RESOLUTION 408R-11 TITLE: CHAPTER 78, P.L.2011, SECTION 125 PLAN

WHEREAS, pursuant to Chapter 78, P.L.2011, Pension and Health Benefits Reform, the State of New Jersey has made available some sixteen (16) health plan designs, including some low cost and high deductible plans; and

WHEREAS, there have been no changes made to the four (4) existing plans; and

WHEREAS, as part of the State of New Jersey’s new health bill, the Township has a four-year phase in period commencing July 1, 2011 and ending July 1, 2014 as per the Department of Treasury percentage of premium schedule;

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND TOWNSHIP COUNCIL OF THE TOWNSHIP OF JACKSON, COUNTY OF OCEAN, STATE OF NEW JERSEY that staff is hereby authorized to institute the State of New Jersey Health Benefits Program; and

LET IT FURTHERMORE BE RESOLVED that pursuant to the Pension and Health Benefit Reform Act, the Township is mandated to implement two Section 125 plan benefits: a “Premium Option Plan” (POP) and a Flexible Spending Account (FSA); and

WHEREAS, Resolution number 217R-10 authorized a Premium Option Plan on May 25, 2010; and

BE IT FURTHER RESOLVED that the Township Administrator is to undertake all action necessary to implement and administer said plans.

RESOLUTION 409R-11 TITLE: AFLAC, SECTION 125 PLAN

WHEREAS, pursuant to Chapter 78, P.L.2011, the Township is mandated to offer and implement two Section 125 plan benefits: a “Premium Option Plan” (POP) and a Flexible Spending Account (FSA); and

WHEREAS, on May 25, 2010, the Township Council authorized a Premium Option Plan through Resolution number 217R-10; and

WHEREAS, AFLAC currently administers a voluntary benefit program for the Township; and

WHEREAS, AFLAC has offered to provide services to administer a Section 125 Plan, including Flexible Spending Account, Premium Option and Dependent Daycare, at no cost to the Township;

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND TOWNSHIP COUNCIL OF THE TOWNSHIP OF JACKSON, COUNTY OF OCEAN, STATE OF NEW JERSEY that the Business Administrator is hereby authorized to enter into an agreement with AFLAC to administer Section 125 Plans for the Township, including those required in Chapter 78, P.L. 2011.
