## ORDINANCES, FIRST READING:
ORDINANCE: 30-16
### ORDINANCE: 30-16 TITLE: AN ORDINANCE OF THE TOWNSHIP OF JACKSON, COUNTY OF OCEAN, STATE OF NEW JERSEY AMENDING AND SUPPLEMENTING THE TOWNSHIP CODE OF THE TOWNSHIP OF JACKSON, SO AS TO AMEND AND SUPPLEMENT CHAPTER 244, ENTITLED, "LAND USE AND DEVELOPMENT REGULATIONS," SO AS TO CREATE S 244-53.1, TO BE ENTITLED, "PIC PLANNED INCLUSIONARY COMMUNITY ZONE"
Attorney Cipriani explained this ordinance was presented and prepared by the developer, EL @ Jackson, per the terms of a Consent Order. The Township has been involved in Affordable Housing litigation and EL @ Jackson is also involved in that litigation, as this is the old Hovbilt project which was approved many years ago. It was not built by Hovbilt and the property was sold off. EL is currently in the plan to be converted to a certain amount of family units. The existing ordinance reflects the prior project and the developer is seeking the creation of alternative zoning, by way of this ordinance. The Consent Order states that the developer could propose an ordinance for Council’s consideration. Mr. Maczuga and I made requests/suggestions that were incorporated into this proposed ordinance.
She advised that as part of Council’s consideration, she would read Mr. Maczuga’s 11-16-16 report on the proposed ordinance into the record and that we need to put our reasons for any action on record. Ms. Cipriani read the report into the record advising the 9-16-16 Consent Order in this matter requires the Township to “hold a hearing to consider and vote to either adopt the draft ordinance submitted by EL or shall place upon the record at a public hearing its reasons for not adopting the draft ordinance proposed by EL.” EL @ Jackson submitted a draft ordinance on 9-21-16 and my memorandum dated 10-21-16 listed 12 comments pertaining to that draft ordinance. A meeting was held on 11-1-16 attended by representatives of EL @ Jackson, Jackson Township and Phil Caton, Court Master. My 10-21-16 memorandum served as the basis for the discussions. On 11-9-16, Frank Petrino, Attorney for EL @ Jackson, submitted a revised draft dated 11-9-16 stating “the revised draft” has been conformed to incorporate the changes in items 1 to and including 11 of Mr. Maczuga’s 10-21-16 memorandum”. The statement is totally inaccurate. Beginning with the comments in my previous memorandum, the following comments are offered:
1) Item 1 of my 9-21-16 memo indicated “the ordinance as proposed contains no reference to any specific property to be rezoned “PIC” and would not rezone the EL @ Jackson property or any property for that matter”. The revised draft ordinance has not addressed this comment and doesn’t identify any property to be rezoned. If adopted as drafted, it would only create a PIC Zone.
2) Item 2 of my 9-21-16 memo was a statement.
3) Item 3 of my previous memo referenced the provisions dealing with the required affordable housing set-asides per the Affordable Housing Agreement (AHA), as amended. The current affordable housing agreement requires 20% of the total units to be set-aside as affordable units regardless of whether the units are for sale, rental or mix. The revised draft ordinance Section H.(2) provides that the affordable housing set-aside would be 15% “if said units are rental”. This provision is contrary to the existing AHA and would require an amendment of the AHA. It also unclear what quote “said units” refers to.
4) Items 4 & 5 of my previous memo, the revised ordinance would remove the former provision permitting 50% of the required affordable units to be constructed at an unspecified off-site location(s). The revised ordinance would require the affordable units to be constructed onsite.
5) Item 6 of my previous memo, section 244-224C of the Land Development regulations providing that “affordable units shall be situated on the development tract in locations no less desirable than the market priced dwelling units in the development and shall be accessible to the common open space, common facilities and shopping facilities”. The revised ordinance purports to address the concern expressed by the Township about overly concentrating large numbers of affordable units in a given location through the addition of the following sentence found in section H.(2) of the revised draft. “Affordable units may be aggregated by building and/or neighborhood, if they are for rent”. It is not clear to me what this means but since “aggregated” means combined into one it doesn’t address the concern. Furthermore, section L of the revised ordinance provides that “any multi-family and/or affordable housing units may be part of a separate homeowner’s association”. This
===== PAGE 16 =====
provision allowing the affordable housing units to be part of a separate homeowner’s association is contrary to section 244-224C.
6) Items 7 – 11 in my previous memo have been addressed either in the discussions with the parties or through provisions to the ordinance.
7) The revised ordinance hasn't addressed any of the issues (clubhouse and bedroom restrictions and small minimum lot sizes) raised in Item 12 of my previous memo.
8) The draft ordinance references section H.(1) the “maximum permitted gross residential density of a PIC shall be 1100 units.” First, 1100 units is not a “density”. The ordinance should have read the “maximum number of dwelling units in the PIC Zone shall be 1100 units. As written, since the minimum size of a PIC Zone is 100 acres, EL could technically claim both halves of the site are separate PIC and an entitlement of 2200 units.
9) Section H.(2) contains the following language: “The development of the PIC shall be subject to the applicable Affordable Housing Agreement and any applicable amendments to the Affordable Housing Agreement, unless inconsistent with the terms hereof, in which case the provisions of this ordinance control.” I will leave the legality to Township Counsel of whether this ordinance would supersede an Agreement approved pursuant to Court Order, however, in my opinion it is unacceptable as illustrated by the preceding item above.
10) Several items discussed at the November 1 meeting, and which I assumed to have been agreed to, are not reflected in the revised ordinance:
a) The EL @ Jackson representatives offered a 50% veterans preference on the affordable units within the PIC; and
b) The revised ordinance was to provide that detached single family and duplex lots were to have a 40% maximum building coverage requirement and a 60% maximum impervious coverage requirement.
11) As a general comment, notwithstanding the right per Court Order to do up to 1100 non-aged-restricted units on the site, EL’s current plans to keep substantially intact the roadway configuration approved for the age-restricted community will result in a development characterized by a significant percentage of the units comprised of very small lots with large detached single homes lining long curvilinear streets which, in my opinion, is not particularly appealing.
12) Exactly how between 192 and 220 affordable units are to be placed within the townhomes, stacked townhomes and 3-story “flats” comprising the remainder of the residential units in the development is undeterminable as the ordinance is currently written.
Attorney Cipriani advised pursuant to Court Order, it was required that the Council consider this ordinance. You have heard and I have read into the record the comments of our Affordable Housing Planner who is extremely familiar with this site and the Township’s needs. Council had no questions or comments for Attorney Cipriani.
There was no motion or second, therefore, ordinance dies and does not move forward.
Applause.

## DISCUSSION AGENDA:
### 1. TOWNSHIP CLERK EDEN
a. Bidder Pre-Qualification – Sale of Distribution and Consumption Licenses – Council had previously authorized the sale of one distribution license and two (2) consumption licenses. We did not receive any pre-qualification material for the consumption license(s); however, we did receive pre-qualification material for the distribution license. As required, I am publicly announcing those who have pre-qualified to partake in the public sale of one (1) distribution license. The Township of Jackson previously advertised for the sale of (1) plenary retail distribution license which is scheduled for public auction on December 7, 2016 at 10:00 a.m. The Township required that any interested bidder must be deemed qualified to hold liquor license within the State of New Jersey and submit their pre-

qualification package to my attention on or before November 16, 2016 by 11:00 a.m. The following individuals submitted their pre-qualification documentation along with the required 10% deposit of the minimum starting bid. Avanti & Sunyi Patel and Mahansandrum Reddy have submitted the paperwork along with the required deposit. I have completed my review of all pre-qualification materials submitted and hereby announce pursuant to N.J.S.A. 33:1-1 et. seq. and N.J.A.C. 13:2-1.1 et. seq. that these individuals are qualified to hold a plenary retail distribution license in the State of New Jersey and are further qualified to partake in the sale of (1) plenary retail distribution license by way of public auction to be held on December 7, 2016 at 10:00 a.m. here in the main meeting room of the Municipal Building.
b. January 2017 Re-Organization Meeting date and tentative Council meeting dates for CY 2017 – Township Clerk Eden provided Council with various meeting dates for 2017 and suggested they review and will discuss further/confirm dated on December 13, 2016.
c. Annual Chanukah Menorah Lighting is scheduled on December 29, 2016 from 4:30 – 6:00 p.m.
d. Toyland is scheduled on December 3rd & 4th.
e. Tree Lighting is scheduled for Saturday, December 3rd.
Councilman Calogero had acknowledged Council Vice President Bressi & his wife, Karen on their 45th Wedding Anniversary. Applause.
### 2. ADMINISTRATOR SCHLEGEL
a. Rental registration – the Code Compliance Supervisor has requested the Code Enforcement registration be discussed and currently it is up January 31st of each year. We’re requesting an amendment to that which would read “on an annual basis”. If a landlord had registered in November 2016, they would be required to renew November 2017. It helps with the clerical staff and we’ve verified with the computer software vendor confirming that it will inform us 30 days prior to the deadline that it’s up for renewal. We’ve listened to the complaints received and request it be changed to a annual basis. Upon further discussion, Council agreed. An ordinance will be prepared (for the December 13, 2016 meeting) reflecting an annual registration beginning on the anniversary date of the landlord’s initial filing.
## PUBLIC COMMENT, ANY TOPIC
JOHN WALKER – 2 EVERGREEN COURT – seeking an update on the engine braking ordinance and Administrator Schlegel had no update. She stated that our DPW Director contacted the Police Department who has to meet with the County. She will follow up and advise Mr. Walker.
RICHARD EGAN – 526 DIAMOND ROAD – wanted to discuss billboards on I-95 and Attorney Cipriani will look to see if the land is outside of the State’s moratorium. She advised the State is not erecting billboards on their roadways and it will have to be researched. Councilman Calogero thought it was a great idea and requested a follow up at the next meeting and Council President Nixon agreed to proceed.
ESTER PETERSON – 1 DETROIT COURT – informed a pole barn was installed at 937 Woodlane Road and none of the neighbors knew anything about it. The rumors are they will be having a petting zoo. Council President Nixon advised it’s a matter for Administration/Code Enforcement and he confirmed that neither she nor any of her neighbors contacted Code. Administrator Schlegel advised they need a permit to build the pole barn but the neighbors might not have had to be informed. She requested Ms. Peterson to email her about this property and she will reach out to the Building and Code Enforcement Department regarding permits.
SHELDON HOFSTEIN – 48 BALTUSROL DRIVE – I have a relative in the billboard business and if you have 6 billboards built on Township property, the going rate is approx. $3,000/month or $216,000/year. It’s open to negotiations.
A law was filed in Federal Court under the Religious Land Use Institutionalized Persons Act/Fair Housing Act - 1st & 14th Amendment and NJ Municipal Law Act regarding the

denial of an educational facility. This facility would consist of a 17,000 sq. ft. classroom building, 19,000 sq. ft. dorm, (7) 2-story faculty houses and 140 male students (ages 14-22). If the applicant wins, they’ll receive compensatory damages, court costs and attorney fees. Upon reviewing our code book, we have no definition of an educational facility or no mention of it. Chapter 244-46 entitled R-2, R-3 and R-5 Zones allows schools, public schools that operate non-profit and specifically the exclusion of universities and colleges. I advise for this to be looked into and whether you want them in our town; if so, where they should go. Hopefully, you’ll decide they should not be permitted in our town and making sure every zone in our ordinance states that. There are a number of these throughout the State. Time is of the essence as there are areas being looking at for a similar facility.
Dr. Hofstein read from a statement. President Elect Trump won by promising to make America great again by changing the status quo. By winning the Republican Primary he destroyed the Republican establishment, by winning the General Election, he destroyed the Democratic establishment. Even though New Jersey is Democratic in Ocean County, Mr. Trump received two-thirds of the vote. In our diversified town, he received approx. 62% of the vote. However, there are other towns in Ocean County that beat our numbers including a town with a large population that gave over 75% of the vote. The Republican Leader of Ocean County takes credit for the huge turnout for Mr. Trump. In next year's General Election for Governor of New Jersey, the Republican candidate will need an overwhelming turnout of voters in order to win. Remember that Governor Christie won because of the Ocean County vote and the win gives this leader a powerful vote in state government.
The same party leader is also principal of a law firm that provides our Township Attorney. We will, of course, continue to receive proper legal representation and advice. Because there are other towns that will provide more votes for a candidate, will he be tempted to place his needs before Jacksons to advise, make recommendations and appointments. How much input and influence does he have in the decisions of appointments of professionals and others in this town. Does the Mayor and Council meet with him to discuss the aforementioned and most importantly does he have a conflict of interest where he has business on one side and political on the other side?
On Election Day, I worked in a district where many long-time voters and former voters came out to vote for a change and to vote against the establishment. Many cast their votes for one person and skipped voting for the remainder of the ballot. Around 52-53% of the voters cast a ballot for Council Members which means the remainder did not vote for you. The same party leader got 0% of the votes here. You may have received money from the County political leader for your campaign or from professionals seeking favors. This election proves raising the most money doesn't mean you'll be elected. The National Elections were won by a person who had a message and was the messenger. The question is what is your message? It is my opinion that the first change you should make should be for a new Township Attorney from a new firm that has no conflicts of interest. Not one that gave us the likes of Mark Seda, Angelo Stallone, Phil DelTurco and Joey Torres. Thank you. Council President Nixon thanked him for his insight. Applause.
DAVID VISCONI – 441 WHITESVILLE ROAD – the condition of E. Veterans Highway between Butterfly/Whitesville Road. The road is a rumble strip and a mess. There has been some construction work and I was wondering if Council is aware what the County’s plans are for improvement of those roads. Council President Nixon advised that project was to start in July and was frozen when the Governor froze the trust funds. I’m not sure of their schedule and I am aware they are doing drainage work and clearing/widening there now.
Administrator Schlegel informed she will follow up on it and believes with the change in weather, there might not be asphalt work.
Mr. Visconi asked about 504 Whitesville Road that was purchased by Quack Industries. Their intention was to move their facilities there but unrealistic about the amount of property needed. They misuse the property by ripping out trees/brush and realizing their situation, they withdrew their proposal. My concern is the wetlands in the rear which they filled in with concrete. The neighbor took photos and I walked the property. My concern is rehabilitating the wetlands that they filled in. How do we go about making them repair the damage they caused and did improperly. Administration Schlegel advised the DEP is the correct entity and we would have to meet. Council Vice President Bressi advised in addition to the concrete,
===== PAGE 48 =====
they also put pressurized wood there and put the containers on the property line. It was rejected and they walked away from it. He advised it should be followed up with the DEP. Mr. Visconi confirmed Code Enforcement would coordinate with the DEP.
## DENISE GARNER – 14 EVERGREEN COURT – informed that property (504
Whitesville Road) has about 183 violations. The DEP has been out there numerous times and it seems the owner is refusing to pay the violations. I walked the property and I found out that the NJDEP has issued letters and copied the Township. Why hasn’t the Township stepped in to forcibly take this owner to task? It’s been going on for years. I wrote up an extensive Environmental Impact Statement and it still sits. The DEP has told them to fill in and correct those problems. Administrator Schlegel stated the DEP is the enforcing agency and not the Township. I disagree that it is the Township. Ms. Garner stated that didn’t happen and there is a long history on that property. Council Vice President Bressi explained they had an application and it was denied. They came in again and then rescinded. There is no application to be heard or presented to the Planning Board. Council President Nixon stated the DEP is not shy in issuing a violation or chasing down the violators. The DEP needs to step in and enforce their rules.
Ms. Garner asked about the Southern Reliable Line that is coming through Jackson. A letter was submitted to the Township and as a Council, you didn't comment on it. As a Commissioner, I did. It will go through contaminated sites and there is a possibility of a threat to the residents in those areas. I'm surprised you haven't attended any of these meetings. I have a map if you'd like to review it and perhaps you can write a letter of concern. If this goes, we'll have a big problem. Council President Nixon advised he would like to see what she has. Applause.
Council President Nixon advised comments are through the Chair and we will not have individual members on the dais speaking over one another and will not be confrontational. When someone is speaking, we will not speak over each other.
ELENOR HANNUM – 7 EVERGREEN COURT – questioned why the bids were rejected on Resolution 362R-16. Attorney Cipriani advised the specifications will be amended and it will be reposted. Township Clerk Eden advised the opportunity to question the Resolutions was earlier in the meeting.
Ms. Hannum stated we noticed the Police contracts changed from $5,000 to $55,000 and another from $5,000 to $65,000. She felt the electronic statements were broad and Administrator Schlegel advised there was a $49,500 increase for Police communication equipment for the vehicles. Also, an additional $10,500 for other anticipated equipment needed by the end of this year. Their equipment needs to be upgraded. Ms. Hannum asked about Blue Line and Administrator Schlegel advised it was for emergency lighting equipment to outfit the 2017 vehicles ($11,097 each) and anticipated future purchases for another $10,000.
Under 357R-16 Mayor Reina appointed an additional member to the Private Residential Communities Advisory Board. We have an open seat for the Planning Board since August and is there a reason why our Mayor hasn’t appointed someone to that position. Council President Nixon advised we’ve asked the Mayor to provide us with names and we’re waiting for him to update us for his recommendations and we’re anticipating these seats will be filled soon. Council Vice President Bressi advised since 2006, the Planning Board has never cancelled a meeting due to a lack of quorum.
Ms. Hannum asked Attorney Cipriani where the anticipated project is located for Ordinance 30-16 and Ms. Cipriani advised off of Perrineville Road (the old Hovbilt property). Ms. Hannum asked who recommended it and Attorney Cipriani explained it was a request from the developer as a result of a Court Order. Ms. Hannum had concerns about city water and/sewer out there and Attorney Cipriani stated it was presented by the developer.
Ms. Hannum asked about the Executive Session with the land donation to Ocean County and Attorney Cipriani stated any action from that discussion would be in a form of an ordinance and she would have the opportunity to comment on it then.
===== PAGE 49 =====
Ms. Hannum wanted the stance of Council as she and Ms. Walker had been trying to have legislation pushed forward by Assemblyman Dancer regarding the cease and desist. There is another incursion of people pushing to get our residents to sell their home. Council President Nixon advised when Assemblyman Dancer can come up with a statute that is constitutional, I would support it. We’ve discussed this issue many times and I would prefer to see the legislature act on it as they’ve done in other places. Ms. Hannum disagreed that it was not unconstitutional. There are people receiving mailers from Brooklyn and they are highly offended and worried. It would be nice if our local leadership supported legislation for cease and desist. Council President Nixon stated once he sees the introduction with a Bill Number that the Council could consider and if it’s something that is done correctly, you’ll see the sense of this governing body on it.
CHRISTINA KISSEBERTH – 40 NO. LAKESIDE AVENUE – looking for an update to the audio in the main meeting room. Council Vice President Bressi advised it's been asked continually since 1985 and it's a horrible system and Council has asked for it several times. Administrator Schlegel advised it will be seen in the capital budget. Ms. Kisseberth asked for a visual for those that are elderly or with small children. Council President Nixon advised they will move forward with the audio and circle back.
BOB SKINNER – 404 LARKSPUR LANE – Regarding the Rent Control Board, does Jackson Gardens have any rent control units? Council President Nixon advised they have been exempt. He asked if the Board can be notified in advance, when an applicant gets approval that would fall under Rent Control. Attorney Cipriani stated the Planning Board can make that notification for themselves. If it will be required, it will have to come from Council. Council Vice President Bressi stated it did come through Council and he wasn’t sure how they didn’t hear about it. Mr. Skinner is waiting for his meeting and trying to re-write the application and the application process for Rent Control. We have been able to return money to the taxpayers this year,; we’ve levied fines against those who have gone against our ordinance. Council President Nixon advised they’re trying to coordinate the professionals. We’re all proud of the work you and the Rent Control Board have done. You’re doing a wonderful job and we will continue to provide you with whatever resources we can.
LAURA AURIEMMA – 22 GALASSI COURT – On December 6, 2016 in Toms River a meeting is being held regarding a citizen population increase in Ocean County. Will there be a representative from Jackson attending? Council President Nixon stated he has seen a legal notice but not an outline of what it is their looking for. We have not been asked for formal comments. Council Vice President Bressi felt it was a public hearing just for suggestions. Council President Nixon stated the CDBG was the requirement for the hearing. He stated he’ll review his schedule to see if he can attend.
MELISSA BOSTICH – 15 CYPRESS AVENUE – seeking a follow up for the hiring of more Police Dispatchers. We’re already down 2 and 2 are on disability leave. We have 7 full-time dispatchers working 24 hours a day. Are we not of any importance to anyone? I believe they just hired 6 additional Police Officers. Administrator Schlegel advised the interviews are scheduled for this Friday and the process did take longer than expected. Ms. Bostich noted there is a 3-month training period. Council Vice President Bressi stated he has a great respect for dispatchers as his daughter was a certified dispatcher there for many years. Council President Nixon stated without question. Applause.
JOHN BURROWS – 19 LOCUST AVENUE, RED BANK – Thanked Council for all the nonsense they put up with. Recently on Facebook I’ve been a little more involved than I should be and they’re a lot of internet trolls that have nothing better to do than waste their time. None are human enough to do anything about it, just wasting everyone’s time. I know none of you are benefiting for what you do. I’ve been on the Zoning Board for 8 years and never benefited. If anyone wants to prove I’ve taken anything, I’ll bash your skulls in. I’m resigning from the Board and I’m done because I’m moving. They are cowards and you all do an excellent job. I very much appreciate that you go through the trouble you go through to do this; there is no gain. I have tens of thousands of hours of volunteer time in this town, through EMS, Zoning Board, committees and Sunday School. Not one of them have the guts to do anything but you have. Mr. Burrows endorsed Rae Ann Walker for the Zoning Board vacancy/position. Council President Nixon stated they’ll be no lobbying here and we’re very
===== PAGE 50 =====
fortunate to have a lot of people step up. Council thanked Mr. Burrows for his service.
Applause.
HINDY HESS & BRIANNA SERZAN – GEORGIAN COURT COLLEGE – We’re doing a community project on Jackson and the drug epidemic. Council President Nixon stated it wasn’t the proper venue and to see him after the meeting.
MORDECHAI BURNSTEIN – 13 CALIFORNIA DRIVE – he advised he’s new to Jackson. Thanked Council for upholding the quality of life that exists in Jackson. I’ve heard there is a division in Jackson and that people don’t understand us well enough. Sometimes I’ve heard we have done wrong. Does the Council have any suggestions as to the things we can do as residents? As an Orthodox resident what can we do to heal the divide or to explain ourselves to our neighbors and Jackson citizens. Council President Nixon welcomed him and appreciated his comments. I’ve said privately and publicly that I view this community as a wonderful, welcoming community. The laws we write are designed to benefit every resident and to protect the quality of life. Regardless of an individual’s background, it starts at the neighborhood level and it starts by making sure there’s a friendly gesture to letting people know where you’re from. Communication is the best way to build a relationship. I’m aware of the Menorah Lighting. He asked if there is any other event that the Township can have that would be an inter-community event. Council President Nixon suggested speaking to the Mayor/Administration.
