair Thomas Laird in the Assembly Room of the Millcreek Township Municipal Building. Present were John DiPlacido, Cody Foust, Dennis McAndrew, Brian McGrath, Kylie Morris, DO, and Matthew Waldinger. Following the Pledge to the Flag, Mr. Laird announced the purpose of the special meeting, which is to review the administrative code and questions that committee members have. It was decided to walk through an email circulated by Chairman Laird and then cover any items that were not discussed through those questions. Discussion topics covered the effective date of the code, the effective date of ordinances being ten days after adoption, a resolution to continue operations for up to 60 days, powers and duties of council and the manager, and references to the Township's Code of Ordinances compared to the Optional Plans Law or the Second Class Township Code. Most of these issues are in need of further legal review. Additional topics included council vacancies and the process to fill them, compensation of council, the addition of a vice chair to serve in the chair's absence, providing time for residents and taxpayers of Millcreek to speak at meetings, reiterating some items related to public meetings that are included in the Sunshine Act, and what items require a majority of the full council and what can be done with a majority of any quorum present at a meeting. Discussion continued regarding the frequency of council meetings, including abstentions in the roll call of votes, council's ability to investigate the manager if desired, manager residency requirements, bonds required for the treasurer and the manager, the extent to which the Second Class Township Code governs when the Optional Plans Law is silent on a matter, whether the manager would be eligible for severance pay, the timing of filling manager vacancies, and more details on the duties of the manager. Additionally discussed were appointive offices in the township – secretary, solicitor, and engineer – and how those appointments are made, adding descriptions to the departments listing, how the township categorizes "offices" within the department structure, how the personnel system could work, having the manager recommend the auditor to council, who designates alternate signers for accounts, and including portions of the PA ethics code in the document. Following these discussions, the committee agreed that many items need further legal review or clarification. Mr. Laird stated he received a quote from local attorney Tim Wachter that he would like to present to the Supervisors for their consideration. Mr. DiPlacido also received quotes from two consulting firms, ALOM and Kafferlin Strategies to pass along to the Board as well, and Mr. Laird was going to prepare a quick agenda request to try and get this item discussed at the October 27th Supervisors meeting. The Chair moved on to Citizens to Be Heard and Candy Horm appeared to request the names of the attorney and consultants, and asked about how the manager fits into the picture when council appoints the secretary, solicitor and engineer. Jerry Servidio appeared to ask about the consultants being recommended and shared his thoughts on the candidates. ===== PAGE 2 ===== There being no other Citizens to be Heard, the meeting was adjourned by unanimous roll call vote at 7:25 p.m. on motion by Dr. Morris, seconded by Mr. DiPlacido. Respectfully submitted, Matthew D.
